Here in Bexar county people get mad at the DA’s office for the large number of cases that get dropped. No one stops to think that part of the problem is police grossly overcharging people for arrests which then become difficult to hold up on conviction. Seems like Williamson county operates the same.

Probably a “cover your ass” approach. Make the arrest and let someone else make the decision, so you cannot be accused of failing to arrest a person for a crime, particularly assault on a woman.

this is why I dont jump to conclusions. If the Williamson County DA ain't doing nothing, he probably didn't do anything.

The DA wants to be able to convict beyond a reasonable doubt. Need solid evidence. Need reliable witnesses.

In domestic abuse cases, the witnesses often have conflicting feelings, regret, or a financial incentive to clam up. Or, they dont want to be homeless or have their kids go through shit. Or, they are scared. It’s why some jurisdictions prosecute even if the victim doesn’t want to press charges.

Whether or not charges are dropped, it doesnt mean he didnt do the crime. It just means the case to convict him beyond all doubt was not solid.

We don’t know shit. And now it’s none of our business.

I see that side of it, and it makes sense. That's why I said he probably didn't do anything. But if he were choking her, she'd most likely have marks on her neck. So, who knows? it is none of our business like you said.

I’m really not. And I don’t think I’d fit into his “posse”. I’m white, closer to 40 than 30, and have nothing to offer that would benefit him unless he finds himself shot, stabbed, or on fire.

I do, however, possess enough life experience to reserve comment/judgment on a topic of this nature until further information is available. And I believe in mocking and belittling those that jump to conclusions.

It’s crazy that ppl on here act like women don’t fucking lie. And he was automatically guilty.

The venn diagram of guys who do this kind of thing and the guys who attract women who would lie about this sort of thing has a LOT of overlap.

Years ago when the legislature classified theft of precious metals as a felony as opposed to theft of regular old metals, which was usually a misdemeanor, deputies and city cops became amateur metalurgists. If they could file a case as the former rather than the latter they almost always did.

I noticed when they made assault by choking a felony as opposed to assault, which is usually a misdemeanor, a shitload of cases were filed as assault by choking. Even in some cases I either prosecuted or defended in which there was no evidence of it and the alleged victim specifically told the officer(s) that she/he wasn't choked.

Like y'all I don't know the merits of this particular charge. Just saying after 34 years of doing this I've noticed some trends

If the fiancé calls the police and tells them X choked her, he is getting arrested regardless of what happened. We don’t know shit until or if more evidence is released.

*and right or wrong, he is guilty in public until proven otherwise

💯 and this appears (at this time with the information we have) to be what happened as they’ve announced he won’t be charged.

This is all true. On the opposite side, women have fabricated domestic violence issues in the past given some slight, usually infidelity but there are other reasons.

As I understand it, the mandatory prosecution is usually tied to prior issues with the same couple. In that case it makes a LOT more sense, imo, as abusers are, more often than not, habitual offenders. The mandatory prosecution is as much a protection for police force resources as they are a protection for the women. Police keep going out to the same place time and time again. Female, despite all evidence never presses charges. It's a frustrating (for police) tax on public service and those are often extremely volatile situations. Not to mention, they often escalate in to more serious offenses including homicide.

So, we don't know shit. Was this a woman who opted not to press charges due to various reasons post, did she even claim she was choked, did the police trump up the charge, did the woman falsely claim abuse to get back at the man for a completely different reason?

We don't. What we do know is offenders are usually habitual. It will raise its ugly head again if that's the reality.

Anything else, is just pure conjecture without further supporting evidence.

I am very happy with my initial take, which is that WR are disproportionately moronic. I think every possible scenario confirms this presumption.

Williamson County District Attorney Shawn Dick told the Statesman that his office declined to charge Worthy after speaking with multiple witnesses but said he will "continue to evaluate the case."

"After further investigation by the Williamson County Sheriff's Office and further discussion with a third-party witness, Mr. Worthy and his attorneys, this case is being declined at this time pending completion of the investigation by the Williamson County Sheriff's Office," Dick told the Statesman. "Mr. Worthy and his lawyers are fully cooperating with this investigation."

3rd party witness probably backed X’s version of events so far.

Yeah, which still leaves a few items in question. First, eye witness testimony is shit, always has been, always will be. Second, is a neutral 3rd party, one of X's good friends, a friend of both parties.

However, when you combine the dropped charges AND eye witness testimony it looks stronger for X. There remains the question, to my knowledge, of where the strangulation aspects came into the case. Was the former accuser the one who brought it into the fold or the police? That's a huge variance and I dont recall seeing the answer.

So... evidence appears on the surface to lean in X's favor, but there is still less we dont know that do.
