  3. He doesn't think presidents can obstruct justice. And he recommended and engineered the Iran Contra pardons under Bush 1. Bush only wanted to pardon a few, but Barr made him go all in and pardon everyone involved.

  10. That's not entirely true. According to the Constitution, Senators can forbid impeached and convicted from holding public office again. Of course it is for them to decide.

  12. Yes and without the penalty it’s just a requirement to buy health insurance. It was done intentionally to undermine Roberts argument for allowing mandate.

  14. From that Politico article up above: Judge Greg Katsas, the court's only Trump appointee and who had worked on the Russia probe while serving in the Trump White House, had recused himself. During his confirmation hearing, Katsas said he would take a broad view of his recusal obligations stemming from that experience.
  15. Dreeben has argued over 100 cases before SCOTUS. Justice Roberts says that makes him the second person this century to achieve that milestone. He's a heavy hitter. I think there's also something related to journalist and constitution entangled in the arguments.

  17. Michael Dreeben once being a Deputy Solicitor General seems more important. I would think this likely implies that there are constitutional issues at play in the subpoena.
