It wasn’t the message he posted that got people’s attention, but rather the painting he shared alongside it, which many felt to be in poor taste:

“As the values conservative endorsed by President Trump, I am proud of my record standing up to and defeating the Biden Administration - repeatedly,” he said. “I have taken the American First fight to this far left administration on the border and reinstated Trump’s Remain in Mexico policy. I am also prosecuting dozens of felony charges of voter fraud and helped  lead the investigation and closure of the largest human trafficking website in America.”

It's not really an ethical issue.  I read the briefs and I think it is a preposterous argument, but they make it look pretty good in the brief.  There are also some technical issues, as in they sued the "Office of the Attorney General," but not Ken Paxton in his official capacity and they probably should have done both.

That's an easily recoverable fumble as far as not ending the lawsuit, but it may be another ground for this kind of delay.  That's really all this is, delay.  Barely plausible, but legal, lawful delay.  Delay helps defendants.  Especially those who may be run out of office.

Actually, the Whistleblower Act only provides a cause of action against the employing agency and not the individual accused of the crime, or the supervisor that commits the adverse employment action.  Other than that, all of this is spot on, especially the obvious delay tactic.  Paxton has also managed through this maneuver to avoid discovery in the trial court.

Paxton was addressing an argument that the Biden administration had made for why it should be allowed to challenge the six-week abortion ban in federal court. The Justice Department said that the way the ban affects interstate commerce gives the United States the authority to bring a lawsuit challenging it.

Paxton shot back on Wednesday in his brief by arguing that the Justice Department did not cite any "actual evidence that the Texas Heartbeat Act burdens interstate commerce."

Furthermore, the abortion ban is encouraging people to cross state lines, he suggested.

"What evidence that does exist in the record suggests that, if anything, the Act is stimulating rather than obstructing interstate travel," Paxton said, pointing to an increase in Texas women seeking to travel to Kansas and Oklahoma to obtain the procedure.

In an earlier court filing, the leader of the clinic organization Trust Women told a court that call volume for appointments at its clinics in Kansas and Oklahoma had doubled, and a significant portion of those patients were from Texas.

"About two-thirds of our [Oklahoma City clinic] patient appointment calls now come from Texas patients seeking abortions that are unavailable throughout their home state," the provider said, noting that typically only a quarter of the clinic's patients are from Texas. In Kansas, where in 2019 only 25 abortion patients were from Texas, approximately half of the calls to its Wichita clinic are now coming from Texas patients, according to the filing.

Paxton's brief was filed ahead of a hearing scheduled for Friday during which US District Judge Robert Pitman will consider whether to impose a preliminary injunction blocking the law. The Justice Department lawsuit is one of several cases in federal and state courts attacking the six-week ban, which is at odds with the US Supreme Court's precedent in Roe v. Wade.

Yet the six-week ban has remained in force due to its design, which is aimed to complicating the path for getting a federal court order blocking the law.

In passing the measure, the Texas Legislature adopted a novel legal strategy barring Texas officials from enforcing the law, instead allowing private citizens -- anywhere in the country -- to bring a civil suit against anyone who assists a pregnant person seeking an abortion in violation of the law. In a separate federal lawsuit brought by clinics, courts including the Supreme Court have pointed to this enforcement design as why they were not yet able to step in to block it.

Paxton emphasized in the new briefs that as the law was written, federal courts have no jurisdiction to hear the dispute and he rejected arguments made by the Justice Department that the individuals who are able to bring civil suits are acting as "agents" of the state.

"Texas does not represent the interests of those who would bring private causes of action," Paxton said.

"No federal court can hear a case to determine the constitutionality of a statue that the sovereign defendant is not enforcing," he concluded.

On the first day of early voting in Texas, Attorney General Ken Paxton announced the formation of a 2021 Election Integrity Unit, which is charged with maintaining secure local elections in Texas.

Paxton’s office also set up a public email address Monday to document alleged violations of the Texas Election Code.

  • Voting by mail, if ineligible.
  • Accepting assistance with marking a ballot, if ineligible.

According to the press release, the unit will dedicate agency lawyers, investigators, staff and resources to ensure “this local election season…is run transparently and securely.”

“The foundation of our constitutional republic is a secure and transparent ballot,” Paxton said. “It is why my office remains ever vigilant in defending the integrity of our elections. And it’s why I’m establishing a 2021 Texas Election Integrity Unit to monitor this season’s local elections—which, even though they’re local, must be run in accordance with state law.”

At this time, it is unknown how this newly formed unit is different from Paxton’s previous efforts to oust election fraud. 

In 2020 Paxton’s office was a national leader on this front, dedicating thousands of hours and resources to investigating fraud. Only 16 cases were prosecuted from the 2020 election, according to the Houston Chronicle.

Exactly. Suit has been on file for a year and the plaintiffs have been able to conduct exactly zero discovery. The AG’s office never thought it would win with this bullshit argument. It’s nothing but a procedural delay tactic.

It’s still crazy to me that Paxton was indicted 6 years ago and continues to delay the trial. Does anyone not believe that he will find one MAGA juror, in the eventual trial, that will believe this is all a conspiracy against Paxton.

or Paxton will delay this until the right prosecutor shows up and dismisses that charges.

Isn't that the playbook that worked for Tom DeLay?

Delay it for 6-7 years so nobody really remembers the scandal, paint the offense as a technical distinction, make the trial boring as shit, and in DeLay's case, make sure the venue isn't Harris county.

Absolutely. The delays are also creating a scenario where some politicians will be desperate for federal or state pardons. Won’t what they do to help certain re-election campaigns.

are there any safe guards to prevent a defendant, with the right resources, from delaying a trial for a decade. Do we have a Justice system when someone can commit a crime and never face consequences?
