  1. You have a serious problem with reading comprehension. All I've done is explain the law and where the driver went wrong. End of story. I've highlighted the portions above where your understanding of what I've written is absolutely fucking absurd. edit - FYI - I am pretty sure it's okay to hold two, perhaps even three, independent and related thoughts at once: The driver behaved rudely and, as it turns out, illegally, and his illegal behavior -- as opposed to his rude behavior -- led to ramifications. He's not at all a sympathetic figure in my eyes. Also, the police hold too much power in our society. And also, they are treated extremely leniently by the courts but there are many aspects to that, the most important of which are probably the Supreme Court's doing.

For the record, Mimms sets the "reasonableness" standard so that courts look through the eyes of the cop acting with reasonable fear in performance of their duty. That standard entails courts (and therefore cities, states and police departments) giving cops extreme leniency. I don't know what to tell you...go look at what happened to the case of Eric Garner. 4 cops gang tackled him and not even the cop who put him in a prohibited choke hold and killed him was prosecuted. (edit - Garner was suspected of selling, get this, untaxed single cigarettes when the 4 cops approached him.) The homicidal cop wasn't even fired until 5 years later ffs. Take a look at the case of professional tennis player James Blake who totally out of the blue was slammed to the ground by an officer. No orders, no warning. He was literally just standing there by his hotel waiting for a ride. The cop got off with -- at the most -- some form of internal discipline that the public will never know about. What happened with the Dolphins player is tip of the iceberg. Honestly it's not even that. edit - also consider the ONLY union the political party that supports treasonous behavior supports is police unions. There's a reason for that but I'm not getting into it here.

  6. The way the law works in most cases, including situations such as this, previous court decisions dictate what's legal. Those court decisions, unfortunately, give police almost carte blanche to do pretty much anything they want within reason. If you want to start your journey toward learning about it perhaps start with Pennsylvania v. Mimms.

  12. Unlike you, apparently, I'm not able to read the cop's mind. I simply watched the video and observed what actually occurred. And as it happens, whatever was in the cop's mind doesn't fucking matter under the law. That's what I'm discussing here. The cop might've wanted him to exit the vehicle so he could have a good look at what was in it, and then if he saw anything he deemed suspicious use that as probable cause to search the entire vehicle. The cop might've wanted him out of the vehicle simply because he felt safer if he were in handcuffs for the duration of the stop if he were. All of that is legal and your feelings don't matter.
  13. That's actually exactly what they're saying. You say "zero threat" but as I've already stated, that's the whole point (nobody knows what kind of threat he was or if he has a weapon, or if he's going to fight them) and why you shouldn't fuck around when police order you to roll down your window or to exit a vehicle. edit - the dude was uncooperative, failed to follow orders, and his behavior was suspicious and bizarre. He gave the cops more than enough reason to pull him out of the vehicle.

  17. And I wrote the exact same thing not more than 30 minutes ago. Michael Brown. Sandra Bland. Countless others have ended up dead because there's many bad cops in this country. While your best option is almost always to obey orders, sometimes even that's not enough.

  24. The last police encounter I had was getting pulled over for speeding on the backroads of Louisiana between NOLA and Lafayette. You can bet i rolled down my window, kept my hands on the wheel at all times, and moved slowly to provide my i.d. as requested, etc. Was I cognizant at all times that the cop may just decide to fuck with me because I was a jew boy from the big city of Austin, Texas? You betcha. I don't like that's how it is. I felt safer getting pulled over for fucking up while driving in Slovakia for chrissakes.
  25. Michael Brown found out. Sandra Bland found out. If you give the cops any pretext to fuck with you, or murder you, they may just take it. Sometimes they don't even need pretext, they'll invent one. Unfortunately for the driver in this video he gave them plenty of pretext but luckily for him he came out of it alright.
