  1. It's about 35 points redder than the other two but it still went to Obama 49.1 - 48.4 over Romney and Clinton 51.5 - 41.8 over Trump.
  2. The guy pushing this isn't a major Democratic operative. He donated to both Obama and Romney but otherwise he has donated to the RNC, California Republican Party, and Feinstein's Republican opponents.
  3. The goal of the plan was to make each state roughly 13 million people so you’d have to find another 3-4m people to move from California to Southern California if you flipped San Diego.
  4. Yeah, the largest state at founding, Virginia, was only 10-12x larger than the smallest state, Delaware (10x larger in terms of white males, 12x larger by total population). California is now 67x larger than the smallest state, Wyoming, and is 10x larger than 20 states.
  5. The resolution doesn’t trump the Constitution. The resolution itself is the consent of Congress required by the Constitution.
  6. I do think there’s some wisdom to the idea that states shouldn’t exceed a certain population before being broken up. But the politics of the Senate and Electoral College make subdivision politically impossible, at least for the timebeing.
  7. Yeah, at least textually, I think the "nor" implies that it relates back to the prior clause as well. Texas already has consent to create four new states within its broders from the Joint Resolution admitting Texas in 1845, so it could subdivide at will unless and until that consent is withdrawn.

It would be interesting to have a Court rule on the meaning of Article IV, Section 3 and whether, "without the consent of the legislatures of the states concerned as well as of the Congress" applies only to, "nor any state be formed by the junction of two or more states, or parts of states", or also to, "but no new states shall be formed or erected within the jurisdiction of any other state".

  10. That already is the law in Texas but practically speaking, it's not hard to imagine employers being retaliating against employees for taking advantage of that law.

  14. I’m not conflating anything. I’m asking you what your calculus is for deeming a nominee uncontroversial.
  15. Marcus was confirmed 50-46, so at least based on the final vote, it appears he does not fit your criteria of being uncontroversial. He was referred out of committee and thus placed on the Senate Calendar on January 18 along with 29 other executive nominations. Of those 30, 8 were confirmed with a voice vote within one month by a voice vote. Only one has been confirmed with more than 50 votes. Of the remaining 21, which ones are uncontroversial and what is your basis for concluding such?

  22. I didn't ask you how legislative bodies work. I'm quite familiar with the process, House rules, and parliamentary procedure. I asked you specifically which nominations are being obstructed by Democrats and in what manner.

  24. We could follow the same immigration policy we did for the first century of our existence and which led to the United States being the greatest country in the world.
  25. Blocking hearings and votes is obstruction. Voting against confirmation is not.
