  7. Courts have held that prosecutors are political positions as they’re entrusted to make decisions to carry out the political agenda of the elected DA. Aucoin v. Haney, 306 F.3d 268 (5th Cir. 2002). Public defenders on the other hand are protected because their duty is to represent the individual defendant before them rather than any broad policy position. Branti v. Finkel, 445 U.S. 507 (1980).
  8. Yeah, it’s just a first amendment case. If your employer isn’t the government, they can fire you for your political comments (although some states have laws prohibiting that I believe).

  10. If the allegations in the complaint are true and she was fired for private Facebook posts made by her criticizing GOP officials, she has a great case. As an administrative assistant, she’s a non-political employee. Her speech was in her private capacity.   12. No. This case was literally a court enforcing Title IX, so deriving from it that Title IX is somehow unenforceable is a fairly bizarre conclusion. Title IX prohibits discrimination on the basis of sex in educational programs funded by the federal government. The court ruled that transgender discrimination is discrimination on the basis of sex. Title IX regulations do allow for separate bathrooms/locker rooms on the basis of sex. In this case, the student, who was born female, had received an amended birth certificate designating him as male. But the school district policy assigned students to bathrooms based upon their genitalia, not birth certificates. The court ruled that such a policy constituted transgender discrimination under Title IX. The court did not reach whether assigning bathrooms based upon birth certificate would violate Title IX.

  19. There’s a threat as soon as the person requests that the exposure cease and is told “it’s staying up unless and until you pay us”. And it’s continued exposure. Surely you’re not arguing that as long as as I previously told someone you cheated on your wife, it wouldn’t be extortion for me to threaten to tell other people unless you pay me.
  20. I don’t really understand why you think the California definition is dissimilar from the definition I posted but sure. The website is obtaining consideration through the threat of exposing a disgrace. That placed in that context well enough for you?
