Pope Francis: You know that hell thing? Never mind....
BurntEyes replied to Aqua Buddha's topic in Daily Texan
Ummm... could we possibly start this with the cult of Xenu Space Invaders aka Scientology hit Utah and work our way down from there? I'm in no way defending the Catholic Church as they are absolutely on my to-do list but I was just thinking we should start with the ones based in the US then expand our reach internationally. Get some domestic kills under our belt first, if you will. -

So much to unpack on this one but nobody got time for that... I'll go top 3. 1) It truly looks like this guy is sitting alone in his "hobble chair" in an empty parking lot. Hearts and minds. Change! (spare change, got some) 2) the dirt road ministry, I don't care what stupid "symbolic" bullshit they're using/trying to use. dirt road ministry 3) flying both the rebel flag and US flag. Pick a fucking side. -

1) Zero evidence thus far has been presented that this was a case of self defense. NONE Doesn't mean some won't surface but no evidence has been provided to this point. 2) The accused was in the team tent of the victim. Why don't know why, but it's reasonably logical to conclude the accused was the aggressor not the other way around. This is supposition, based on known facts. 3) The accused brought a knife to a track meet. This is known fact. The accused took the knife he brought to a track meet and then went to the tent of the victim. It's supposition but reasonable to conclude that particularly when combined with #2 above. 4) Below is a cut and paste from a lawyer in Texas. It's a clarification around self defense and escalation. Texas Self Defense Law - Criminal Lawyer Interpretation So, based only on the facts we currently know for sure. The accused brought a knife to a track meet and when to the team tent of the victim. Then, the accused stabbed the victim with a knife. The victim died. It's logical to conclude, but it is supposition that the accused was the aggressor based on know facts. It's logical to conclude that the victim told the accused to leave. It's logical to conclude that the victim may have attempted to physically remove the accused from the tent. That act under Texas stand your ground law/castle doctrine may be covered. What you can't legally do, if someone tries to remove you from a place where they belong and you don't/aren't wanted is escalate to stabbing them. The self defense doesn't play here, as the accused went to the victims "castle". Whether or not the accused intended violence prior, if he didn't leave when asked it is aggression, and the accused chose an escalation path. Even if the victim tried to push him out physically, that doesn't qualify as reason to escalate as the accused could have just left Being in the tent in the first place could easily be perceived as aggression by the victim and most jurys/judges would agree particularly if the victim asked him to leave and he didn't. That's without including the fact the accused brought a knife. Based on current known facts, there is nothing that supports a self defense claim as bring a knife to a track meet and going to the victims tent is easily perceived as clear indication of aggression. Hell, the accused didn't even need to have the knife for his actions to have appeared aggressive. Evidence may well surface that alters thing, but currently, based only on know facts, self defense doesn't apply. -

For the record, I was informed that suggestions of Thunderdome or similar ideas is a clear indication of being a racist Trump supporter a few pages back. Thought you should know. -
In fairness, you have always been complimentary about my girth.

Who's gonna fund my vacation man? This plan is going into the shitter fast.

Fuck that noise! Not enough time to fleece the Surly flock prior to disappointment and sadness. Plus, I get no cut of that action. No sir, remote Central American island destination or bust!

(Fixed)You're lying. Not once during our friendship have you ever said that to me. Asshole.

So, when the fuck is the Surly Fyre Festival happening? Where is it? I need to start working on connections for the drugs and sex workers. This shit takes some planning.

I can agree to what you've put forth, just important to me that the victim and his family aren't forgotten in all of this. To that end and to practice what I preach here is a snap shot from Austin Metcalf's X profile and his hudl link. (I blurred the phone and email because I think I should) Austin Metcalf Hudl -

I fully understand and don't disagree which is why I put hold the party responsible accountable first. Yes, on the broad stroke the criminal justice systems service is in the name of the state on behalf of the people not the individual, but as with all items the devil is in the details. I like to believe you and Twice both believe that our criminal justice system is in place to bring forth justice, dont you? Let's take a look at the legal definition of justice as described by the Cornell Law School that I hope we can agree is a fair arbiter of the word, legally. https://www.law.cornell.edu/wex/justice Justice has three meanings: (For purposes of discussion and because the second two were covered by both you and Twice I'll focus on the first) Justice is the ethical , philosophical idea that people are to be treated impartially, fairly, properly, and reasonably by the law and by arbiters of the law, that laws are to ensure that no harm befalls another, and that, where harm is alleged, a remedial action is taken - both the accuser and the accused receive a morally right consequence merited by their actions So, I would argue that while the criminal justice system absolutely does serve the people in a broad aspect, in the name of justice it also strives to serve the victims (and those accused) of the crime to receive a morally right consequence, to use the Cornell Law definition. Likely this falls into a semantics discussion but I ask, what is a criminal justice system without morally right consequence and justice for the victims? Who are will killing in the name of? -

What, exactly, would you say is the purpose of the US criminal justice systems if not to serve the interest of the deceased and their family in a homicide? In my world view the entire purpose of a homicide investigation is to hold the party accountable for the crime and help bring what little closure is possible for the family in the name/memory of the victim. I would further argue that many homicide detectives take this obligation to the victims and their family seriously and personally. Its on record and well documented that many such investigators have continued said obligations long after the case has grown cold and post the end of those careers. Not just to punish the murderer but in the memory of the victim and the victims family. -

The definition of the term and every word of "Intent to cause serious bodily harm" has been an ongoing beating consistently and repeatedly. Knife fighting skills have been discussed in depth. -

The entire US/state police and penal system was designed to do something about it. Saying there is nothing to be done about it? I bet the Metcalf and Anthony family would disagree that nothing is being done about it. That said, how many times have you seen Austin Metcalf's name in the thread? What if any details have been discussed about who he was, what he liked, his passion, his life, his dreams. Your take that he's dead who cares is exactly what is/was wrong with the vast majority of criminal investigation documentaries and news coverage. Name 2 victims of Ted Bundy, name 1 from Jeffery Dahmer, 1 from John Wayne Gacy, hell name a victim of Epstein. I'm betting you can't because historically the focus has been on the life of the predator. Fortunately, there is a strong trend surfacing to talk in more depth about the victims of these events rather than just the perpetrators. Their lives and what the perpetrators took from the world rather than JUST the criminals themselves. Forgetting the victims of crime and dismissing them with statements like "the victim is gone and there is nothing anyone can do about it" is diminishing the suffering of the families, not honoring the life of the victim and dismissive of the criminal justice systems part in the story. Why are there memorials for 911, OKC bombing, and a multitude of other deaths? Saying they are dead and there is nothing anyone can do about it disturbs me greatly. -

I'm certainly not going to claim that Texas doesn't have fans that fall into the demographic you're claiming. I know it does. That said there are a goodly number of posters on this board that rarely, if ever post on sports or other topics at all. They mostly stick to CR and Daily Texan. Given the nature of those subs its going to draw the racist trolls that really give zero shits about the University of Texas or Texas Athletics. Is that 100% of them, absolutely not, but I think its the majority most likely. -

I can't comment on the broader aspects of what draws them here in the first place, but I have a high level of confidence the majority are socks of other posters that have been banned or socks of trolley posters who've yet to be escorted off premises. -

Agreed. However, had a white girl been stabbed by a white boy or a black teen been stabbed by a white teen the response and outrage would have been just as loud if not louder. -

The one thing this case has absolutely confirmed, above all else, is the number number of vultures ready to pounce on the cultural "race wars" in this country and the adage a fool and their money are soon to part. One teenage kid stabs another at a track event killing him. Were race variances not involved it's likely a minor story. But before the funeral the internet has taken up arms and sides. The parents of the alleged assailant starts a gofundme. Because "race wars" idiots are fleeced by the parents to the tune of half a million dollars. So as not to have the foolish funders look dumber than themselves the parents align to criminal that is running his own grift. Mean while the internet has the racist white idiots jumping on the opportunity to promote their bullshit cause and I'm guessing also fleacing idiots of their money. At the same time, the father of the victim is swatted for showing up to the social media circus put on by the parents of the accused, no doubt prompted to do so by their own flimflam man whose likely charging them ridiculous sums to come up with this strategy. While all this is occurring right here are Surly someone is actually questioning whether or not stabbing someone with a knife qualifies as "intent to do serious bodily harm". It would be comical if it weren't so common, predictable and based in such a sad event... and all the while.. A young man is dead and he is the lowest priority of discussion in this entire mess. -
Your grifting imagination is really limited dude.

I've finally found my reason to claim NIL is destroying my love of college football. "Because of NIL" these tapes aren't released to the public any longer. As such, I have been denied an epic meme worthy video from the aggie offense prowess. This aggression not stand. Also, thanks again for the cliff notes saving me from reading all that drivel. -

I'm not saying you're wrong, but I came to a different conclusion. I should start a YouTube podcast to discuss current legal events in crime and source my guess 100% from Surly. It would be entertaining as hell, and I could profit.
