  7. 100% disagree. If you're defense is, "that was not planned, we had no intention of doing that, and it was spontaneous" but circumstantial evidence exists that you contemplated that exact result, that evidence should come in. If the police arrest some burglars and in one of their phones was a typed, but unsent, text that read "lets go burglarize this place" then that is relevant to their intent at the time they entered the structure. At the end of the day, criminal intent is just a "thought" but it is still an element that must be proven in many cases. Rarely do you have someone saying "my intent is X." Rather, you have circumstantial evidence tending to show what their intent was. A defendant typing up a message that refutes their defense of "unplanned accident" is relevant to the question of intent.
  8. Bc you have to prove BRD that the defended was trying to kill the victim. From all accounts it looks like the cop thought the gun was not loaded. Just because someone could have died as a result of your intentional conduct does not mean that the elements of attempted murder have been met.
  9. Huh? I've personally represented people on cases where Florida sought extradition. There's the Uniform Criminal Extradition Act that all (I think) states are parties to. Its an agreement that basically says "we will return yours, if you return ours." If a person is arrested for a crime in CA, the agency that processes that arrest will run their info and see if there are any warrants or "holds" from other jurisdictions. If there is a warrant from a different jurisdiction, then CA would call them to see what they want to do about it. The answer can be "cite them out," "set bail and order them to return to our state" or "hold them. we'll come get them." If its the third option, then various timelines kick in regarding how long one can be held, and the defendant can request Identification hearings, etc.

  11. The former president of the US and many of his accomplices were just indicted on a multiple felonies and half the posts over the last hour on a thread about those indictments are arguing whether Hillary would've been "fantastic" or merely "fine." Fuck you all

  13. No, I get it. And I thought Downey was brilliant. Liked the twist at the end with Malik's character. But considering the subject matter was the building of a doomsday device and the moral/ethical concerns in doing so, I personally found it difficult to get invested in the ultimate outcome of that struggle.
  14. Thought it was fantastic. Only complaint was the final quarter of the movie - revoking his clearance over a personal grudge - seemed wholly unimportant considering the subject matter of the film. Visually it was stunning
