Wait, why was the FBI involved?
Hey, if you are an FBI Supervisor you can choose to visit the FBI field office in Muncie, Indiana, to investigate the interstate meth lab murder, or go to LA with winter approaching and investigate the guy who was supposed to have been given a gun with blanks on a movie set.

I think local authorities seek forensic help from the FBI on a regular basis. The yokel in this town evidently couldn't find the resources to hire the new guy until the FBI didn't give them what they want.

Why the yokels want it is a mystery to me. Maybe a reporter should investigate. Or the FBI as they, I think, can come in to investigate police and prosecution matters.

Curious that the calls to defund the FBI have been quieted lately when it comes to the Baldwin situation.  Suddenly we need more robust investigations with all the resources at the ready. 

I kid, I kid.  I could give a shit about this.  Tragic, unnecessary loss of life.

Both are fourth degree felonies.

“We look forward to our day in court,” Baldwin’s attorneys Luke Nikas and Alex Spiro told CNN in a statement on Friday.

Baldwin’s attorney has previously insisted his client is not guilty.

Involuntary manslaughter charges were dropped against Baldwin last year, with prosecutors saying in a statement at the time that they could not “proceed under the current time constraints and on the facts and evidence turned over by law enforcement in its existing form” due to “new facts” in the case.

Cinematographer Halyna Hutchins was killed and director Joel Souza injured when a gun held by Baldwin fired a live round during a scene rehearsal on the set of the Western.

Baldwin denied pulling the trigger on the weapon in a previous interview with CNN.

The initial decision to drop the involuntary manslaughter charge against Baldwin in April of last year came after authorities learned the gun used in the shooting may have been modified, a law enforcement source told CNN. However, prosecutors said the case could be re-filed at a later date.

In October, prosecutors said “additional facts have come to light that we believe show Mr. Baldwin has criminal culpability in the death of Halyna Hutchins” and signaled a grand jury would decide on recharging the actor.

Armorer Hannah Gutierrez Reed also faces involuntary manslaughter charges in the case. She has pleaded not guilty and is slated for trial in February.

The film’s assistant director, David Halls, was identified as the person who handed the firearm to Baldwin that fateful day. In 2023, he signed a plea agreement “for the charge of negligent use of a deadly weapon,” prosecutors said, noting that terms of the deal include six months of probation.

Attorney Gloria Allred, who is representing Hutchins’ family in a civil lawsuit against Baldwin, responded to Friday’s development in a statement to CNN.

“They continue to seek the truth in our civil lawsuit for them and they also would like there to be accountability in the criminal justice system,” Allred said. “We are looking forward to the criminal trial which will determine if he should be convicted for the untimely death of Halyna.”

Matt Hutchins, cinematographer Halyna Hutchins’ widower, declined to comment when reached via phone by CNN.

Two charges are levied against Baldwin in the indictment, but he could ultimately only be convicted of one.

Should he be convicted, Baldwin could face up to 18 months in prison and a $5,000 fine.

So when do we find out what the new evidence against Baldwin is?

Expert analysis of the gun. Before, it was thought possible that it fired with just the hammer being pulled back, without the trigger being pulled. After different analysis, the expert looked that it couldn’t have fired without the trigger being pulled, which means Baldwin had to pull it.

Note: that’s just the prosecution’s expert. Would be unsurprised if Baldwin gets one to opine the opposite, which would very likely be enough to establish reasonable doubt. A very light plea deal is the only thing that makes sense here, from what I can read.

Yeah I found the description. I mean let's see how it's explained. This is the story as I understand it: They tested the gun and it eventually fired without pulling the trigger but the inspectors said that was because of damage caused to the gun from previous tests. That should have ended this whole thing right there. Then some other experts put this broken gun back together and have concluded there is no way it could have fired. I'm a bit skeptical in how confident you could possibly be in that conclusion given it came from analyzing a broken gun that did fire in previous testing without pulling the trigger however I guess let's hear the details in the trial. It still seems like complete bullshit.

I don't know if he should worry about being convicted, but he should definitely be worried about facing Gloria Allread in the Hutchin's family civil suit. Guess his little PR campaign to finish the movie and pay off the Hutchin's family didn't go so well.

No, I don't.  As I have stated above I feel incredibly sorry for Alec's situation.  Nobody deserves to be harangued like he is in this video, I was surprised he was holding it together because he has generally demonstrated he has a temper.  Ending didn't shock me, but surprised me a bit.

I think Alec is generally an asshole and I don't agree with his politics.  He is a very good actor and I have liked a lot of his performances.

Apologies for not knowing your position better. I agree.

It's difficult to know what that final second means. Did Baldwin just brush aside the phone or physically slap the asshole persecuting him?

I would guess if there was a big physical interaction it would be getting massive coverage(maybe thats coming).

If I was on a jury that was hearing a case about AB and this situation, had he made that person eat the phone, I would vote to acquit.

I must’ve been under a rock, but I did not realize that the trial actually started. I spent a few minutes reading through some articles. I admit I never actually thought this would get to a trial. I actually think he will plea before there is a verdict.

Yes, his trial for involuntary manslaughter has begun. His lawyers have done a good job of making sure he will not face charges as a producer, but only as the shooter, which I believe helps him immensely. I still think he should be found guilty and at least perform community service. It is a very interesting trial, for sure.

I don't believe the Screen Actors Guild sets the ulitmate policy for what an armorer does on set, but I'll listen.

BREAKING: Baldwin 'Rust' Case Tossed Over 'Willful Withholding' Of Evidence

Law360 (July 12, 2024, 1:23 PM EDT) -- Alec Baldwin wept and hugged his attorneys Friday after a New Mexico state judge threw out involuntary manslaughter charges against the actor in the "Rust" shooting case, finding that prosecutors willfully withheld key ammunition evidence from the defense. 

"The late discovery of this evidence during trial has impeded the effective use of evidence in such a way that it has impacted the fundamental fairness of the proceedings," First Judicial Judge Mary Marlow Sommer ruled.  

"The state is highly culpable for its failure to provide this discovery to the defendant," she said.

"There is no way for the court to right this wrong."

Judge Sommer dismissed the case with prejudice, meaning it has been permanently thrown out. 

The claims of misconduct, outlined in a motion filed late Thursday by Baldwin's defense team, derailed what was supposed to be the third day of testimony in the case. 

During a Friday hearing on the motion, outside the presence of the jury, special prosecutor Kari Morrissey voluntarily testified under oath about the withheld evidence, claiming that she had done nothing wrong. 

She also revealed that her fellow prosecutor, Erlinda O. Johnson, had abruptly resigned during the hearing, because she disagreed with the decision to make it public. 

Johnson, Morrissey and Baldwin's defense team did not immediately respond to requests for comment. 

Baldwin's attorneys said they had discovered that law enforcement and prosecutors concealed evidence indicating that "Rust" prop supplier Seth Kenney could have been the source of live rounds that ended up on the film's set.  Kenney denied that allegation while testifying during Friday's motion hearing. He was not charged with any crimes in the case. 

The film's armorer, Hannah Gutierrez-Reed, mistakenly loaded a live round into Baldwin's gun, which fired inside a church on the set in 2021, killing cinematographer Halyna Hutchins. 

Prosecutors alleged during the armorer's trial that she was the source of live rounds, though they had no definitive proof. She was convicted of involuntary manslaughter in March and sentenced to 18 months in prison. She is appealing her conviction. 

Baldwin, who would have faced the same potential sentence if convicted, had contended that the gun misfired without him squeezing the trigger.

According to the motion filed Thursday, the live rounds from Kenney are the same type of ammunition that fired from Baldwin's gun. Part of the state's argument was that Baldwin was criminally liable for Hutchins' death because he was aware that Gutierrez-Reed was a young, inexperienced armorer and there was a "possibility that she brought live rounds on set," Baldwin's motion stated. 

"Evidence that the live rounds came from Kenney is therefore favorable to Baldwin, which is why the state buried it," Baldwin alleged. 

A supplemental report that the Santa Fe County Sheriff's Office made after inventorying the live rounds in question also was never disclosed to Baldwin, according to his motion. 

Baldwin's attorney Luke Nikas of Quinn Emanuel Urquhart & Sullivan LLP described it in court Friday as "critical evidence in this case that was never disclosed to us."

"What we know is we don't have those bullets and they were required to be disclosed so we could put on a case that was fair," Nikas said. 

Morrissey, who denied any wrongdoing, said during the hearing that she had been unaware of the supplemental report on the Kenney ammunition evidence until Friday morning.

"I've never seen these, and I never saw the report," she told Judge Sommer. She also questioned how the defense had learned about the report.

Baldwin alleged in his motion that Troy Teske, a retired police officer, told Morrissey about the live rounds in Kenney's possession during a pretrial interview in November 2023, but she failed to follow up on the information or collect the rounds in question.

Morrissey said during the hearing that she determined, based on images of the Kenney ammunition, that the rounds did not appear to match the round fired from Baldwin's gun or those found on the "Rust" set. 

She testified that she concluded that the ammunition, which was not forensically analyzed, was irrelevant and had no evidentiary value in Baldwin's case. 

"Your honor, there have been no violations of our obligations as prosecutors," Morrissey told Judge Sommer. "This is a wild goose chase."

The state is represented by special prosecutors Kari Morrissey.

Baldwin is represented by Luke Nikas, Alex Spiro, John Bash and Sara C. Clark of Quinn Emanuel Urquhart & Sullivan LLP, and by Heather M. LeBlanc of LeBlanc Law.

She (The Judge) called the state's withholding of this information "intentional and deliberate" and that it came to light so late in the proceedings that it "undermines the defendant's preparation for trial."

"If this conduct does not rise to the level of bad faith, it certainly comes so near to bad faith as to show signs of scorching prejudice,"

I'd like to understand more about one of the prosecutor's resigning in the middle of the trial. The stories I have seen haven't made sense in that regard.
