Man charged after urinating in a cup on Air NZ flight

A man has been charged and fined after he was caught urinating in a cup on a flight next to passengers.

The 53-year-old was removed from a flight from Auckland at Sydney Airport in December, after receiving a report the man had urinated into a cup while in his seat.

Australian Federal Police told Stuff Travel the man was charged with acting in an offensive or disorderly manner affecting safety, contrary to section 91.525(4) of the Civil Aviation Safety Regulations 1998 (Cth).

The matter was heard in the Downing Centre Local Court on Thursday, 21 February. The man was fined AU$600 (NZ$655).

A mother and daughter who were on the flight next to the man told Stuff Travel they were left “humiliated”.

Passenger Holly was flying with her 15-year-old daughter from Auckland to Sydney to visit Holly’s sister.

They were sitting in the middle and aisle seats, with the man sitting at the window.

Holly said when they landed in Sydney they did not have a gate so the plane sat on the tarmac for 20 minutes or so. The engine had been turned off so it was much quieter while they waited.

“We heard him do it [urinate]. There was no mistaking what the sound was and I just looked straight at my daughter and my daughter looked straight at me. It was very obvious what was happening.

“So yeah he pulled his naked penis out next to us at least three times.

“That just makes my skin crawl.”

She and her daughter went to the back of the plane and told the flight attendant what had happened.

“And because I guess we had moved he then got up after us and was carrying another full cup. I guess his intention was to pour it out in the toilet. Then as he was walking, he was obviously quite drunk by this point, he spilled a good amount of his urine onto the flight attendant at the end of the plane as well, because he tripped.

“So then he went into the toilet, we had told them obviously what had happened, or what we thought had happened, and then it was kind of solidified by the fact that he had this cup of urine and had spilt half of that on her.

“When he came out of the bathroom, the crew pulled him aside and essentially, I guess, asked him not to do that any more.”

Holly said the plane was then further delayed to wait for the Australian Federal Police to arrive.

“We were humiliated by being escorted off the plane.

“I said, no, I don't want to make a police complaint. I just want to go home and get off this plane.”

She did however give a statement but said since then, she had not heard from the police.

After making a complaint to Air New Zealand Holly said she only received an automatic, ‘thank you for your complaint’-type message.

After hearing nothing more, she submitted three more complaints over a number of weeks.

An email was sent to Holly by Air New Zealand on Tuesday, three months after the incident, saying compensation was not an option. She has since been offered a gift basket.

“I understand and accept totally they can't control passengers, but I do think that the crew should have noticed he was drinking. I do think that the crew should have not put us or subjected us to being police escorted off the plane.

“I think they're not responsible for his behaviour but they are responsible for their customer service.”

“I want to be able to show my daughter that actually this is so abnormal, look how above and beyond they've gone to apologise. I found that really odd.”

Holly said her daughter now does not feel comfortable to fly alone, jeopardising her school holiday plans to visit her aunty.

“My daughter won't fly alone because she's absolutely terrified that she's not safe.”

Chief operational integrity and safety officer, David Morgan said he “can’t comment on this specific incident.”

“However, if behaviour like this were to happen on our aircraft, our normal process would be to call the local law enforcement agencies and do our own internal investigations. Unless there were exceptional circumstances, this sort of abhorrent behaviour would lead to the passenger being banned.”

Morgan said Air New Zealand issues between five to 10 ban letters to customers each month for a range of disruptive and unacceptable behaviours, repeated failure to follow crew instructions and intoxication.

“We will not stand for abhorrent behaviour that impacts other customers and our staff. It’s frustrating for us to have to deal with behaviour like this from a small number of people when most of our passengers are fantastic.

“We apologise to any customers who have experienced poor behaviour from a fellow passenger and would like to reassure our customers we take issues like this seriously.”

Coincidentally, on the same day in December, 2023 a New Zealand couple flew with Qantas from Bangkok to Sydney sitting in seats covered in a child’s urine.

They initially thought it was water, but when they discovered a pair of children’s underwear under the seat they put two and two together.

After a back and forth, Qantas refunded the couple.

The Reddit user said the ground crew spent over two hours trying to clean the carpet with paper towels, and shared photos of the mess.

"The smell never quite went away," they added.

Most us have seen/known plenty of rich people act like complete fucking assholes on airplanes multiple times.  But at this point, I almost think it's at some kinda weird tipping point I can't quite describe where the people, regardless of income bracket, are trying to get attention almost to 'go viral' (admittedly it's concentrated on just a few airlines).  I think it's also flying is so much stressful than it used to be because of long TSA waits and so many dipshits sitting alongside you, that I think more people are more liquored/drugged up to get through the circus so shit gets escalated real quick.  I guess people are just filming and posting it more, but I really feel like it didn't used to be like this as recently as 2020 but has gotten outta hand at a quick rate and I think again, the attention part is a major factor.  I've seen so many incidents over the last decade from grandparents to rich business travelers to obvious white trash and everything in between.  I get it, we all get a little anxious up there and maybe over-served, but it almost seems like a tacit contest at this point nowadays.  Dunno.  Please Feel Free to Move about the Crazy.

Well, I'm not sure of other people's experiences, but I haven't had a trip go smoothly without issue in at least a few years. I know I'm going to get fucked over, I just don't know how or when. At this point, I don't really want to talk to anyone from the ticket agent to the TSA to pretty much every airport or airplane staff member. Agent somehow removed the KTN number from spouses ticket and need to go to other security line, Attendants not available for the flight, Cancelled flights in the middle of the itinerary, Improperly sealed purchases from duty free... Flying is basically a total shitshow these days. Unfortunately, there usually aren't any other options except limiting distant vacations.

I had a bunch of Euros that I didn't feel like converting so I purchased alcohol at the duty free shop. When we got to Chicago, they had us recheck our bags and then they sent us back through security for our domestic transfer back to Austin. The liquor bag wasn't sealed properly even though the receipt was there and the liquor was sealed. The security lady said that she thought that it would have to be confiscated but that she would ask her boss. Her boss then came over and was a complete asshole to me. I said just keep the shit and started to walk off and he followed me yapping away about me using the word "shit" in his airport with kids and families around.

Gotcha.  Had a somewhat similar experience coming back through Denver from abroad.  Said the bottle was compromised or not stamped or somesuch shit, I don't quite remember.  So I couldn't re-check it. Can't remember the details but I just left it behind and got on my flight back to Austin.  

But him chasing you down to give you a hard time about saying "shit"?  They pat down children's genitals for a living, I think one cuss word is the least of the issues of the day for families.  

csb/ I think I was coming back from O'Hare and they're supposed to at least say something cursory like, "I'm going to pat you down sir"  And this guy was probably just hungover or just forgot given the job redundancy.  So I'm called over for secondary check.  And he just immediately gets on his knees and slides his hands right up to my balls basically.  I am  nervous about flying anyway even though I log a lotta miles.  But I paused and collected myself so as to not get angry and cracked a bad joke, "Hey, you gonna buy me dinner before you do that next time?"  Harmless, particularly since he didn't ask for consent for that invasive of a move.  And he ended up grilling me and my luggage for 10 extra minutes.  I thought it'd be a routine pat-down with the right permission and all that.  Next thing I know he's handling my balls with BOTH hands before I even know the search has begun.

There were multiple things wrong with it. Duty free should know how to seal the bag correctly. Before rechecking the bags, security should have asked if there was anything we wanted to add to the bags because we were going to have to go through security lines again. If the airport was set up correctly, sending secure passengers back through an hour security line is completely unnecessary for everyone involved and just adds to airport chaos and frustration.

From my perspective, it took probably 1hr to go through customs, 15minutes to go from international to domestic and then an hour line back through security. And then of course there was the shitheel TSA manager who escalated a situation that his underling had under control. And it was all pretty much out of my control as after a two hour process, going to ticketing and trying to check the liquor just so I could miss my connection was not an option. I know now though to pay attention to how they seal duty-free bags and if you are flying back through OHare internationally that you are re-routed through security again after customs clearance so you better have a long layover between flights and limit what you are carrying.

SHould have just opened it up and pounded it right there. Maybe pass it around, see who else wanted a belt.

All/almost all US and Canadian airports (Miami used to be an exception, don't know if it still is) make you pass through security after arriving on an international flight. The only exceptions to this are if you are coming from an airport that has US pre-clearance (most Canadian airports, Dublin, some others); then you've already cleared customs and TSA there and your transfer in the US is treated just like changing planes domestically. Other than that - yeah, you're going to have to clear security again. Some airports are better than others and have dedicated security lines for international arrivals; some don't and make you go back into the airport like everyone else. I try to avoid those if I can, much as I try to avoid airports where you need to leave airside just to transfer between terminals domestically, which has the same effect. 

It sucks, no question - and it also seriously sucks about your duty-free.

Thanks. I did not know that. Does this mean that if you fly from Dublin then your flight is directed to the domestic terminal? Is that at all US airports?

Yeah, if you travel through a pre-clearance airport overseas (Dublin, Shannon, Bermuda, Nassau, Aruba, Abu Dhabi, and the major Canadian cities), you're released into the general horde when you arrive at your arrival airport in the States as if you were arriving from SFO or JFK. You've already cleared everything before you leave (this means that once you do that, of course, you're in a sterile part of the foreign airport and have to stay there until you depart, so keep that in mind). The fine folks that give you patdowns without warning want to ensure that it's only US Americans who do that prior to you joining the domestic air travel scene (the benefit if you're connecting in the US, of course, is that you've also cleared customs and immigration and can just go to your next flight).

If you travel overseas at all, I'd highly recommend Global Entry as it speeds up customs and gets you TSA pre-check.
