  18. Massage parlors/spas are frequently trafficking cases. And they do nab the traffickers, not just the customers. Nabbing the traffickers is when they seize the records/videos and start identifying the customers. Frankly, with all the ways to find a self-employed prostitute in 2019, if you’re going to a rub and tug, I assume you get off on the sex slavery aspect of it.

But it’s a bat signal to FedSoc, et. al. to devote some resources to scholarship on why the actual malice standard is inconsistent with the text or original understanding of the First Amendment so there are some law review articles to cite to in the future if this becomes a pet issue of conservative legal groups in the future.
  23. I'm certainly open to tweaking the actual malice standard if it's been interpreted to the point that it's protecting bad faith.
