  1. Just to be clear, assuming he did not harm anyone, you are saying that UT's conduct unbecoming that led to termination would be choosing the wrong person to date?
  2. Agreed on that point. He will likely only end up with both sides disclosing some embarrassing facts, unless UT is willing to pay him something to avoid that.
  3. I guess we'll see if Beard ends up suing. My bet is it is not thrown out immediately, but obviously I am in the minority.
  4. Even if they legally can, I doubt they would. A&M got Jimbo because they were willing to offer more guaranteed years. If coaches know those guarantees are not worth anything, it will be difficult to get the same level of coach. It doesn't matter as much for Tech, because Tech is generally not looking to hire that quality of coach, so the guarantee matters less.
  5. If UT is going to stay out of court, they are going to have to prove they win even assuming the facts are as Beard alleges. So assuming that he alleges that he is totally innocent and never did anything physical, then what is the conduct unbecoming? Being falsely accused of a crime and then being falsely imprisoned for that crime? Obviously that is probably not what happened, but if UT is going to avoid a trial altogether, it's difficult to do on a loose standard like "conduct unbecoming."
  6. If they are basing his termination on the "unbecoming" portion and not the charged with a felony portion, it is definitely going to court, which is my point. I think Beard has enough to at least get a trial, including discovery, which I imagine both sides would prefer to avoid.
  7. I've already expressed my opinion that he arguably did not if he did not do the "conduct" that led to the charge, but obviously most people disagree. My guess is it is enough to get into court, but it will depend on the judge.
  8. I will be surprised if Texas invokes sovereign immunity against one of their coaches, as it will hurt them when trying to hire future elite coaches.

  11. Didn't Texas call a timeout right as Washington was moving to fake a punt in the Alamo Bowl? It was hard to tell on TV because they do not show everything, but the announcer suggested as much.
  12. That may cut toward keeping Beard, because I agree, this is not going away whether we keep him or not. Fans of opposing teams will continue to bring posters of Beard's mug shot and chant things about domestic violence even if we fire him and hire Gloria Allred.
  13. Ah yes. If there is one thing we know for certain about these types of situations it is that logic always prevails. I'm sure she made herself a pros and cons list before deciding whether to call the cops.
  14. Agree to disagree on whether a court would rule that the word any would basically read out the word conduct. Arguably, “any conduct” would encompass walking on the street near where a crime was committed or sleeping with the prosecutor’s wife so that they tried to pin a crime on you, but I do not foresee a judge agreeing with that reading of UT’s contract.

To be fair, it says “any conduct resulting in a criminal charge…involving a felony.” It’s not necessarily a great argument, but depending on what he actually did or did not do, it could be argued that he did not do the conduct that resulted in the charge. In this case, if it’s only a felony because of the strangulation charge and he did not do that conduct, did he really do conduct resulting in a felony charge? To take a more extreme case, if someone was arrested and charged on mistaken identity, that person would clearly have been charged with the felony, but did they really do any conduct resulting in a felony charge? The contract is written such that the conduct is what is important, and not just the charge. I am not sure if that was intended or just lazily drafted.

  17. Maybe I do not realize how much media availability coach Gundy does. Does he have multiple availabilities during the next couple of weeks. If so, then maybe the question could be asked at one of those sessions. My understanding is that this is likely the last media availability until he likely does one after signing day in early February. If that is the case, my guess is that he would come up with some rant about how that was about these kids big day following their dreams and the reporter should not be soiling their big day by asking questions at that time.
  18. But if that is the reasoning, why even have media availability at all. We might as well just wait until Oklahoma makes a press release. I'm sure that is what coaches would prefer.

Or maybe he meant that as "Come after me, so that we know who to remove their access to the program they cover." Are you kidding me? Where are we at in society today? Come after me! I'm a man! I'm 40! I'm not-- I'm not a kid. Write something about me, or our coaches.

  22. It's a tough situation that we are not going to solve on this message board. Obviously, if people are guilty of domestic violence, you want to punish them, but if there is not enough to punish them criminally, do we want the default to be punishing them economically. Maybe we do, but the downside is that if victims know that their husbands will be fired regardless of what actually happened if they call the police, they are certainly going to be less likely to call the police to escape an escalating situation. This case is not necessarily typical, because they are not married and there are no mutual kids (so it's not clear whether she would be harmed if he is fired and has trouble getting a similar job), but if we make the default that whenever someone calls the police, all of them suffer financially, you will end up with fewer calls to the police, even if the police could help alleviate the situation.
  23. Those were three of Texas' best games, so he must be the key to our success.
