There can be a difference between an opinion that explains the reasoning and a judgment that states the conclusion and operative terms of the judgment. Like the DC Circuit released the opinion and a judgment on immunity simultaneously as separate documents. Sometimes it can be hard to tell if an opinion IS the judgment or not. The test is whether the document in question disposes of all the issues and all the parties. This is an incredibly common controversy. One of the problems it causes is that you usually have 30 days from the date of the judgment, not the opinion, in which to appeal. So it can cause premature appeals or belated appeals. Belated appeals are untimely and do not go forward. Engorons order left some issues open namely the precise terms of the supervision. So it is probably not a judgment. Recognizing this, James' office filed a proposed judgment for Engoron to sign finishing everything off. This is not uncommon, but usually the other party has the opportunity to object to the proposed judgment and propose their own. Maybe in NY practice that's called a counter judgment. In Texas and federal practice, that's a weird name. As scottsins points out sometimes the trial judge will give the winner the sole right to draft the judgment, at the risk of creating an an issue for appeal if they are too heavy handed. But that is in accordance with what the judge orders and Engoron didn't order anything as far as we know James office just did this unilaterally apparently. The process does present something of an opportunity to negotiate, not with Engoron, but with James office over the precise terms of things like the supervision. The whole mess may add a few days to the time for appeal, depending on when Engoron signs a conclusive judgment. But that's more his fault for leaving matters unresolved in the opinion that we have seen than anything anyone else is doing.

I can probably contract a sufficient waiver that would insulate a client against a wrongful-death lawsuit of the type that brought about this ruling. But that does nothing to insulate a client against a potential criminal prosecution. And this is Alabama--there's definitely the potential for a criminal prosecution. But here's the real fucking deal: if you're a woman who is (or might be) pregnant, you'd do well not to go anywhere near Alabama. It's kind of like a roller coaster in that way.   36. Seems like this will all be someone else's problem. Good. What bothers me about this whole thing is the parents. Kids are morons and some are vicious morons. I don't think they should get a pass, but I also get where @closetojumping is coming from. People change, learn, and grow over time - no one more than teenagers - and there is now a very public record of this kid acting like a terrible person that will follow him for a long time. Maybe forever. That seems disproportionate to the harm he actually caused. Not saying to take it easy on the little shit, more that I'm just glad I was an idiot teenager before social media became a thing. But the parents. And the coaches, teachers, and administrators. What the fuck. I said people can grow and change, but that can only happen if there are consequences for their actions. This fucking guy could have killed someone. Has anyone driven that fact home to him? Has anyone sat him down and explained how badly he almost fucked up the lives of everyone involved? Killing someone else isn't the kind of thing you get to move on from. Even if you avoid jail, you will forever be the person who bullied someone to death. I tell my kids - you are what you do. Not your intentions, or what you say, or think, or how you see yourself. And if you bully someone to death, that is who you are. Doesn't matter if you didn't mean it. But someone has to explain that fact to this kid in no uncertain terms for him to have that epiphany and change. It doesn't seem like this kid has learned any lesson. There's no indication that he apologized, learned from this, and made amends. No one really punished him. So part of me is glad he's getting dragged on twitter - it's a shame that a bunch of strangers on the internet have to create the consequences necessary for this kid to learn that what he did was bad, but at least it's fucking happening. At least maybe now he'll understand and won't do it again. Anyway, like I said. I'm glad this is now someone else's problem.

My favorite part with these screenshots is where they value ATM returning 72% of their production, and then using that to firm up their "9-3 or bust!" hubris while simultaneously casting aspersions on the notion that Texas returns 70% of its production and using the same model to do both things. They continually find new ways to astonish me with these takes. It shouldn't happen, but it does. Also, it's simply a hilarious constant that these idiots are able to whip up hypothetical wins for themselves and losses for others. They don't just do this for games that were never played, for which they're basically undefeated, all time. No, they do this with games that have already been played, whether those are ATM games or someone else. They use that maneuver to firmly convince themselves that a true outcome actually happened in the past in which someone like Texas lost more games than the records reflect, and of course everyone knows this, while ATM actually performed better than most people realize. That one rube writes as a matter of fact that they actually beat Ole Miss the last two years, which apparently also means that beating Texas this season is a given.
