You're telling me that the cops did a bad job collecting evidence to build a case against their boy? Unpossible.

Rosenbaum zoomed in aerial footage. You can see the ambush lie in wait style of this. He's going to walk on self defense.

Idk if I would call that a "lie in wait" ambush, since the aerial footage picks up pretty much where the other video does, which is about 10 seconds before the shooting. There's still no telling what started the conflict, and we only have kyles statement to go on since he killed up the other stories.

I unfortunately agree with you, he's gonna skate. Cops love to tilt the scales of justice to protect their own

The investigator when asked on the stand yesterday would you agree Rosenbaum lie in wait for Rittenhouse? He said yes it appears so.

Yes, I agree the prosecution has been doing the defenses job for them. I'm talking about what you and I see in that aerial footage - which looks to start around the 1 minute mark. We see the yellow circle run into the cars, and then about 2 seconds later, white circle runs into the frame and continues to be pursued by yellow circle, and then we've seen the ground level view of events.

What I'm saying is that if the guy carrying the gun who would shoot 3 people that night started the altercation and then run away, would it not look like this?

Given the evidence we have, we just don't know because we have only the briefest of moments preceding the shooting.

Still no idea why they aren't nailing his ass to the wall on those illegal gun charges though

I have an idea.  It’s a state court proceeding with no jurisdiction to bring a federal charge.

Rittenhouse broke state gun laws. I posted them a couple pages ago. It's a black-letter class A misdemeanor for anyone younger than 18 to be using a rifle without supervision outside of a target range. And a class F felony if they use that gun to harm themselves or someone else.

The state doesn't want to prosecute their little up and coming recruit

Cops will always protect their own. Especially if the charge is violence against antipolice protesters. It's been happening for generations across society now

He was being a dick by putting out a fire in a dumpster the mob had lit and was pushing towards a gas station.  They were really upset that he extinguished the fire.

Witness accouts, on his side, said that he had been pointing his weapon at passer-bys earlier in the night. That's what got people upset. But you keep rolling with the dumpster thing.

They all left their house and came to the dance looking to tango.  And they all got what they were looking for.

(1) the 5'4" pedo was unequivocally the most aggressive, confrontational, and combative person in the entire video... initiated a fucking block-long chase of a person armed with a fucking rifle, because people were putting out dumpster-fires he set.  i mean, nothing comes close to this level of stupidity, except maybe some of the CR hot takes.

(2) Phony Hawk, the literal felon with a history of battery, vandalism, kidnapping, assault, etc, uses his skateboard to whack a person who was running away from him.  he truly deserves a post-humous F.A.A.F.O. trophy sent to his burial site.

(3) God's Cherub #3, a mostly-peaceful person who happens to also have a rap sheet, who attends a mostly-peaceful protest with a mostly-peaceful handgun, also tries to jump on the kid.  If he didn't learn what the 2 other guys did before him, he'll never learn.  Now he has to learn to jerkoff with his left arm.

(4) Rittenhouse.  In every single video that was ever dug up, his behavior was the most benign of the 3.  Not a single clip anywhere showing provocation or instigation or escalation.  You don't like his politics because he doesn't cheerlead for your team?  Fine.  That's not illegal.  You think he wanted to shoot people down?  Too bad, this isn't fucking Minority Report.  You don't think he was allowed to carry a rifle?  Charge him with that.  As it is, he was arrested, held, facing legal action, has life-long notoriety and probably a target on it back.

Pretty fit for the course.

One of them, a babyface with a backward ball cap, raised an assault rifle and pointed it at him.

The reporter, who said he has experience with ARs, said Rittenhouse was not handling the gun properly.

https://www.channel3000.com/i-just-killed-somebody-kenosha-shooter-caught-on-video-shooting-3-people-firing-at-least-9-rounds/

Witnesses on both sides both said that Rittenhouse was pointing his gun at people. I am sure the dumpster fire was the straw that broke the camel's back, but there was way more leading up to this. There is a video the videographer took during the incident where he was following Kyle and some guys confronted Kyle saying "you are the one that was pointing your gun at us". The video can easily be located. That video was prior to any of the shootings, so its not like the witnesses were making it up after the fact. You guys really need to do your homework. EVERYTHING the kid did was wrong, walk or not.

More “evidence” that has no relevance to the shooting and self defense.

Should they show a video of the pedo confessing to diddling kids?  Would that be relevant to the trial?

Links to these “eyewitnesses” that saw Kyle pointing a rifle at people prior to the shooting?

Were these the same “eye witnesses” from Austin who said the Uber driver purposely drove into a crowd. Started firing and drove off?

It seems our certain group is hell bent on wanting to throw out the rule of law so they can charge him with thought crimes.

well if it turns out that he was going around brandishing his rifle at people, it certainly would negate his self defense claim. Pointing a rifle at someone is pretty fucking threatening.

Once again, there is a video of people talking to him BEFORE the shooting ever happened. It wasn't even a tense situation. Just a couple dudes making a comment to him about it and he brushed it off. 3:16 mark

Sack, 52-80 and crew are willing to ignore all the things that led up to the shooting and wanna simply focus on the dumpster fire and the shootings themselves. The things leading up to that tell a story of a kid who WANTED to hurt someone, and made multiple decisions to put himself there at that exact moment. Then once there he escalated the situation through pointing his weapon at people, placing himself at the front of a tense situation, and even walking off by himself after making sure he made himself a target. He WANTED that moment. Lets not kid ourselves here.

Bottom line, this kid is no different than a guy who walks into a walmart and starts shooting. He just found a smarter way to execute his plan. He has all the signs if you dig into him a little, even how unnaturally controlled he was in a fire fight is very telling. This incident could spark more incidents just like them, or firefights on the streets. We should all be worried. Makeshift militias aren't the only ones who know how to use guns.

How does that remove self defense in a case where you're trying to flee, chased, getting assaulted by a mob with gun shots going off, hit over the head with a skateboard, people attempting to grab your gun after assaulting you as you fled and a glock pulled on you as you lay on the ground?

“Provocation affects the privilege of self-defense as follows:
(a) A person who engages in unlawful conduct of a type likely to provoke others to attack him or her and thereby does provoke an attack is not entitled to claim the privilege of self-defense against such attack, except when the attack which ensues is of a type causing the person engaging in the unlawful conduct to reasonably believe that he or she is in imminent danger of death or great bodily harm. In such a case, the person engaging in the unlawful conduct is privileged to act in self-defense, but the person is not privileged to resort to the use of force intended or likely to cause death to the person's assailant unless the person reasonably believes he or she has exhausted every other reasonable means to escape from or otherwise avoid death or great bodily harm at the hands of his or her assailant.
(b) The privilege lost by provocation may be regained if the actor in good faith withdraws from the fight and gives adequate notice thereof to his or her assailant.
(c) A person who provokes an attack, whether by lawful or unlawful conduct, with intent to use such an attack as an excuse to cause death or great bodily harm to his or her assailant is not entitled to claim the privilege of self-defense.”

Carrying an illegally purchased and possessed rifle is unlawful conduct. Pointing that rifle at people is conduct likely to provoke others to attack you. Thereby he is not entitled to claim self-defense under subsection (a). He's in multiple interviews saying he's going there with his rifle to protect himself, but he has no good reason to be there. He is on video 15 days prior expressing his desire and intent to "shoot some shoplifters". He is not entitled to claim self defense under subsection (c) either.

This is all a load of shit.  Kid was cleaning up graffiti, putting out fires, and rendering medical aid (he had some medical training as he was a lifeguard).  He did not shoot anyone for looting, rioting or arson.  He shot people who attacked him.

It is a good thing he had his rifle.  Otherwise the pedo and other scumbags likely seriously injure or kill him.  They fucked around.  They found out.

You should tell the prosecution.  They are not arguing that.  Probably because the video does not show him pointing a gun at anyone, especially the people who attacked him (until after they attacked him).

The state's own investigator testified Rosenbaum hid and ambushed Rittenhouse. Kid is going to have generational wealth after he sues the media once he is cleared of these false charges.

Is part of your argument really 18 = self defense but he's 17 so it was murder? Because that makes zero sense.

This is an "interesting" case in general because clearly Rittenhouse seems like a shitty person and he's being backed and lauded as a hero by a bunch of shitty people. At the same time, his actual actions here where he shot and killed people were in self defense.

Should he have been there? No. Should he have had a gun? No. Was he attacked and then shot in self defense? Yes. Should anyone out there think he's some sort of hero? Fuck no. But he's almost definitely going to get off any murder charge and I have a hard time understanding people who have watched all of the videos of the incident and believe otherwise.

Just wanted to rep this, it's a good take, and indicative of our divide.

If we want to discuss the cold legalities, he may succeed on his self-defense claim.  But that doesn't make him a hero, worthy of admiration, or any of that shit.  He's a little shit who went hunting, is being made into some kind of icon/hero (and by many of the worst people out there).  In some ways, it's as if we had a shitty, repeat-criminal gangbanger who never should have been carrying a weapon....but when the rivals came after him, he shot in self-defense and will prevail on that defense.  It means he would be acquitted of that particular murder charge.  It also does NOT mean that he's any less of a shitty person.

Yeah. I know. The state wants to protect its little wannabe cop boy. It's why the cops doing the investigation did a shit job and why the prosecution has been doing the defense's work for them. It's how typical cop investigations go. It's sort of why there's so much anger and distrust towards cops, if you hadn't noticed.

Do you think he shoots someone if he isn't chased or otherwise confronted?  He had more than enough time and opportunity to do it.  If he really just wanted to shoot a looter, why did he wait until a time that he was chased after by a fucking lunatic?  You think he was smart enough to hatch that plan?  I fucking hate having to seem as if I am defending this kid because he should not have been there just like all of those other people should not have been there.

(15 days prior) "I want to shoot shoplifters" (social media video with a friend)

(15 minutes prior) "I'm here with only lethal options" (interview w/ Daily Caller)

(3 minutes prior) some dude: hey you were pointing your rifle at us earlier, wtf bro? (video posted upthread on this page)

(Shooting happens) he was just defending himself from a lunatic that had no reason to be so upset with him!!!

IMO, I don't think any of this was overtly planned by rittenhouse. But he made the decision to be there, "put himself into harm way" with only lethal options available, and there's multiple people and a reporter who was there who have all said he was pointing his rifle at people and handling it unsafely. In my opinion, he falls foul of subsection c

(c) A person who provokes an attack, whether by lawful or unlawful conduct, with intent to use such an attack as an excuse to cause death or great bodily harm to his or her assailant is not entitled to claim the privilege of self-defense.”

Why would he inject himself into a situation that he has no personal stake in, has no support from the law to protect others property he has no interest in, brandish his rifle at random people, if not to give himself an opportunity to use his new toy and "shoot some shoplifters"?

I truly don't know.  What happened was that at a Gathering of Dumbasses, AR-15 Dumbass happened to have his wish fulfilled by Attacking Mayhem Dumbasses.  The question is the hypothetical of if someone gave him a lesser reason to shoot, might he still have done so?  I dunno.  He went there intending to Fuck Around.  So did the guys he shot.  What either group would have done in some lesser circumstance is hard to predict.

I'm comfortable concluding that no member of said Gathering of Dumbasses was there with a good state of mind.  Anything after that is just gaming scenarios.

I think you’re wrong here. There’s a lot of intermingled family politics that I wasn’t aware of. One extended family is basically running poInt on this.

https://kenoshacountyeye.com/2021/11/02/opinion-kenosha-mayor-who-let-city-burn-has-surrogate-in-rittenhouse-courtroom/

Spoiler

I will be in the courtroom for the duration of the political prosecution of Kyle Rittenhouse. Since the trial is streaming on millions of devices around the world, I won’t bore my readers with the same reporting that will be done by countless news agencies. The Kenosha News is putting out articles from the associated press even though they have a full-time assigned seat inside the courtroom. Maybe for once the Kenosha News editor doesn’t want Deneen Smith’s extreme left slant on the coverage of this case. What I will do, however, is point out things that those who are not intimate with this community, and even and some who are, do not know.

Mayor_JohnAntaramian.jpg

Kenosha Mayor John Antaramian (D)

Kenosha Mayor John Antaramain has been mayor since 2016 and was elected in 2020 for his sixth term until 2024. He also served as mayor from 1992 to 2008. After this term, he will have been mayor for 24 years. Many sources have told us he will not be seeking a seventh term because of the immense backlash from the Kenosha Riots of 2020. Most Kenosha residents view his response as very poor – he is the chief executive of the city, including the police department. We didn’t hear from him. He didn’t lead. Many joke that he was hiding in his basement. Some tell us he was hiding in Lake Geneva. We don’t know for sure – he wont tell us. John has a lot at stake in the Rittenhouse trial. He wants Kyle convicted. He wants Kyle to take the blame and distract us from his failures as our leader. Lucky for John, he has a lot of powerful family members in charge here in Kenosha. First off, the lead detective in this case is Benjamin Antaramian, his nephew. Benjamin wants Kyle convicted. Benjamin was very thirsty to connect Kyle Rittenhouse to the “Kenosha Guard” Facebook page. He grilled Dominic Black about if they had seen the page or not. They desperately wanted to connect the two. They could not. Mark Zuckerberg of Facebook told this to the public twice, once on a Facebook Q and A and again in front of the U.S. Senate. This is a common myth that is repeated by the media and naive folks. Kyle came to Kenosha of his own accord on the 25th – to volunteer removing graffiti. Law enforcement at the federal level, Facebook, and other forensic reviews have determined there was no such connection. The “Kenosha Guard” was simply a plea for help when our local leaders like John the Mayor and Tony the Governor would not help. Benjamin will be sitting at the prosecutor’s table for every day of the trial. Today, he held up the rifles that were carried by Rittenhouse and Black, Kyle’s friend. The mayor’s cousin is the Kenosha City Attorney, Ed Antaramian (D). His nephew is the Kenosha City Judge Michael Easton (D). His other nephew is Thaddeus (Tip) McGuire (D), State Representative. His other cousin is Laura Belsky (D) County Board Supervisor.

During the remainder of this trial, remember, the mayor who let Kenosha burn has a surrogate in the court room – at the prosecutor’s table, actually.

Kyle is “David” and the State of Wisconsin, with all of their resources is “Goliath.” The only thing that gives Kyle a fair and likely shot to win is the generosity of strangers that donated money to his defense. He now has a team of three sharp attorneys – among the best in the business. It’s now a fair fight.

BLM Sympathizer Kenosha DA Mike Graveley, like his predecessor, Robert Zapf, loves the limelight and always prosecutes the high profile cases. Not this one. Mike knows the state cannot win. That’s why he’s leaving it to T. Clair. Let’s see what T. Clair’s excuse will be if he loses.

I can’t vouch for any of the commentary, but the family connections are interesting as is the DA passing on trying such a high profile case personally.

This is like saying a woman that got raped by someone who was talking about going to the club and raping someone then dosed them or got them really drunk. Took them back to their place and fucked them then left.

Its not rape if you just zoom in on the fucking. Its definitely fucking rape though. Buncha stupid people up in here.

Holy shit that might just be the worst analogy I've read on Surly.

I really don't know.  I do not know what lead up to the nutjob chasing him.  I may have missed it, but I don't think that has been made clear yet.  Nutjob was clearly there looking for trouble whether it be to inflict damage to property or to inflict injury on someone.  I think it is more likely nutjob went there with those specific intentions and thought he found his mark in some stupid kid playing Army.

I think you’re wrong here. There’s a lot of intermingled family politics that I wasn’t aware of. One extended family is basically running poInt on this.

FWIW - the author of that article is a local militia leader with an axe to grind against the DA's office and not exactly an unbiased source. The other authors (who don't publish bylines on their articles...) all seem to be former PD people who all write for gun blogs and run militia groups on facebook.

It never ceases to amaze me how you gravitate to sources like that. The author of that article is one of the militia leaders who was putting out calls to arms for people like rittenhouse to come bring rifles into the protest.

The 3 people who got shot literally have a recorded history of various forms of assaults.  On video, as related to the actual incident, they are recorded as directly attacking him, unprovoked by him.

That's all that matters.

If you want to bring prior intent into it, the hours of footage that exists, filmed by all "sides", imply no such thing.  (...but there are witnesses!)

Quote

Bottom line, this kid is no different than a guy who walks into a walmart and starts shooting. He just found a smarter way to execute his plan. He has all the signs if you dig into him a little, even how unnaturally controlled he was in a fire fight is very telling. This incident could spark more incidents just like them, or firefights on the streets. We should all be worried. Makeshift militias aren't the only ones who know how to use guns.

Bottom line, they ALL fucked up and they ALL found out, and I don't sympathize an ounce for any of them.  You want to tie your political trailer to some of their hitch, that's your prerogative, but are swimming up a waterfall here trying to ascribe culpability.  I'm not crewed up - I'm looking at who's responsible for what.  I'd like for some of you to get kicked in the face, but - buddy - that sentiment in itself is not a crime.

And none of that should matter because it isn't relative to the charge. Just like any of Kyle's alleged activities prior to the shooting should matter.

This isn't Judge Judy.

correct

but it is cosmically-fitting to see the comeuppance

No it's not.  3 people were killed over something avoidable.  I don't think the cosmos is a better place after this result.

Two were killed.  One was disarmed.

It was avoidable.  Don't attack someone with an AR who is on the streets rendering aid, putting out fires, and cleaning up graffiti.

au-contraire.  it was extremely avoidable.  the hundreds of other people there that night not attacking an armed person are not dead, and the 100,000 other kenoshans who were at home not smashing cars or burning shit or playing soldier are not facing murder charges.

that's a strange way to characterize brandishing an illegally obtained rifle at people in an area he doesn't live or have any interest in being in aside from going out and playing soldier like his militia leader on facebook told him to do. Rittenhouse was excited that it was time to use his gun.
