  4. I think I got both parts right, but neither of us going to know for sure. I do agree that he handled it well and probably reconciled it quickly. The greater point I was trying to make is that we're (myself included) so quick to turn our attention to the daughter and how horrible it must have been for her, perhaps at the expense of the primary victim, a dude who was singled out and assaulted in front of everrrrrrryyybody. The explanation may be as simple as the fact that she's on screen the whole time, but still.

  15. If you ask them they won't be able to articulate this, but It relates to the fact that falsifying business records, by itself, is a misdemeanor. For this case to be considered a Felony, there needed to be an underlying crime. In the Judge's instructions, he specified to the Jury that they didn't need to be in unanimous agreement about what the exact underlying crime was, but only whether it fit into one of the 3 choices available. Of course the sheepherders jumped all over this and twisted it for the galactically stupid, but that's where it comes from.

  17. I'm seeing due process arguments all over twitter, but it's twitter. This doesn't answer my question as to whether it's proper, but this diagram is helpful to understand the instruction.
  18. Law dawgs, If the threshold for a Felony is that it was done to cover up a crime, do you really need to agree on what exactly that crime was, or could you have 4 jurors who say "it was this", 4 who say "it was that" and 4 who say "it was the other"?
  19. Nice. I've never scored a shoulder like before. I'm not sure if it would make for better rendering, but it sure is pretty. At first glance I thought you were reducing the bark by doing that, but it might actually increase it a little. I'll give it a try next time.
