  3. I am a lawyer. But I was talking about attempts to use the bag game to still get recruits to sign; that's obviously still an illegal contract that has no force or effect. So if the speculation that Sims decided to take a bag and sign, instead of considering future NIL $$$, I struggle to see how the bag game keeps anyone at a school given current free agency around the CFB landscape. Re: draconian NIL provisions--are y'all putting arbitration provisions in the NIL contracts? That's almost certainly enforceable and not, generally, draconian. But I'd think that would help keep a lid on public issues to a certain extent.
  4. The issue is what happens after year 1. (Or, hell, the end of the spring window.) We've already seen the exodus from College Station for their bag game recruits. Why would any recruit stay? Take the bag. Sign. Then transfer to somewhere that actually has NIL.

  6. I guess that's the point, though. Bush may have some NIL claims from 2016-present, as USC/NCAA/etc. have continued to use his likeness. And maybe those claims are not time-barred because of statute of limitations was tolled pursuant to American Pipe. But how would any of Bush's pre-2016 claims not be time-barred?

I imagine that the argument is NIL was always "legal" and the NCAA/Pac12/USC improperly conspired to prevent Bush (and other collegiate athletes) from profiting on their names, images, and likenesses. Now, how Bush's suit against the NCAA isn't covered by House, I'm not sure. Maybe he was able to opt out of the pending settlement? Or maybe he's suing individually before the settlement is finalized, and his statute of limitations has somehow been tolled all this time under the American Pipe doctrine? Edited to add: Also possible that Bush's suit will be consolidated into House.

  12. There's a pretty big difference between doing a short radio show and sitting down with the laser pointer and diagramming your playcalls/scheme on TV.
  13. I remember there being conversations about this even as far back as Mack's tenure. First, the time demands of having to record LHN content every week. But even moreso, breaking down your own game film. At the very least, it gives your opponent an insight into what/how you're seeing your own team that they wouldn't otherwise get. I'm glad we don't do that anymore, as enjoyable as it was to watch after the few marquee wins we've had over the past 15 years.
