I get your perspective. It makes sense logically, and you are right that you could still get a conviction at trial even without Rock, but it really isnt as easy as it sounds. All defense needs is a sliver of reasonable doubt. How do your prove it wasn't staged? All that is needed to stage the act was the cooperation of Rock and Smith. Rock won't show and you cant compel Smith to testify. Even if you subpoena every member of the Smith and Rock family (which the defense attorney could arguably get excluded under relevance), how can they say with certainty that there was no plan between the two men?

"So how can't say whether Rock and Mr. Smith ever discussed staging this act at the Oscars?"
"Well, he never said anything about it..."
"But you can't say with certainty that Mr. Rock and Mr. Smith ever spoke about the Oscars leading up to it?"
"No, but . . . "
I also don't think its selective enforcement and, given the blanket dismissals that DAs ask for when the victim no-shows, its arguable that a prosecution in this case would be selective enforcement against Smith.

First, this would have been a misdemeanor battery. Second, DAs are far less likely to pursue charges (especially misdemeanors) if the victim is uncooperative. What if Will Smith took the stand and said "it was staged. we planned the whole thing. Rock was in on it." How does the DA counter that evidence without Rock? I've only personally seen one misdemeanor case where the LA DA's office went forward all the way to trial with an uncooperative witness. A DV case where there were multiple past reports of DV and the DAs felt like they had to go after the guy because they believed she was non-cooperative due to her fear of the defendant.

I'm team ledge, but I also am going out on a limb and agreeing with @TwiceHorn. I think charges get filed against Donald. I've read the motions re: Eastman. I've read the back and forth emails from Eastman and Pence's counsel on the eve of 1/6. I think it happens. Not willing to predict a conviction, bc we can't have nice things, but I do think charges are forthcoming.

Went to the 50th anniversary showing at the Cinerama Dome in LA - the theater were the movie debuted in 1963. Really badass to see the movie in front of a live audience.
They rolled out an obviously confused Mickey Rooney. The actress who played Sylvester's girlfriend was the only other cast member to make it. Oh, they also had the mannequins that were used in the final scene's stunts. Still dressed in their costumes.

Still waiting for someone to explain how we unilaterally force a peace deal upon Ukraine which contains provisions they have repeatedly said are non-starters. When the deal is signed by the US and Russia (bc Ukraine will obviously not sign it) how do we enforce it when Ukrainian soldiers and separatists continue to bomb, shoot at, and kill Russian soldiers? We going to send some troops into Ukraine to "remind" them to abide by the agreement they didn't sign?
