  1. In the "how low can politics possibly go" category, it appears that Dan Patrick and Lina Hidalgo (Harris County Judge) are competing for stage position at a slain officer's funeral. I have no doubt that both of them are using the appearance for political purposes. Whether either of them is sincere is in their hearts alone and we'll never know. Patrick and the right wingnuts (like Michael Berry) are piling on Hidalgo and making it seem like she disrupted the funeral. I don't know what standard protocol is for who gets to stand where. Patrick got to stand at the front; not sure why that wasn't okay for her too.   2. Is that a lot? I used to charge $3,500 and I was always upside down relative to what my hourly rate would have been. A lot of times "simple" probate would turn into more though.
  3. Yeah, you can't use a small estate affidavit if there is a will. I would have recommended that you "lose" the will, but it sounded like you had already disclosed its existence to the insurance company so that wasn't an option.

I actually don't do much probate work anymore, but even if I did there are so many people who don't know what to do an don't listen to advice out there that this will never not be a problem for a and there will be no shortage of work. I used to do probates of simple estates (independent administration, no debt, no fights) for a flat fee of $3500. I was always upside down compared to what the hourly rate would have been, but I'm hard-headed about trying to give clients value. I've pretty much come to the conclusion that if a client doesn't get value for what I do then it's their own fault or they were fucked from the beginning. Anyway, your advice is good as far as reducing the workload (and cost and time) in probate. Having as many of your assets converted to "non-probate" assets, which is what you described, is a simple and effective thing you can do.
  5. If you open a probate or administration you are required to post a notice for creditors. Creditors stay on top of those probate notices, so they would likely be aware and may file a claim on the estate. Limitations may have run on their ability to collect it. I am assuming credit cards. I don't deal much with credit card debt, so I don't know if cardholder agreements have some kind of tolling agreement that would extend the limitations period for suing on the debt. Couple of other possibilities for dealing with it. One is that there is a special kind of notice you can give after the estate administration or probate is opened that will shorten the limitations period to four months. If the unsecured creditor does not file their claim within that period then the claim is barred. I have knocked out a bunch of unsecured debt doing that in the past. If any remains they will usually negotiate it down, in my experience. So, send your notice and if that doesn't knock it out then negotiate with them. If that doesn't work make them go all the way to get their money.
  6. I tell people all the time, "There's the technical legal answer and then there's the practical answer." The technical legal answer is that you would have to open a probate in order to negotiate the check. The practical answer is that you can do whatever the bank will allow you to do. I would go to your bank and tell them the issue and ask them if they will allow you to deposit the check. They probably won't unless you have a relationship with the bank and they want your business. In other words, they need a compelling reason to take the risk, unless you happen to work with someone who DGAF or sees it for what it is. The risk is pretty small - it's a small amount of money and who is going to bitch? If you don't get the answer you want the first time I would try a couple more times, either with different people within the same bank or a different bank. If that doesn't work, you might be able to file the will as a muniment of title only, which doesn't involve a full-on probate, but would provide some cover for the bank. That process is in between probate and an affidavit of heirship. It should be a lot cheaper than probate and a lot faster. I would check with the bank in advance, though, to make sure they will deposit the check if you do it that way.

  14. Names have always been kind of a sensitive subject for me. Names are important and should be treated as such. Instead of projecting some positive trait, so many people pick names that only signal how dumb they are. Drives me nuts. Anyway, when we started talking about having kids I made my wife aware that this was a danger zone for us. So we agreed to a system. We did not find out the sex of the baby before the birth, so we had to have girl and boy names. The system was that at the appointed time, each of us would send the other a list of ten girl names and ten boy names. The highest name in common from both sets of lists would be the winner. It actually worked perfectly for our first. We started deviating from the rules after that. Fortunately, naming our kids didn't lead to violence or divorce like it could have.

The main purpose of the playoff is to make money, though they do it with one hand tied behind their backs because university presidents still wield a considerable amount of power, in partnership with their conferences, and they are, at least ostensibly, trying to feed the main mission of the universities - education - and look out for the interests of the student athletes. That said, every method of crowning a champion is going to reward certain aspects over others. 64 team tournament (NCAAM), 7 game series (MLB), playoff brackets (NFL&NBA) all require slightly different characteristics to win it all. The goal of any playoff should be to reward the best team, but it turns out that's a more complicated question than it appears. No playoff system is perfect, it can't be, but what we have now in NCAAFB is better than anything we've ever had. It's still ridiculously inadequate. I'm ready for an 8 or 16 team playoff yesterday.
  19. I'm not calling him a failed comedian because I disagree with his politics. One's got nothing to do with the other. I called him a failed comedian because I thought it was true. I didn't know he started as a comedian. I knew him as the Fear Factor and UFC guy, but I'm not a big follower of either of those. I learned that he was getting a lot of attention for his podcast/YouTube shows and that's why I took a look, to see what all the fuss was about. I thought he was a failed comedian because: A) he wasn't still doing comedy (as far as I knew), so if he was so great at that why?, 2) he did other things that had nothing to do with comedy (Fear Factor, UFC, podcast), 3) I watched some of his standup routines on YouTube and I did not find him funny or good. I also have admitted that I have not done a lot of research on the man or his past comedy career. Maybe he won a bunch of fucking awards for his comedy and is well-respected among comics and people who would know. I don't really think Joe Rogan is worth that much thought. He's accomplished some things; he's a celebrity. He tries to portray this deep thinker persona on his YouTube show. I guess a lot of people buy it.
  20. Oh, yeah, that. The fact that so many people get their information from him and his show is what makes him relevant. Totally backassward. I do that - I tend to discount and ignore the stupid and ridiculous. Hope it doesn't come back to bite me.
  21. I kind of don't know what Rogan is. Probably because I don't care to research his background. I know he's a failed stand-up comedian; that's where he got his start as a famous person. He did the Fear Factor show. Then he served as emcee or host or whatever for the UFC. He has a podcast/YouTube show and he gets into all kinds of political and intellectual topics. Is that it? Is there more to him that I don't know about? I've watched a fair number of his interviews with other celebrities and I've thought some of those were pretty good. I have not found it difficult to skip the political or overly dense topics because...Joe Rogan has no business discussing those topics. He's unqualified and fairly ignorant. He's got no education, background or experience in those areas. Why would I care one whit what he has to say? He's just a guy with an opinion.
