  1. Aggiehawg claims to be a retired lawyer with significant appellate experience. I wandered over there quite a bit during the post- election litigation orgy. Her takes were always laughably bad. She probably thinks Pence still has the power to ignore the electors.
  2. You are correct. One requirement for eligibility to be a Special Agent: Be able to obtain a Top Secret Sensitive Compartmented Information (SCI) Clearance. https://www.fbijobs.gov/special-agents I learned something new today.
  3. Not at all. Just curious. I'm guessing that there was someone there with security clearance. But I don't recall seeing that mentioned in the dozen or so articles I've read.
  4. A thought has occurred to me concerning the search and seizure, and I haven't seen it discussed anywhere. The assumption is that some of the records retained by Trump were classified. But FBI agents would not have security clearance to see classified documents. But FBI agents would not have security clearance to see classified documents. It would seem that someone with a much higher security clearance, such as an intelligence official, would have to be present for the search. Has there been any reporting of such officials being there?
  5. But there has to be an actual question asked. The Q and A can be shown to the jury. If the depo only lasted an hour they probably didn't cover much ground.
  6. 15 boxes of documents were returned and indexed. The implication is that there were more. There are reports that in June the agents saw records that were marked as top secret.
  7. So am I right that there are two separate strands to this? 1. Misuse of classified documents. 2. Possession, concealment, destruction, etc. of government records. The first would be far more serious, but might be clouded by his assertion that he declassified them before leaving office. The second would be an easier standard to prove, would apply regardless of the classification status of the documents, and could result in disqualification from office per the statute quoted upthread.
  8. That's where he kept the pics of Ivanka.
  9. It's possible that the 2 holdouts wanted to award more in actuals.
  10. Sounds like a response from someone who doesn't know the Rule and is either too lazy or too busy to look it up. On a different note, has there been any discussion of whether AJ is covered by insurance and, if not, why not? I would think any merits personality would have liability insurance for defamation and the like.
  11. Petition for Mandamus, denied with no opinion.
  12. Not positive, but I think that appeal has already happened and the Court of Appeals affirmed.
  13. The default judgment on the intentional infliction of emotional distress claim automatically determined that the parents had suffered severe emotional distress. I believe the jury was so instructed. By itself, that is almost a blank check for the jury to fill in.
  14. If they were produced without a privilege claim, Plaintiifs' attorney should just hand them over.
  15. All of them? Erbody.
  16. Just declare victory now and stop counting the rest of the votes.
  17. Now imagine Donald Trump as a client.
  18. So this is what I glean: 1. Media outlets report that SS deleted texts from Jan. 5 and 6. 2. SS says that is"categorically false." 3.SS then says that the deletions were part of a normal process. So what exactly was false about the report that texts were deleted?

  23. He might actually carry a few states and prevent the D or R candidate from getting an electoral majority. The chaos after that would be biblical.
  24. "Jimbo Backed Off" has some panache.
  25. At least it wasn't Dijon mustard.
