Xavier Worthy's lawyers say he asked the complainant "multiple times" to vacate the residence and said she "destroyed a room, scratched Worthy's face and ripped out" some of his hair. They add there is photographic evidence supporting Worthy.

None of which proves he didn’t choke her. If anything it solidifies his state of mind as being angry, as one would be if those things were happening to them.

That message seems to establish motive and, at least tacitly, suggests he put hands on her. I'm not a lawyer but my instinct would be to clam up about this, at least for any public communications.

Instead of pointing out what the fiancé did to deserve it, perhaps a better defense would have been to say that they were into BDSM and she forgot to say the safe word.

Re: lawyer's statements -- as we well know, there are often recantations from the alleged victims of DV. Why not let this sit for a day or two before smearing the victim and making this into a "no going back scenario" where they're tied to their version of the story... unless they know for a fact it's super ugly and she 100% won't recant.

Nonsense.  If a woman is assaulting a man, the man is allowed to defend himself.

Now, a man should never, ever put his hands on a woman unless he absolutely has to.  And he almost never does.  

But the idea that "a man can't hit a woman" is wrong.  If she's hitting you, wrap her up and try to calm her down.  From there, if she bites you or tries to knee the groin, you are well within your legal rights to knock her out.  Being able to run away has nothing to do with anything.

That said, you're still going to have a very difficult time in court, probably, so make sure your woman goes apeshit in front of several impartial witnesses whenever possible.

Responsible adults don't find themselves in situations where they are accused of choking their girlfriend (kinks notwithstanding).  I'm not pronouncing him guilty, but he's a fucking idiot either way.

If the fiancé calls the police and tells them X choked her, he is getting arrested regardless of what happened. We don’t know shit until or if more evidence is released. 
 

*and right or wrong, he is guilty in public until proven otherwise

100% of the time. if the guy is smart he just shuts his mouth and plays along, goes to jail vs arguing / resisting

Retroactive advice like that wouldn’t help him in the moment. Once yall are both in the house and in that moment, lock yourself in a room like a bathroom and make the call.

That's not how it works in Texas. DV means someone goes. If they let him walk away, great, but he doesn't get to stay.

I dunno.  Outright denials are pretty worthless and common among the guilty.

Giving some kind of explanation that won't be contradicted directly by developing facts is probably worthwhile.
