Agreed. But also, younger victims are more attractive plaintiffs. Economic damages (lost earnings) can add up to make the case worthwhile.

These types of infection cases are difficult to prove for a plaintiff. They will need to show the worker was infected at work (rather than somewhere else such as grocery store) and that had the facility acted as a reasonably prudent faculty, the infection would not have occurred. There are significant challenges with that. With the number of healthcare providers getting COVID, there will be challenges to that part as well. You also have a high number of facilities that had (or still have) issues obtaining and supplying PPE over the last few months. With the surge of cases, the facilities could not just send the patients away if they didn’t have PPE for staff. So, what can a reasonable facility do? The changing CDC guidelines on PPE (and other guides de) will also play a role in these cases.
Also, the decedent apparently was an employee, so you may have employer liability immunity via work comp. in that case, the family will need to show gross negligence, which is an even higher standard.

There will be a wave of these lawsuits, but they will be difficult to win. I know several plaintiff med mal attorneys in Texas that don’t think the cases are worth it given caps and difficulties noted above in proving up the case.

Because it makes some of us wonder what could have been had we had our shit together earlier this year.  #1 in testing now isn't as sweet as we are going to be, by far, #1 in deaths.  It's like our Athletic Department.  Sure being #1 in swimming and tennis is fucking awesome.  But we've sucked for a decade in football, baseball, and basketball (a few bright spots notwithstanding).

No, people have been bashing him for it, not saying way to go Hugo, thanks.  But you're right lots of people have been wondering that, and its a legit question.

It has absolutely nothing to do with that and everything to do with it being Hugo.

@Brisketexan @TwiceHorn @Ghost of LL Are we going to see a lot more of these and/or do they have a leg to stand on (I’m not one of the thousands of Surly lawyers but it seems like it).  Jury trial would be beneficial.

Just for the hell of it since this hits close to home, I live a couple blocks from this place.  There have been quite a few deaths there and lots of hazmat ambulance crews.  Here’s a pic of the back door from a park nearby from last week.

I seem to remember Hugo posting some pretty clearly political stuff in this thread early on. And since he has switched to only posting about deaths without saying anything else. While technically he is in line, it's basically like when you tell a toddler he can't drink his juice in the living room, so he sits on the threshold between the kitchen and the living room with his body in the living room and his juice in the kitchen. If he were participating in the thread in other ways it might be a different story. Also he probably has the ceauxvaids.

@ChiTownDoc has explained this before. "Presumptive" means at time of death, the patient exhibited all the hallmark symptoms of COVID and COVID complications. But wouldn't ya know it, we don't have enough testing capacity to test those deaths to make them confirmed. 

The systemic delay in testing was an intentional move to cushion the shock on markets. If the numbers are small, then everything must be fine, right?

At least according to the CDC, presumptive means a positive test but without independent CDC confirmation. I would think pretty much everything reported is a presumptive at this point since the CDC has stopping doing confirmations as far as I know. The term probable is used when their is no testing, but all the hallmark systems. As far as death goes, you also have questionable and possible listings on death certificates that indicate a lower level of confidence.
