I always laugh when they try to correlate the arrival of scholarship limits with "the rise of the sleeping giant." Problem is they have no clue whatsoever about the history of scholarship limits or which schools were recruiting the biggest classes before the advent of scholarship limits.

I really can't follow the in's and out's of what makes NIL legal/illegal/unscrupulous.... Is what Aggy did this year, any of those three?

Also, they do realize that the gravy train has to keep rolling, right? Next year, the same athletes who are making money this year will likely want a raise and the next batch of recruits will want even more?

The rules surrounding NIL state that you cannot make financial promises To individual athletes before they are enrolled in the University. You can offer examples of current players an outline what they get but you can’t promise X amount of € to anyone ahead of time. 
 

aggy bragging about offering $48Mill in “NIL” is not even word play, it’s hot bullshit. That’s their total bag cost. And it’s ridiculous

“Rules.” Ha. There are no rules. There are aspirational principles prescribed by an irrelevant organization. To be a rule there would need to be the credible prospect of enforcement.
No one is going to enforce anything anymore, unless Southwest Missouri State happens to transgress the principles. But any SECX3 program?  “Rules” are for suckers. The gloves are off, it’s the Wild West. 
That doesn’t mean aggy will win. It just means they won’t be punished in any meaningful way.

Well, you are accurate as far as how things exist now, but as NIL will constitute a legal fiduciary enterprise, the bag game will now become a concern of the the FBI and IRS in criminal courts as well as civil court as businesses will be able to sue

Yes, that’s going to be fascinating. We’ve all seen how multimillion dollar contracts work out for pro athletes. I can’t imagine that anyone is counseling any of these CFB players on withholding, etc. Does anyone think these guys are gonna bank 30% to pay the taxman?  
 

When the taxman starts coming for even the legitimate NIL stuff, it’s going to get horribly messy.  And the shady bagman stuff like aggy?

I said early on that the schools better educate their players on taxable income. For some who get caught it’s going to be a very rude awakening when the IRS asks for its third of the pie and they don’t have an NFL salary stream or more NIL money to cover it.

But like tips, I’m guessing that this will be one of those areas of unreported income, and the IRS has only so many resources to track this down.

Unless of course these NIL programs are 1099’ing the players. And for programs like aggy, I’m guessing they’re not.

Ags claimed that their super-advanced NIL solution set up LLCs for each and every incoming player that was receiving money.  In that case paper trails would exist.

Except we all know that is a pile of horse-shit, and that the ags just delivered standard issue SEC bags o' cash.

I seriously doubt many of the ag boosters funding their NIL crap are willing to get into criminal liability for tax evasion. The payer is indifferent to whether the recipient pays their taxes. If they payer is transferring money and not reporting the transfer the IRS will catch them. It's just a matter of time.

Some of the NIL providers are being set up as charities.  As we know, properly formed charities can result in significant tax benefits for the donors.  If it is done correctly, the monies a charity grants can also avoid taxation.

So, there is a process.  However, it seems risky...

Disclaimer: not a tax attorney or tax expert, for that matter...

If Aggy or others are dropping bags of cash on folks (5-6 figures), the FBI will eventually say something.  Enough reasonably sized cash withdrawals (even if under $10k CTR limit) will get flagged by the bank's anti-money laundering protocols.  Even if they had 1000 folks drop $5000 for the "pool," flags would be raised eventually.  How do they store/protect the money?  (Walter White might know.). Even if it is well orchestrated (multiple pools), there will still be issues.  Previously lower income, lower wealth folks with pockets full of cash will eventually raise eyebrows.  Do you give a guy $100k and ask that he only spend $600 per day - to keep a low profile?

The IRS and FBI want to eliminate all cash transactions.  It makes their jobs/lives easier - they can track everything.  I see them going after the bag-men operations before properly established NIL entities.

Especially since they probably used more than their usual bagmen this time. New ones who didn't understand the ins and outs of the NIL any better than the rest of us, so they plan on reporting it properly to the IRS.

Jimbo threatening the SEC teams to shut up and stop drawing attention to aggy or aggy would blow up everybody else's recruiting practices, had to draw plenty of unwanted attention from more than just the NCAA. Uncle Sam will want his money and Uncle Sam will get his money.

BRYAN, Texas (KBTX) - A former Texas A&M student has been sentenced to seven years in prison for a sexual assault.

According to the Brazos County District Attorney’s Office, Jacob Pape, 26, was convicted by a jury last Friday night. Prosecutors say he was on trial for one case, but there are several other survivors who have filed assault reports with police. The three survivors have been identified by the district attorney’s office as Survivor #1, Survivor #2 and Survivor #3.

According to the district attorney’s office, on July 8, 2017, Survivor #1 agreed to go on a date with Pape in College Station. He was a member of the Brothers Under Christ (BYX) Christian Fraternity and was on weekend leave from working a Christian camp. During the date they returned to Survivor #1′s apartment where Pape sexually assaulted her. After assaulting her, Pape said they “needed to pray about their sin of premarital sex and told Survivor #1 that she was obliged to forgive him.”

On Sept. 1, 2017, Survivor #2 agreed to go on a date with Pape. He gave her a glass of wine, but after drinking it Survivor #2 could no longer walk. Pape then took her to his home where he sexually assaulted her. Afterwards, Pape called her roommates to come pick her up. Survivor #2 was in and out of consciousness when her roommates arrived, but she was able to tell them she had been sexually assaulted. They took her to Baylor Scott & White where she received a sexual assault exam.

Survivor #2 did not initially report the assault to police, something not unusual in these cases, because she wanted to believe it was a mistake. As a result her kit was not processed by the crime lab.

According to the district attorney’s office Pape’s roommates and fellow members of Brothers Under Christ, became suspicious of his behavior and confronted him after hearing of Survivor #2′s allegations. Pape told them he continued to assault Survivor #2 while she was unconscious.

In the spring of 2018, Breakaway Ministries held a sermon on sexual assault that ended with the minister encouraging survivors of sexual violence to reach out and tell someone. After seeing the sermon, Survivor #1 reached out to a roommate of Pape’s to report her sexual assault.

During the punishment phase of the trial, the jury heard that a third survivor was sexually assaulted on Aug. 14, 2017. Survivor #3 agreed to a movie date at Pape’s house after texting for a few months. After Pape gave her one glass of wine, Survivor #3 began to feel “super intoxicated.” Pape then took her to his bedroom where he sexually assaulted her. Afterward, Pape convinced Survivor #3 that the sexual assault was due to “her behavior and it caused him to stumble.”

These women later reported their assaults to Texas A&M and Pape was expelled as a result of these assaults.

“The Brazos County DA’s Office would like to thank Texas A&M University, Breakaway Ministries, the former roommates of the Defendant, and the brave survivors who testified about this defendant and the brave survivors who helped bring this defendant to justice,” the DA’s Office said in a statement.

“The jury’s verdict is a monumental step forward in protecting women in this community from sexual violence,” said First Assistant District Attorney Brian Baker and Assistant District Attorney Jessica Escue.

I thought the ags had the magic formula for success in college sports-to use A&M’s unlimited wealth to build outrageously overpriced facilities, spend even more to buy a coach who had won a championship at another school, spend yet even more to buy players and “bingo,” unlimited success. 

I’m shocked they aren’t also employing this brilliant strategy in other sports.
