  3. Elected officials shouldn’t hire someone they are fucking and they shouldn’t start fucking someone they hired. It’s OK to demand more. It doesn’t change the facts but it shows astonishingly poor judgment to do it and then think it won’t paint a target on you once you take on a former POTUS, even one that’s done everything you have and worse.

  5. Sometimes when you move too quickly, you can overlook things. As my wife's MD Anderson trained oncologist told us, "I know you want us to cut this thing out of you yesterday. But the reality is that we're not as worried about what we can see as what we cannot see." Knock wood. We are coming up on ten years cancer free. With Trump, I'd rather have them do it right than right now.

  9. The thing is, we're not really taking the "rule of law" approach. The "rule of law" approach would've been to immediately begin an enormous criminal investigation into Trump the moment Biden took office, because there was a shitload of evidence he and those around him had committed numerous crimes related to 1/6. Garland and the DOJ didn't do so because they were worried about political appearances. That's not commitment to the rule of law, that was them disregarding the rule of law, prioritizing their own vain concerns over enforcement of the law against the biggest fucking threat to American capital-L Law since the Civil War. They really did hope that he'd just go away quietly. It took until Trump refused to give back the most highly classified shit we have before they got around to actually taking any of this shit seriously.

  23. They absolutely can, and do. All the time. Say that Trump owns a property worth $100 million, with $50 million in liens on it. The state forecloses on that property - it's a judgment foreclosure. The state then sells the property for $100 million. The lien holders are paid FIRST -- so the first $50 million goes to them. Then the next $50 million goes to the state, towards paying off the $360 million he owes. Or, if he owed less than $50 million (say, he only owed $40 million), then the first $50 million goes to the lienholders, the next $40 million goes to the state to pay off the judgment, and the excess proceeds of $10 million go to Trump. Lots of assets are subject to the claims of secured creditors/lienholders. Those assets aren't immune to seizure, bankruptcy sale, etc. There's just an order of payment provided by the law to make the lienholders whole. Having assets that are encumbered by debt isn't a novel thing. The legal system thought of this scenario long ago, and has a set script that it follows.

  26. You know that I am a high priest in the Church of Ain't Nothin' Gonna Happen. BUT...I also have personal experience advising clients who have gone up a bigger, better-funded, bullying adversary, when we are dead-solid right on the law and facts. I tell them that the other side is going to throw everything they have at us, and charge and bellow like an 800 pound silverback gorilla.....because THAT'S ALL THEY HAVE. To win, all we have to do is....still be there, standing firm, just like we are, when the dust settles and the gorilla has run out of shit to throw. Patience is our weapon, and it's a lethal motherfucker. Sometimes it has taken a year. Or two. Or even four. But in every such dynamic, the same outcome came to pass. The gorilla ran out of shit to throw, we were still standing, and then we deployed our side of the case on OUR terms and beat the fuck out of them.....and they quickly surrendered, because they had nothing left (indeed, they never had anything at all, just money and bluster). The system does allow bullies to take advantage of it and delay and cost lots of money. It fucking sucks, and is bullshit. But, the system is also still there when the bullies run out of money and shit to throw. I expect that the experienced litigants and prosecutors on the other side of Trump in these cases all know that. The legal positions of bullies like Trump fail as follows: not at all....then slowly....then all at once. I sure as shit hope that pattern stays true here.
