WINSTON-SALEM, N.C. -- A second lieutenant in the U.S. Army is suing two Virginia police officers over a traffic stop last December during which the officers drew their guns, pointed them at him and used a slang term to suggest he was facing execution before pepper-spraying him and knocking him to the ground.

Body camera footage shows Caron Nazario, who is Black and Latino, was dressed in uniform with his hands held in the air outside the driver's side window as he told the armed officers, "I'm honestly afraid to get out.”

“Yeah, you should be!” one of the officers responded during the stop at a gas station.

In a lawsuit filed earlier this month, Nazario says his constitutional rights were violated during the traffic stop in the town of Windsor. The two sides in the case dispute what happened after a second police officer joined the first one in the stop. At the time, Nazario was coming from his duty station and going home, attorney Jonathan Arthur told The Associated Press on Friday.

“Graduated from Virginia State University. He was commissioned out of their ROTC program. He's an officer in the United States armed forces,” Arthur said. “These guys decide to do this to him.”

Asked about Nazario's condition after the incident, Arthur said, “He's definitely not doing too well.”

Windsor Police Officer Daniel Crocker radioed he was attempting to stop a vehicle with no rear license plate and tinted windows. He said the driver was “eluding police” and he considered it a “high-risk traffic stop,” according to a report he submitted afterward and which was included in the court filing.

Arthur said Nazario explained at the time that he wasn't trying to elude the officer, but was trying to stop in a well-lit area “for officer safety and out of respect for the officers.”

Another officer, Joe Gutierrez, was driving by when he heard Crocker’s call, saw him attempting to stop the SUV and decided to join the traffic stop. Gutierrez acknowledged that Nazario's decision to drive to a lighted area happens to him “a lot, and 80% of the time, it's a minority,” Arthur said, quoting the officer.

The lawsuit says by the time the two officers reached Nazario's SUV, the license plate was visible in the rear.

 

Nazario drove his SUV to a well-lit gas station where, according to the lawsuit, the two officers got out and immediately drew their guns and pointed them at Nazario after they got out of their cars. The officers then attempted to pull Nazario out of the vehicle while he continued to keep his hands in the air. Gutierrez then stepped back and pepper-sprayed Nazario multiple times as officers yelled for him to get out of the car.

“I don't even want to reach for my seatbelt, can you please? ... My hands are out, can you please — look, this is really messed up,” Nazario stammered upon being pepper-sprayed, his eyes clenched shut.

The officers shouted conflicting orders at Nazario, telling him to put his hands out the window while also telling him to open the door and get out, the lawsuit says. At one point, Gutierrez told Nazario he was “fixin’ to ride the lightning,” a reference to the electric chair which was also a line from the movie “The Green Mile,” a film about a Black man facing execution.

Nazario got out of the vehicle and again asked for a supervisor. Gutierrez responded with “knee-strikes” to his legs, knocking him to the ground, the lawsuit says. The two officers struck him multiple times, then handcuffed and interrogated him.

The traffic stop was captured on Nazario's cellphone video, and the body-worn cameras worn by Crocker and Gutierrez, according to the lawsuit.

“These cameras captured footage of behavior consistent with a disgusting nationwide trend of law enforcement officers, who, believing they can operate with complete impunity, engage in unprofessional, discourteous, racially biased, dangerous and sometimes deadly abuses of authority ...” the lawsuit says.

The AP reached out to Windsor police for comment, but an email was not returned and their voice mailbox was full. No one answered the phone at a number listed for Crocker on Friday.

Crocker and Gutierrez still work for the department, the town manager told The Virginian-Pilot of Norfolk. Windsor is about 70 miles (112 kilometers) southeast of Richmond.

I loathe out of control or over zealous cops.  I dislike idiots just as much.  I get why a black person might be afraid when guns were already drawn, but after watching this video the driver is arguing and being a moron. 

If he truly was afraid he should have stated that he didn't want to reach for his seatbelt or simply reached from the outside to open the door or stated that he feared reaching for the door and being shot.  Instead he was telling the cops, who made it clear he was being detained, to not touch him. 

This issue is too serious for me to waste it on, imo, an attention whore.  The driver knew what he was doing.

The really aggressive one who shouts, "Yeah, I'm a veteran too.  And I know how to obey an order."  Two minutes later, same dipshit cop, "What are you?  Specialist?  Corporal?"  The victim responds, "I'm a Lieutenant."  

Uh, I know emotions were running high, but if you can't tell the difference between somebody's arm and somebody's collarbone.......you're either the dumbest fucking veteran ever or Derek Chauvin.  Either way, your ass needs to be put down like a sick dog.

This,this is the problem with society and why it’ll be a very long time if ever. That cops will be held to the standard they should be.

There was no reason for trained specialists. Whose first duty is to “protect and serve” to act the way they did. Sure. The guy may not have acted exactly the way some wanted him to.  But who could blame him for doing so when put in that kind of situation. But again. Let’s blame the citizen. Someone not guilty and certainly not deserving of such treatment. At least the one officer tried to help the guy unbuckle his seat belt and get out. But the other meathead told him not to reach in. We need LEO in that situation to tell the meatheads in charge to shut the fuck up and solve their small dick problems through therapy or some other manner. Until good Cops and all of society stop accepting such behavior from those our taxes pay for. This will continue.

 

 

Also sad that to so many. A Black man knowing full well what has happened to many other Black men. And numerous others of different races and skin color. Not being able to act perfectly cool and calmly when two out of control officers are pointing guns at him. Is the one at fault here. But hey. Expecting better treatment means someone is just an “attention whore”.

If he *had* reached for the seatbelt, there's a fair chance those two would have killed him and played the "reaching for a weapon" and "feared for my life" cards.

Confusing for some, sure, but not strictly conflicting so that’s just bad reporting (sadly par for the course of today’s journalism)

edit: forgot he had his seatbelt on, that would be conflicting orders but yeah, no doubt he’d be shot if he reached in without warning and even if he said he was going to undue his seatbelt, I’d put it at over 50% he’d be shot. Still stand by fact that it is shitty reporting though.

How sad is it that this normal occurrence no longer has a reaction from me. My fiancé was broken up by it and i told her i got pulled over driving through falfurrias going 24 over the speed limit. Cop walked to my window and asked for my license, after looking it over, gives it back to me with a warning and have a good day. I am a white complected Hispanic, because of my skin color I can get away with speeding and I don’t have to worry for my life when the officer gets to my window... we live in a very fucked up damn world man.

You guys act like he got shot or was beat up.  Based upon the video alone i saw none of that.  What i did see was a person who was repeatedly told that they were being detained and why and then the driver making poor choices.     

Did they then shoot him?  No.  Did they billy club him? No.  Did they put their knee on his neck? No.  Did they even tase him?  No.

IF you argue that the dude in the car demonstrated "patience" then one could argue that the cops demonstrated equal amount of patience as the result was the dude was maced and arrested. 

Why all of this happened is probably stupid, but not the point.  What some officers said probably is stupid, but also not the point.  We can all agree there are moron cops who say and do stupid shit.  We can all agree we don't want those dudes as cops. All that and my IMO is that the response by the driver was just as stupid.  

This issue is serious to me.  Serious enough that i won't let fucking emotion take over when the facts don't support it.  In the end weak emotional arguments using past bad actors to justify or lump this in as just another incident of race or police fuck ups is some childish ass shit.  It doesn't help and hurts the cause for better policing.   

What i see is an incident that probably could have been avoided on both sides.  Listen to the words the driver actually stated and asked.  When did he say those things?  Look at his actions when he used his arm to keep the door closed after they told him what was happening.  Listen to his butt hurt feelings as they took him down.  Not someone in fear, imo, rather hurt pride.  What i hear is someone, like you guys, who is lumping himself into being a George Floyd.  He's not.  He's an asshole, who happens to be black, who thought he was a martyr.  Yeah, i'll say it, he should have just fucking done what they said, after they told him he was being detained and for what reason.  He didn't because he didn't like the reason or thought it was wrong.  That's my ugly take whether any of you like it or not.

At what point does not displaying a temp plate warrant drawing your gun and pepper spray? 

I'll hang up and listen as you explain to me the reason they drew their guns was because this guy was clearly super scary and threatening. Mainly because he's black, and we all know what we've been taught is that every black man that drives a new car is a drug dealer, with lots of guns and illegal things in his car.

It is a terrible fucking take. He had guns pointed at him and feared for his life. That second cop was coming in hot for no fucking reason. If the guy had calmed down for half a second after it was clear there was no threat, it would have been a normal traffic stop. He literally told them he was afraid of opening his car door. Again, do you honestly think he could have just put his hands back in his car to take off his seatbelt and open the door without having roid rage light him up? 

They also never told him why he was being detained. Not really. All they said is he was being detained for resisting arrest, which isn't really any informatiom about why he has two jack holes pointing guns at him for a traffic stop.

No, my opinion is way better than yours because yours is trash. I have no idea why you have such low expectations of our police force. Again, tell me why they had their weapons drawn for a fucking license plate? Tell me why the cop couldn't just calm down and say "you're being stopped because you have no rear plate." Why the fuck was aggressive attitude necessary? Why cant the supposed trained professional keep his emotions in check and deescalate the situation?

I've been saying for years, they need to take guns away from the street cops. Send them in pairs with OC spray and a taser, save the guns for the goon squad or SWAT team. They'll be a lot more respectful to the citizenry in a short amount of time.

Race is absolutely a factor in the treatment by the cops.
