A thought has occurred to me concerning the search and seizure, and I haven't seen it discussed anywhere. The assumption is that some of the records retained by Trump were classified. But FBI agents would not have security clearance to see classified documents. But FBI agents would not have security clearance to see classified documents. It would seem that someone with a much higher security clearance, such as an intelligence official, would have to be present for the search. Has there been any reporting of such officials being there?

15 boxes of documents were returned and indexed. The implication is that there were more. There are reports that in June the agents saw records that were marked as top secret.

So am I right that there are two separate strands to this? 1. Misuse of classified documents. 2. Possession, concealment, destruction, etc. of government records. The first would be far more serious, but might be clouded by his assertion that he declassified them before leaving office. The second would be an easier standard to prove, would apply regardless of the classification status of the documents, and could result in disqualification from office per the statute quoted upthread.

Sounds like a response from someone who doesn't know the Rule and is either too lazy or too busy to look it up. On a different note, has there been any discussion of whether AJ is covered by insurance and, if not, why not? I would think any merits personality would have liability insurance for defamation and the like.

The default judgment on the intentional infliction of emotional distress claim automatically determined that the parents had suffered severe emotional distress. I believe the jury was so instructed. By itself, that is almost a blank check for the jury to fill in.
