  2. The 3 dissenting justices need to be campaigning on this. Maybe not going on the trail or making endorsements. But they can definitely speak out on the dangers of an unlimited government. They can definitely discuss their dissent in this case. If Sotomayor genuinely does see this as an attack on democracy, and democracy is worth fighting for, then increasing their visibility is a way for them to get in the fight. One thing I'm fucking furious about right now is why in the fuck did the dissenters here change their dissent to a concurrence on the Colorado ballot case if this is what we were going to get in this one?

We just have to win in November, then expand the court by...a lot, and probably have Biden (or Harris) drone strike every conservative justice and then resign and get charged with a bunch of crimes in connection therewith because obviously SCOTUS will need new cases in which to overrule this bullshit. Things are fine, is what I'm trying to get across here.

  6. It should go without saying, but their "he can illegally order/conspire with DOJ officials..." obviously extends to "he can illegally order the Navy Seals to murder his political opponents." If they can't look at corrupt motive, they're both clearly core executive functions and thus absolutely immune.
  7. Haven't y'all noticed that Trump wasn't really gloating about the debate? Have y'all seen what undecided voters have said about it? Minorities have mostly been angry about whatever Trump meant by "black jobs" and most other undecideds already thought Biden was too old, so him being old didn't really change anything. This freakout is almost entirely among the center-left who finally realized we're in for a real fight, which was always the case and a better debate from Biden wouldn't have changed that.

There's essentially no abuse of power (you know, those things we should be most worried about) that wouldn't be an "official act" as this SCOTUS has decided to (sort of) define it.

If Biden does decide to step aside for Harris great, I'll support her fully and I'll call my racist Nam vet stepdad every day for the next few months to convince him he needs to vote for her anyway. I know it's shocking to many of us, but before today there were still tons of Americans who didn't get what's at stake in this election (hell, we had one here in CR the other day saying this will be the least consequential election ever). SCOTUS has clarified it for everybody. So I don't care if you need to fake optimism until you feel real optimism, or if you can get by with Brits-during-the-blitz style grim determination, but stop with the fucking whining. Start arguing with your friends who are thinking about not voting, or are thinking about voting for RFK, or are thinking about voting for Trump even though they don't think they're fascist. And if they are consciously fascist, why the fuck are you friends with them and don't you know how easy it is to get rid of a body? That's a joke if SCOTUS asks. We still have a chance to stop them from retaking power. And this might actually be their last gasp. Trump is in worse health than Biden and they've put everything they possibly can behind him. That's not the behavior of people who think they'll ever have another shot. They're even more desperate than we feel right now, because they know they can never convince actual majorities to support them. Think how fucking awesome it will feel to beat Trump and know that John Roberts has to confront the fact that he'll go down in history as literally the worst chief justice of all time and that he did it for fucking nothing.

  18. Man, you have no clue what you're talking about. You're just bitching about homeless people and ignoring what the case was actually about. It wasn't "should homeless people pull themselves up by their bootstraps? Y/N?" It wasn't "can a city use its police power to do anything at all about homeless people?" It was "can a city put a homeless person in jail for camping on public property when they have nowhere else to go?" That was the question at issue.
  19. You don't get it. None of us are saying that it's actually fine that the Democratic nominee looks like the cryptkeeper and clearly has dementia. We're not giving Biden the worshipful Notorious RBG "he should get to choose when to step aside" treatment. I personally don't give a fuck about Joe Biden. What we are doing is explaining why all of y'all's magical alternatives are actually even worse options if your goal is to beat Trump. The only plausible alternative to Biden is Kamala Harris. If he decides to step aside and she's our nominee, I'd be fine with that, but there's no reason to think it materially changes our chances of beating Trump. And most of the people demanding an alternative now don't want it to be her. That's precisely why so many of you are dreaming impossible brokered convention scenarios. Whitmer, Newsome, and Pritzker don't want the huge fucking shitshow they would have on their hands from cutting in front of Harris without even running in any primaries. And Michelle Obama doesn't want the fucking job, and even if she did she suffers from most of the same electoral weaknesses (black woman) that are the reason y'all don't want Harris to be the nominee. At least she's not as publicly weird as Harris usually is, but there's actually no evidence that she'd be more likely to beat Trump than Biden is.

Not only did they take too long, they didn't even really give any serious guidance on how to distinguish official from unofficial acts or say anything that might limit their ability to immunize him later if the lower courts find a way to say his acts were unofficial. They basically said "take a ton of time to figure it out, but when you do we're still probably going to take a huge shit on you and overrule you anyway."
