I threw down some tomato cages to keep the tarp off of the plants, and then staked down a large tent over the top, then put a 4 x 8 sign over the top to keep the weight of the snow down.   5. In thses types of cases, blood draws will always be well after the time of driving. In this case there is a boating accident a distance from a hospital so far more delay than a traffic stop in an urban area. There will be lots of issues there. What kind of draws. Legal blood draws or medical blood draws are not the same. Time of draw. Was there both? BAC. Extrapolation factors, if known. Medical treatment prior to draw. Warrant issues, if no consent.

  7. It can, particularly in the case of an accident where the driver is injured. Also it is more likely in a case where there is a boating accident. There may not be standardized field sobriety test administered in that type of a situation. There may be a medical blood draw which is subpoenaed by the investigating officer or the prosecutor. Or there may be a legal blood draw and it takes quite some time for the results to be returned, as there are many legal blood draws.
  8. Not odd. Blood results came back from the lab. May have been an arrest warrant based on them, or a capias on an indictment. I’d bet on the former but the latter is possible.
  9. I definitely agree with your premise as I have had multiple occasions to represent “the right family” in a Calhoun County courtroom, but unless the D’s BAC was under .08 or there iare some issues with the warrant or blood test, this case isn’t going away with a slap on the wrist.
  10. Best thing about a cold snap is reaching out onto the porch to grab a cold beer. I have a cases of Yuengling in a big yeti outside. I freeze used plastic bottles from tea or soda for ice. Last time I put some in there was 2 days ago. I just took them out and they are frozen solid. Not a bit of thaw. So now there is absolutely no ice in the cooler. Still, I’m thinking I’m going to have to bring the cooler inside.
  11. That's why you take it slow down the ditch at night. This dude is looking at some pen time unless his attorney can pull a rabbit out of a hat. Convictions at trial (or technically, even a plea bargain) for Intoxication Assault and Intoxication Manslaughter sentences can be run concurrent by the trial judge, should the court so desire. So trying a multi-victim case can be perilous. His max exposure would be 2-10 for IA and 2-20 for IM, probably with a deadly weapon allegation that would make him serve at least 50% of any sentence before becoming parole eligible, but as a practical matter, in cases like this, a defendant would not parole out until close to all of the sentence was served.

    That's going to be 4 clues out of 6 for the Horizontal Gaze Nystagmus test. Lack of smooth pursuit and distinct and sustained nystagmus at maximum horizonal deviation, in each eye, is 4 clues The last 2 is onset of nystagmus prior to 45 degrees, where 45 degrees is (allegedly) correlated with a BAC of 0.08, and hence, prior to 45 degrees equals a BAC over 0.08. Controlled substances may or may not cause nystagmus. It depends on the substance.

  19. Got back into it last year after a lay off of over a decade. Been working on the game quite a bit since October. Off the tee isn’t so bad. The 2nd shot is usually what kills me. Short game has always been a strength. Yesterday I had 4 pitches off the green rim out or hit the flag and bounce out and I holed one from about 30 yards for a birdie.
