More than anything, I am a contrarian.

I understand the process pretty well. Those were the only two exhibits that were submitted in landscape, which also happened to be the perfect way to cut out the dates on both documents. That mistake is so obvious reading the rest of the documents that I have a hard time believing one wouldn't notice it prior to writing those allegations. As I said, maybe it is innocent. But, if I'm the judge, I'm making you explain it. I don't think benefit of the doubt is deserved here. You may ultimately be correct, but it should be incumbent on the submitting attorney to explain her mistake in detail and explain why it doesn't deserve some sort of punishment.

That wasn't directed at you, obvs.  More of a general statement.  We're just having a genuine disagreement and we're not really that far apart.  But even with these shitheads, I am willing to give the benefit of the doubt.

Definitely some splainin to do.  I don't think Powell really had much to do with this complaint, besides skimming it.  She's just a grifter and insane gadfly now.

Apparently, this Haller person did and wasn't really up to the task, either because of incompetence or time pressure or both.

You'd really think after advertising "the Kraken," and knowing that your work is going to be heavily scrutinized, you'd really try to dot every I and cross every T.

One of the worst things about the current political culture is that it very much resembles sports fan culture.  Right and wrong don't matter, just winning. There is no allegiance to any political philosophy, just teams.  It's great for sports, but horrible for governance. But, the good thing here, is that these Trump sports fans just lost the big game they were certain they were going to win.  We've all been there.  We've all seen how the fan base can strike out at everybody and everything that they could possibly blame for an unpleasant reality. That includes their fellow fans who might have a different view on what the reality is.  I look forward to some ugliness in the Trump fanbase.  

Somewhat related, I read "The Origin of Satan" many years ago.  It dealt with how the idea of Satan originated and evolved in Judeo-Christian mythology.  The pertinent aspect was that early Christian writers were much more likely to call their fellow Christians (or Jews) "Satan" than outsiders like the Romans, or other pagans, or, as time went on, traditional Jews. For purists, people who are 95% on your side are more "evil" than people who are not on your side at all.

So, when trump orders martial law, and the generals have him arrested, do the elected republicans then finally rebuke him?  And if not, can we arrest them too?  Of course, any of this will lead to calls of political prisoners and probably would be the flash point for militias trying to take back the country by force.

Fuck that. Incompetence is frequently just as bad, damaging, dangerous, whatever as maliciousness. Both should be punished, sanctioned, scorned, fined, discredited, whatever.

And I'm not just talking lawyers, although that is the current profession under discussion.

 

In the case at hand, deliberately cutting off a date on a downloaded picture is just as bad as stupidly cutting off a date on a downloaded picture. The point remains, the date was cutoff, its bullshit, they should have used more due diligence. There has to be some sort of standard followed and enforced.

It is a little bit strange.  A challenge to the constitutionality of Act 77 has got to be a valid claim, it's only the remedy that's barred by laches.

As I recall, the suit asked for a declaration that Act 77 is unconstitutional.  It would seem that would have to survive, laches notwithstanding.

Thus, it would seem that the court should strike the extreme remedies, but permit the DJ count to proceed to trial.

But, this may be some oddball proceeding where the PA Supreme Court takes jurisdiction and a more ordinary DJ that didn't ask for stupid remedies would survive.

Something is superfucky about the way those were downloaded or screenshot.  In a way that makes me think incompetence rather than intentionality.  Every page of both exhibits is truncated at the bottom.

Nevertheless, it is now incumbent upon Powell to correct the record.  Someone should probably email her about it so we can make sure she eats some doodoo in front of the court.  Or is truly, deeply unethical.

When all of your evidence comes from posts on Parler, it's easy for things to get superfucky.

yeah...no.  i'm going to disagree.  this was an intentional redaction meant to deceive the Court, regardless of how little she spoke of it in the motion. 

bottom line is that documents like these...if obtained properly...are self-authenticating as public records.  she knows that...hell, EVERY 2L and beyond knows that.  it's Evidence 101 (see Fed. R. Ev. 902(2)(a-b)).  and it's extraordinarily easy to get a true and correct copy of a self-authenticating public document. 

her entire conjucture is she purports to be a fact, when it fact it's not due to her own intentional malfeasance.

this is intentional on her part...she's playing fast and loose.  she should be sanctioned at minimum, most likely she should be immediately barred from practicing in that Court and prosecuting the present action barring a show cause hearing on why shouldn't be barred and sanctioned.
