I have an employee who is having a tough time getting along with everyone else at our workplace. He is extremely unhappy but is really bringing on himself. Anyway, if he wants to claim unemployment after giving his 2 week notice, what options does he have? He cant be off work for any considerable time and make his rent. Is this a difficult thing to get, claiming unemployment after you quit a job? What would help his case (like starting an HR case for work environment issues)? Is it next to impossible to get unemployment unless you are laid off in Texas? Or will a note from me do, as they say, and it is quite easy to get and nothing to worry about?

 

I do want to help the guy but its becoming a real issue with both him and most of the other employees.

Not a lawyer either, and typically am on the receiving end of resignations.  HR treats a written resignation like a "Get out of jail free" card, with regard to unemployment cases.

Help your employees who want to be there.

Your heart is in a good place, but I think you should be helping him acclimate better or suggesting others companies/jobs where he might fit in better. You are doing him no favors long term by getting him on unemployment.

I would fire your employee. It sounds like you don’t want him there, but you want what’s best for him. A severance + unemployment could give him a chance to start over. If you fire him, please work with your HR so they don’t contest his unemployment claim. 
 

He 1000% won’t get unemployment if he resigns.

If you're fired for cause and the employer has any kind of documentation at all, the fired employee ain't gonna get shit.

This is actually a good idea. I think I could only afford to pay 30 days on a deal like that though.

Unemployment claims reduce an employer’s UI balance usually resulting in an increasing tax rate in future years to replenish it to benchmark levels. In other words, firing vs allowing him to quit costs your company money.
