I guess I should have also added that I don't see Saddam and Putin type rigged elections being possible for the same reasons. I have almost no hope for this country, but even I feel cancelling elections or dictatorial vote rigging isn't going to happen. The country will fall into full constitutional crisis or civil war before stuff like that just happens. As many magats as there are in power, there would be too much resistance, even if from a minority, because it will be a large minority. -

I'm with you both in spirit, but I just don't see him being competent, or even motivated enough, to actually do something like this, or succeeding if he tried. He's fundamentally a lazy piece of shit and doesn't do shit when in office. There's just no way for him to actually stay in power, even if he lives through 2028. As shitastic as this Supreme Court has been, they aren't going to go along with cancelled elections. I don't even think Clarence and Alito would be willing to go that far. There will also be state actors like the guy in Georgia who just flat out refuse. And worst case scenario, if Trump tries to use the military to stay in power, the top brass isn't going to let it happen. There are also far easier ways to undermine votes that might actually prevail, like limiting or eliminating early voting, shutting down collection boxes in big cities (one per county, that's fair, right?), more and more extreme gerrymandering (SCOTUS has called it a political question, tough shit losers), etc. They might also start prosecuting all democratic candidates across the country for fake crimes, because they think it's all fair game now. These things are far more scary in my opinion because it's far more realistic. -

That’s not going to happen. I don’t really understand the PE thing but it’s not going to be a way to lose money. The terms would be safer, but I think ultimately nothing will happen there. The naming rights thing is dumb but clean infusion of cash. Talent disbursement isn’t going to change. The five star programs will still get the five stars and the rest will get the rest. But ultimately like @Okie State said fuck all this shit. secsecsec

Shit like this is where you know it's all complete bullshit tailored to peoples' personal preferences. There is nothing objectively problematic or immoral (i.e., sinful) about being in love with someone of your own gender, or genuinely believing you were born of a different gender and taking actions to conform to one's genuine self. It's just a ruse to not like people you don't like. The last part is absolute horseshit as well, you say you can "easily not let other peoples' sin affect me," but will vote over and over and over again for politicians who make sure that people you don't like are prevented from living the same life as you. Complete and utter horseshit.

He does, they're letting him down this series, in part because Boston's defense is really good and deep. His teammates won the LAC and OKC series for him when they were doubling him and PJ, Lively, etc. went off. During the OKC series the local radio guys called him a ball hog and I almost called in to call them on that bullshit. He finished second or third in assists. It's very obvious that if he's doubled, he finds an open man. If he's iso'd on someone he can take, he takes. His game is very smart and unselfish, while also recognizing and acknowledging that he's the best scorer in the game and he uses that to help the team. As far as I can see, he could use a little better conditioning and needs to improve his overall defense (there are some plays where he looks great at defending but its not consistent). Dirk improved his defense over time too, it'll happen for Luka I think. Seriously, first Finals at 25 years old, and two conference finals appearances in three years. Up against a better and deeper overall team. Dumbest take ever.

Judge Calls Car Sex 'Clearly Foreseeable' In HPV Suit By Hope Patti · Listen to article Law360 (June 12, 2024, 8:16 PM EDT) -- An Eighth Circuit judge said Wednesday that having sex in a vehicle is "clearly foreseeable," challenging Geico's contention that such activity does not constitute normal use of an automobile in a coverage suit over a woman's claim that she contracted HPV during sexual encounters in a policyholder's car. Geico General Insurance Co.'s counsel, Douglas S. Beck of Shook Hardy & Bacon LLP, contended during oral arguments that, under Kansas law, the policy issued to Martin Brauner does not cover liability for the woman's injury simply because the covered automobile was the location where transmission occurred. A Missouri federal court had accepted Geico's arguments in March 2023, when it concluded that the insurer was not obligated to cover Brauner against claims asserted by the woman, identified in court filings as M.O. Citing a Kansas state appeals court's 1981 ruling in Farm Bureau Mutual Insurance Co. v. Evans , Beck asserted that an injury does not arise out of the "use" of an auto if it is caused by some intervening cause not identifiable with the normal use of an auto. When asked by one of the judges what exactly "normal use" of an auto means, Beck responded that it means "using an auto as an auto." "Using an auto as an auto doesn't help me because it depends how you use an auto," the judge remarked. Beck asserted that using an auto as an auto means using it for vehicular purposes, which is why Kansas courts have repeatedly found that using a vehicle as a shelter, or as the situs for bodily injury, is insufficient to create liability coverage. He further contended that Garrison v. State Farm Mutual Automobile Insurance Co. provides a good example of what it means to use an auto as an auto. In that case, the Kansas Supreme Court held in 1995 that a driver who was injured when a shotgun inside the vehicle accidentally discharged was entitled to coverage because the incident arose out of the use of a vehicle. But one judge asked how the court can reconcile the language of the Garrison ruling — which states that coverage exists where the minimal causal connection between the use of the vehicle and the injury is provided by the foreseeable and reasonable use of the vehicle — with this case, when it's "clearly foreseeable" that people are going to have sex in cars. Ultimately, Beck said, there has to be a causal connection between the use of the auto and the injury to trigger coverage. Otherwise, he asserted, the auto policy would be converted into a general liability policy with no restrictions. M.O.'s counsel, David M. Mayer of Monsees & Mayer PC, argued that the Geico policy is "formatted in a manner that's confusing and not usual with most other policies," leading to more than one reasonable interpretation. One reasonable interpretation is that the policy does not require a bodily injury claim to arise out of the "use" of a vehicle for there to be coverage, according to Mayer. U.S. Circuit Judge Raymond W. Gruender asked whether a reasonable person would interpret the auto policy as covering his liability if he had a covered vehicle in his garage and someone tripped on his sidewalk and broke their leg. "Under your reading, don't you have a claim under the auto policy?" the judge asked. Another judge commented that Mayer seemed "hung up" on the formatting of the policy when the stronger argument was whether M.O.'s injury arose out of the use of an auto, saying he could hang his hat on the Garrison case. Mayer also contended that the Evans case is distinguishable because the injury occurred outside a vehicle, whereas M.O. was injured inside Brauner's car. Geico's coverage suit against Brauner and M.O. commenced in April 2021, when it denied M.O.'s demand for payment to resolve her claims that Brauner negligently infected her with HPV during sexual encounters in his 2014 Hyundai Genesis. Shortly before the insurer's denial, the woman and Brauner entered into an agreement in which her claims against him would be sent to arbitration and she would only seek recovery of any judgment from his insurers. The pair then arbitrated M.O.'s claims in May 2021, and she was awarded $5.2 million. M.O. informed Geico of the award and sued Brauner in Missouri state court, which entered a judgment confirming the award in July 2021. Geico was permitted to intervene in the suit on the same day judgment was entered but was unsuccessful in its attempts to vacate the judgment. A Missouri state appeals court affirmed the award in June 2022. The Missouri Supreme Court, however, vacated the $5.2 million judgment in January 2023 because Geico wasn't given the opportunity to intervene before judgment was entered. U.S. Circuit Judges Steven M. Colloton, Michael J. Melloy and Raymond W. Gruender sat on the appeals panel. Geico is represented by J. Max Rosen and Cary B. Lerman of Munger Tolles & Olson LLP and W. Clark Richardson and Douglas S. Beck of Shook Hardy & Bacon LLP. M.O. is represented by David M. Mayer and Phillip R. Martens of Monsees & Mayer PC. Brauner is represented by Brian J. From a purely legal analysis, the court had no choice (the sole dissent was only in part and he didn't write an opinion so it's not clear where he disagreed). There's just no viable legal theory to make the City of Tulsa pay reparations through a nuisance claim. What I always found problematic is that the City of Tulsa is funded entirely by sales taxes (somewhat unusual) and any judgment would be paid from those sales taxes, which of course is one of the most regressive taxes that exists, and I just don't see how that works out equitably. It also wouldn't capture the subsequent waves of racism in this state and city that were far more devastating economically to the Black community over time. The court's last line in this paragraph has been my position. The wrongs from that era can, and should, be resolved through legislation and a broader funding mechanism. Every (or most) sessions of Congress has had introduced a bill to establish a commission to study reparations and issue proposals for reparations. It never gets a vote, because the majority in this country still lacks the will. I get wanting courts to intercede but there just isn't a legal basis for it at this point.The Tulsa Massacre was the worst, but only one of many in a span of several years, and that event in and of itself did not kill Greenwood, it actually came back stronger, until it was destroyed by Urban Renewal and the next wave of racist policies (i.e., redlining, etc.). And for the record, the Oklahoma Supreme Court is still relatively sane considering the redness of the other two branches, so there's no gqp fuckery going on with this decision. On the same day they issued this opinion it ruled unanimously against the state superintendent's crusade to force local school boards to ban books. They also upheld mask mandates in schools during the pandemic. I think they also ruled routinely in favor of abortion rights, at least before Dobbs. The opinion recognizes the seriousness of the wrongs involved, including from City of Tulsa officials, many of whom we now know were members of the KKK. You won't find many, if any, gqp state policians even recognizing that the Massacre not only occurred but that it was fueled by racism (some still claim that the Black people deserved it for daring to question the arrest of the kid involved and trying to prevent him from being lynched at the courthouse). I think only the U.S. Congress can provide the right mechanism to study and propose reparations for the wrongs committed against Black people for so long, and I really hope we get to a point someday that it happens.

Oh yeah, that “NaTional FaNBAse” that put them 36th in tv ratings last year behind the likes of TCU and Kansas. Their ratings are good for the new conference but this idea that they’re some massive draw like Notre Dame is exhausting. Almost as aggy as Utah fans thinking they are Big 10 royalty status.

They’ll do it if the terms are right. Sankeys comment was an opening position. The conference will negotiate to avoid too much control from the PE investors, but they’ll do it in a heartbeat for the money when the terms are right. That’s all that matters anymore, that sweet sweet cash.

(AP) — Local school boards in Oklahoma will retain the right to determine what books are available in public school libraries after the state Supreme Court shut down efforts to shift that discretion to the state Board of Education. “The state Board of Education is attempting to exercise unauthorized quasi-judicial authority in enforcement proceedings before the board,” Justice James E. Edmondson wrote in the unanimous ruling Tuesday in a lawsuit brought by Edmond Public Schools. “State statutes give a local school board power and a type of statutory discretion to supply books for a school library that meet local community standards,” the ruling added. The board, led by state Superintendent Ryan Walters, had recommended the suburban school district remove two books — “The Kite Runner” by Khaled Hosseini and “The Glass Castle” by Jeannette Walls — after new rules were approved in June 2023 that banned books and other media that contain pornographic and sexualized content. The lawsuit was filed days before a hearing the board scheduled on the district’s appeal of its recommendation. The district welcomed the decision in a statement. It said the ruling “protects our locally elected school board’s role in creating policies that determine how library materials are selected and reviewed.” Walters said he was disappointed, calling in a statement for the Legislature to act “and reign out of control access to pornography in schools that our kids are exposed to.” The ruling came the same day attorneys for LGBTQ+ youth, teachers and major publishers asked a federal appeals court to affirm a lower court order that blocked key parts of an Iowa law banning books depicting sex acts from school libraries and classrooms. There has been a wave of similar legislation around the country, typically from Republican lawmakers who say the laws are designed to affirm parents’ rights and protect children. The laws often seek to prohibit discussion of gender and sexual orientation issues, ban treatments such as puberty blockers for transgender children, and restrict the use of restrooms in schools. Many of the laws have prompted court challenges. Earlier this month, the 5th U.S. Circuit Court of Appeals in New Orleans ordered the return of eight books dealing with subjects including racism and transgender issues to library shelves in a rural Texas county.
