I heard this story on the radio today. For those that don't care to read/listen, the gist of it is:
Non-citizen has been married to a citizen for several years, they have a couple kids
They apply for legal residency status based on the marriage
Government says it's a legitimate marriage and they're moving the application forward
In the meantime, ICE is trying to deport the non-citizen spouse
According to the lawsuit, 2016 DHS regulations are intended to allow illegal aliens to seek legal status based on marriage
It get stickier because the lawsuit claims the government used the marriage interview as a trap for ICE to detain the non-citizen
It's hard to see what purpose the goverment's actions are trying to serve, beyond scaring people away from marrying immigrants. This isn't a public safety concern, it's not a "public charge" concern. It just seems anti-immigrant.
