  4. Just a point of order. Originalists, or textualists, or strict constructionists, any of the constitutional interpretation methods "in opposition" to a "living Constitution," do not hold the original document as perfect. Rather, they hold that if it is to encompass and address matters not confronted by society at the time of ratification, it should be amended, in order to more democratically address such issues, or address them fully in the modern context in which they occur. By the same token, amending the constitution and treating it as a "living document" are somewhat at odds. If it's a perfect artifact, capable of addressing all societal issues via intention and penumbrae, why amend it? Of course, none of these modes of interpretation can, by itself, solve all constitutional problems, so I guess it's fine to make a hash of them. It's never not been Calvinball. It's just that the practitioners now are more willing to transparently and dramatically change the rules more often.

Although the law degree in the US has mostly always been a graduate degree, at first and for many years it was the LL.B. The J.D. is a relatively modern development. Hang in there all of you.   9. There's an interpretation that that language means the constitutional eligibility requirements of Article II, but not that of the 22nd Amendment. We're talking about Trump here. Republicans can't find enough ways to debase themselves before him.

  16. The other thing was she made some pretty scurrilous allegations against UT coaching and medical staff on the way out. Wasn't sure what to think at the time, but I think she was probably full of shit now.
  17. Yeah, that was a monstrous grudge match. My client spent $3M, the other side spent more than 10 with V/E. It was funny because the case started in the Employment section, then IP had to get involved, and then Employment realized they'd lost a ton of billables to IP, so they started mucking around again. Huge big law circlejerk.

  19. I had a client do this, wound up taking nearly a whole office of a company with them, because the old employer was that bad and the people identified with them were that good. They had an overbroad covenant not to compete, no anti-solicitation clause, but they were in litigation for the next three years solid. As tends to be the usual case, though, it turned into an IP case.
  20. To be fair. it does not appear that Whiskey Pete directly ordered the removal of specific books. Possibly worse, though, is the whole chilling effect of this type of order. One thing I find particularly galling is that integration of the military has been a leading force in integration of society and the willingness of abused minorities to serve the country that has abused them is a marvel of the best of America. Edit to add: Article also says USNA had eliminated affirmative action in admissions, which I initially thought was a blinding glimpse of the obvious in view of the fact that it is a federal institution. However, I believe that the state of the law is that the courts defer to military judgments of the necessity of affirmative action and similar things, so the academies were free to continue affirmative action before this order.
