  1. Legally, the jury finds whether you’re guilty or not, then they decide whether your actions were reasonable. Self defense hasn’t changed all that much over the years. Again, raising the issue only gets you an issue.
  2. Sure but it explains what you’re leaving out of your explanation. Yes, merely raising a scintilla of evidence gets you self defense on the jury charge. You still have the burden of producing sufficient evidence for the jury to buy it. If you’re practicing any other way, stop.
  3. No, you’re wrong, from the same opinion. “Defensive evidence which is merely consistent with the physical evidence at the scene of the alleged offense will not render the State's evidence insufficient since the credibility determination of such evidence is solely within the jury's province and the jury is free to accept or reject the defensive evidence. A jury verdict of guilty is an implicit finding rejecting the defendant's self-defense theory. Jenkins, 740 S.W.2d at 438.” You seem to be confused about the use of the word “raised”.
  4. It’s certainly in black and white. I’ve never heard anyone describe it in those terms. Using the word “raised” is hardly what I’d consider the burden of proof for self defense.
  5. Self defense doesn’t have to be merely “raised”, that’s the standard for the jury to consider it in the charge. The defendant has to prove their actions were reasonable then the burden shifts to the prosecution. That’s why they’re called “affirmative defenses”.
  6. Hope the Rittenhouse kid never leaves prison. Better, I hope he doesn’t ever leave his cell.
  7. Where are these young progressives going to go? Maybe they’ll grow up a little and understand only getting what you want is for babies. Watching progressives throw a temper tantrum for not getting everything they want and losing more elections is not new.
  8. Do you know anything about Joe Biden because what you just said really indicates you don’t.
  9. As a long time democrat, I can tell you, I’m for less regulation of small businesses. Most regulation only benefits big businesses. That said, call centers deserve regulation.
  10. You’re a telemarketer? Ok, stop calling me. No wonder we all started getting more calls that no one wants. We solved this problem now you want to got back to undesirably phone calls. Get into a new business.
  11. I get it, I’d feel stupid too. Grow the fuck up.
  12. I get that, and I was saying that when you guys were tearing him down in a way that was much like our adversaries. You’re right but you and people like you owe a damn apology.
  13. I’ve been a Biden guy from the get go. Couldn’t be prouder tonight. That man is Presidential.
  14. I think you’re right. Gotta be smart about your battles.
  15. I forget, you’d prefer losing and watching Repubs further their agenda while watching from your high horse.
  16. So move him further left than the platform that got him elected? Sounds like a one term presidency.
  17. Couldn’t agree more. I’ve watched this happen so many damn times. People need to grow up.
  18. That’s absolute garbage. Again, not only did she establish a solid legal reputation, she raised a child. I don’t know for sure but I’m willing to bet she passed up a bunch of opportunities to go to Little Rock. This, “she’s decent” is just dumb.
  19. Sorry, quoted the wrong post. She was incredibly successful and raised a kid basically on her own. She’s a role model for all women.
