  13. Whether Biden's policy is wise, particularly keeping Trump's, which were broader-based (as opposed to targeted to certain things like EVs), is another question altogether. Also, I have seen some scholarly things that indicate the main effect of tariffs is not to even the trade balance overall, but to shift it to other foreign low-cost providers, like Vietnam, etc.

Even if it hurts us. Whatever you think of tariffs, Trump clearly does not understand them and attempting to finance programs using tariffs is pure idiocy.
  15. Well, further, it depends on the cause of action. What you most commonly see in federal courts is a "1983 violation," which is a violation of civil/constitutional rights. If a state permits it, state law torts can be alleged in addition and might have a different flavor of qualified immunity than what the constitutional torts under 1983 permit. Texas' version of official immunity for state torts is basically 100% immunity, it's not even qualified. Colorado apparently is waiving immunity for state torts, but has a damage cap. So that's why you pretty much only see 1983 claims in Texas.
