Dan Davis represented a construction company in a case against a provider of hoisting services that resulted from an incident during the construction of the Texas A & M University Reed Arena. His client was engaged to erect huge steel trusses for the superstructure of the Arena on the Texas A & M University campus in College Station, Texas.

In October 1996, during the course of erecting a 160-foot long, approximately 170,000-pound truss structure, a crane lifting the structure dropped its end. The client, with one of their cranes and operators, along with a crane and operator leased from the defendant, was conducting this operation. The defendant's operator dropped his load from 80-feet in the air, causing enormous destruction to the structure below.

As a result, many parties on the project sued for damages sustained to the structure. The client was able to settle most of those claims with insurance dollars from the various parties. However, the defendant continually and steadfastly refused responsibility for the destruction of the client's crane and property sustained in the incident. The defendant engaged engineering consultants who theorized that the malfeasance was the result of poor planning on the client's behalf, rather than the operator's misconduct. It was claimed that the client had miscalculated the weight of the equipment involved, resulting in a lift that was doomed to fail. In trial, the defendant sought to justify the conduct of their operator.

After approximately two weeks of testimony, the case was submitted on theories of negligence, breach of contract, and breach of warranty of good and workmanlike performance under the Deceptive Trade Practices Act (DTPA.) The jury responded with a 100% negligence finding against the defendant, finding that they failed to perform in a good and workmanlike fashion and did so knowingly. A verdict was rendered in favor of Dan Davis' client for $650,000 in property damages and lost profits, and $600,000 in attorneys' fees. The jury also awarded additional damages of $5,000,000.

I went into the Surly Horns office today and just sat at my old desk. They called security and escorted me out. All those insufferably  young Surly bros were chanting, "bye bye, old, bye bye." It was really, really painful. We walked right by @immamac who pretended not to know me. Now, @Dennis Taylor, are you finally happy? Does this make you finally happy?

The Aggies are going to be incredibly hyped up. The players will be raging, the fans will be frothing, their cadets will be shoveling shit into the Longhorn band, the Ags will have been crying for two weeks about the 12 kids that died when their bonfire collapsed, making sure that everyone knows they believe they deserve a win. 

And Texas will win by two scores.

A&M will be lucky to be 5-6 when they face us.  The roller coaster will have taken its toll, although earlier than usual.

I'm not a huge fan of betting games months in the future, but this one is tempting. As a comparison, they have us  -16.5 at arky a couple of weeks earlier.

In that light, it appears that we make it blend into the jersey a little better by not making the letters so white like they are on the Aggie jersey. Or maybe it's just that the contrast with the colors is different.

According to the Aggies, it's a magic patch that makes you SEC good the second it gets sewn on. We now can lay claim to all of the SEC success in the past as though we were part of it.

I've forgotten yet again who on this site quipped that the Aggies shouild wear an SEC uniform with an A&M patch. The person usually shows up to identify himself. He should. I still laugh at the line.

At some point, when someone keeps assuring you they’re potty trained and then shits on your shoes, yet again, you realize they’re completely detached from reality.

And that somehow magically makes aggy better in spite of changing coaches and losing tons of players to the portal. Failing in the SEC is better than winning the Big 12 you stupid sip.

How can anyone even know that? That is like asking for eyewitnesses to their lone national championship. Or people who have survived an aggy wooden construction project.

I believe they have won 4 games total in 7 appearances.  Which gives them a - checks notes - a sterling .0222 winning percentage in Omaha.  Sterling, I say.
