The former mayor reiterated several familiar attacks against Biden and his son, Hunter, though he only sued the president – despite the high bar for statements by public figures in a political setting to be found defamatory. 

The move comes as Giuliani is facing his own legal exposure on several fronts and new questions about his ability to pay the lawyers representing him. Wednesday’s news conference took place shortly after news broke that another lawyer, who has been representing Giuliani in the Georgia election subversion case, had withdrawn.

Asked if he was concerned about Giuliani’s ability to pay his legal fees in this case, as his debts mount, Lou Diamond, one of the attorneys who appeared Wednesday alongside the former New York mayor, told reporters, “That is the furthest thing from my mind.”

He's not getting paid 

“Lou Diamond” is a bit too on the nose for the type of seedy ambulance chaser that would take Rudy’s case on contingency.

This raises a most interesting question of choice of law.  He filed in NH because it has a long statute of limitations for defamation.  Most states are one year.

This despite neither Biden nor Giuliani ever residing or maintaining a home or property in the state, and the defamatory communication (allegedly) occurring in Tennessee.

Choice of law dictates that some state other than NH's defamation law applies (TN where the defamation occurred, or NY where Giuliani resides, most likely)  But that might not be true of the statute of limitations, if it is regarded as procedural rather than substantive.

Regardless, you're going to see Joe delay the shit out of this.

You are saying that the statute of limitations isn’t tied to the place of adjudication?  That seems like a poor idea, such that anyone could file in the place that fits their needs for SoL knowing that it will be moved to the proper venue. It’s a bullshit backdoor.

It's a bit of an open question.  In some places, like NY, it's "procedural," so governed by the law of the forum.  In other places, it's substantive, so governed by the law that controls the case.

I'm going to assume they researched it and the NH court will apply the NH statute of limitations, although there's about zero chance NH law governs the case.  Also some possibility that the NH court dismisses as an inconvenient forum.  And, it may not have personal jurisdiction over Biden.

Because Rudy has lost everything - his reputation, his businesses, his bank account, his ability to gin up decent new business, etc., and because Rudy knows he did it to himself and has only himself to blame.

Trump can gin up new campaign donations, can still fuck around with businesses, and does not believe that he caused his own problems.

In his release Friday, Howell said Giuliani, “consistent with his prior track record,” has failed to file any response to the submission of materials, despite the Sept. 22 deadline to do so.

Since the former Mayor of New York City failed to comply with the order or file an opposition, Howell ruled the jury must infer that Giuliani was intentionally trying to hide information about his businesses and social media when determining the “appropriate sum” of damages.

The Judge also said the jury will be instructed to infer that Giuliani received “substantial benefits” for defaming the election workers and that the Giuliani businesses “continue to generate” revenue from their operations.

The order makes it clear that Giuliani and his counsel will not be able to make an argument or introduce any evidence related to his financial benefits. He also will not be able to state or suggest that he is “insolvent, bankrupt, judgement proof, or otherwise unable to defend himself, comply with this Court’s orders, or satisfy and eventual judgement.


The five-page ruling was released Friday, ahead of the scheduled Dec. 11 trial.

I know that for most torts Tennessee has a one year statute of limitation.  Another sucky state with such a short to file is Louisiana.

it’s possible that one of the other reasons they chose that venue is apparently New Hampshire has a far less robust use of privileges as a defense to defamation.

The suit argues that Biden’s comments have damaged Giuliani’s reputation, and continue to do so, preventing him from holding “positions that require credibility, trust, decision-making, and independence.”

Giuliani’s lawyers then go on to list Giuliani’s career accomplishments as proof of his positive reputation, referencing his “sterling and unimpeachable character.”

Calling someone who is a public figure a “pawn” is, perhaps the least legally defamatory statement I could imagine. 
The only less defamatory statement you could sue on is Biden’s statement that Rudy’s opinion about Hunter Biden is a “bunch of garbage.”
And I think that even a 1L could figure out this has no traction.

Although SBU did not name the MP in the statement, the photos and video materials attached to it identify Dubinsky, whose alias, “Buratino,” was taken from a 1930s Soviet “Pinocchio” knockoff.

Dubinsky denied wrongdoing and called the investigation against him political persecution in a Telegram statement on Friday.

In October and November 2019, Dubinsky and Derkach gave several press conferences in Kyiv at which they claimed that based on an investigation by Kulyk, they had uncovered corruption and money-laundering schemes related to Burisma, a gas company which had future U.S. President Joe Biden’s son Hunter on its board of directors.

They also claimed U.S. investment funds were involved in money laundering in Ukraine.

In 2020 the U.S. Treasury sanctioned Derkach as a Russian agent undermining America’s political system. In 2021 Dubinsky and Kulyk were also sanctioned by the U.S. as foreign actors involved in spreading fraudulent allegations involving a U.S. political candidate

Depends on the borrowing statute status, and like Twice said, on whether the statute is deemed procedural or substantive.   This is all too soon to worry about statutes of repose, otherwise that would be a factor too.

As a plaintiff lawyer engaged in mass torts, I was always scouting around to find someplace to file a case if the SOL was blown in the state the Plaintiff lived.  Missouri for Roundup cases, NJ for talc, etc.  If you aren’t at least considering forum shopping, you are not representing your client well.   But you are correct that a blown venue can be fatal - or just a transfer, depending. 

This is all academic, as there’s no way Rudy is not a public figure, and as a public figure you are allowed to talk shit about that asshole. * “Pawn” is about the most innocuous thing you could have said about him.   But he may be right, so grandpa Joe needs every email Rudy has sent or received in discovery to be sure.

The judge warned Giuliani's lawyer that Giuliani's continued statements about the election workers is just opening him up to more lawsuits. The judge and lawyer openly discussed Giuliani's age and whether he could even follow instructions if he testifies. 

If I was Giuliani's lawyer I would be spending my time wondering if I'm ever going to see a dime for my time. Spoiler alert: you won't.

Holy shit, I forgot about that guy.  He represented somebody I knew with a claim against a therapist he was seeing with his wife (or one of them was seeing her, can't remember).  He's apparently a decent guy from a Ranger friend of mine who served alongside him.  But seriously, why is that Trump and his cohort always "hire" attorneys who have specialties in everything EXCEPT what they need actual legal help with>?
