Under Texas law, it's not tortious interference for a third party to induce a contracting party to terminate the contract that contains a termination and buyout provision so long as the buyout is paid. Happens all the time in M&A deals with break up/termination fees when a new suitor comes along with a better deal. There is no breach of contract here so long as the buyout is paid. So there is no tortious interference. It isn't TI to induce a contracting party to exercise their legal right to terminate.

  7. I listened a bit this morning. They all claim CDC announced the Pierce termination on Monday to mess with their title hopes. Maybe he did. But I doubt it and those rubes never considered a couple things. First, is CDC a wizard that knew A&M would lose Sunday to force a game 3 and somehow knew he could wait until Monday to announce the Pierce firing. Second, did CDC announce anything? Near as I can tell, Bohls' source told him Pierce was out and Bohls reported it. I think it is more likely than not that source was someone in Pierce's camp. I strongly suspect CDC would have rather Schloss not have to face questions about him leaving at the postgame press conference. I bet it was Pierce who leaked it.

  18. We just switched to Lexis. It is about half of what Westlaw charges. And I use their AI as a starting point on legal research. Like this morning I had a client ask if they as a LP under Delaware law could sue to force a buyout for oppressive conduct by the GP (and majority equity holder) when the LPA contains no provision. Lexis AI got me the answer in 10 seconds. And it was right. It is just a starting point and you better confirm, but so far it has been a very nice tool. WL's natural language search was garbage, and I never used it. Boolean all the way.
  19. Maybe to pick up a first down once or twice a game when he can do so without taking a big hit / sliding. But generally speaking, I'd rather the ball be in the hands of our weapons, which we have a ton of -- Bond, Cook, Golden, Bolden, Niblack, Moore, Wingo, Blue, Baxter, etc.

  21. As someone who lives in Afton Oaks, I am thankful Culbertson killed that. Rail down Richmond would have killed the neighborhood. Richmond is the one decent east-west road in the city.
