Really?  Based on the arrest alone?

What if it turns out that nothing actually happened that he's being accused of (long shot, I admit).  I mean this is a heated domestic dispute and the APD we are talking about.

Hypothetically, if UT fires him tomorrow and in a few days it is proven he never choked her or hit her or the like, then UT is up the legal shit creek with not much of a paddle at that point, aren't they?

There's no reason UT has to rush this...none whatsoever.  They need to make sure they have all their i's dotted and t's crossed.  And they will.

Stop with the wishful thinking. Get in tune with reality.

I have been on cloud nine his whole tenure up to now. I loved the whole idea of Chris Beard, a UT grad and an elite coach who really loves Austin and Texas. Him showing up at the Baseball game was a thrill (if Sark wants my unwavering support he can make an appearance or two next year). And I loved last year's team and I was so hyped for this season. I love the Moody Center and had such an amazing time taking my son to see the Horns play last Saturday. I was certain we were about to embark on an era of glory with multiple Final Four appearances and conference titles and maybe even a national title. And yeah it feels like we went from heaven to hell in a blink of an eye.

I am so pissed off man. What a fucking terrible thing.

The Garrido DWI is the last time I can recall something even remotely like this and at least in that situation nobody allegedly got hurt.

There's the story (maybe more) of Frank Erwin getting pulled over for drunk driving, and upon finding out who it was, got a police escort home and nothing made of it. That was Frank's influence back then, so it was told.

Bev Kearney filed a wrongful termination lawsuit against the school, and UT was forced to pay $600k.

If Beard is fired, his agent/lawyers will file a lawsuit against the school, no matter what.

That was a discrimination lawsuit. This would, at most, be a breach of contract lawsuit. I'm not seeing why sovereign immunity wouldn't apply.

It is fairly standard to meet a firing with a lawsuit.

Kearney had some disparate treatment claims going on with Major, OFN and whatnot that might have beaten summary judgment.

Beard probably wouldn't have a leg to stand on if there aren't some DV violence incidents covered.

Once they are called for a domestic issue, doesn't someone have to be arrested or am I making that up?

I'm not an attorney but, as I understand it, though Texas does not have a "mandatory arrest" policy, many jurisidictions follow that guidance. I believe that APD does follow that.

My neighbor put his on the top right of his windshield like a totally regarded person.  I assume that's actually illegal but am too lazy to check.

The path forward, at least in the near term, is obvious.  Suspend Beard with pay.  Do not allow him on the premises.  Take further action this week pending investigation.  That said, anyone who thinks we can't fire him an hour ago is an idiot -- the only thing at risk is the rest of his contract money.  I'm fairly certain the powers that be value that money, but they also value UT's reputation, and at some point I fully expect they will can his ass and weather the rest of the storm in civil court.

guys, it takes a little bit of time for admin/university to do its due diligence, review employment contract with attys to ensure no wrongful termination claims can arise, nothing else civil/contract related, corroborate the story, talk to chris, etc...

but the action will be swift.  he's absolutely done.

Can he be uh-arrested?

Some are having difficulty with the risk management side of this equation. There is no risk with suspending him pending a thorough review and then dismissing him outright for beach of contract or eliciting a resignation for pennies on the dollar.  There is a process in place and not following that process leaves room for an argument to the contrary.  However baseless a wrongful termination suit might be, there is risk involved with litigating this, and in a public forum.

Anyone remember how long Bev Kearney's matter dragged out and how embarrassing that was? That suit was foundering until she was able to leverage Applewhite's indiscretions into an argument that eventually cost UT $600K and plenty more than that in attorneys' fees and expenses. Do a cost/benefit analysis. Do you want to litigate this with Beard, however frivolous, and roll the dice on what turns up in discovery, or bide your time and make this go away quietly, and if necessary, cheaply?

That's why you've gotta cut ties w/the BSCs.

Just gotta.

I will confess to having dated a BSC way back in the day.  She was so smoking hawt that people would assume that we weren't dating when we went out.

But I had no money then.  If I had been making $5M/yr, we wouldn't have been in the same zip code.

Well that's what I want. So if everybody agrees then what are we talking about here?

In any case I was very upset to see UT's name in the national news for this kind of thing. So I may have been a little pissed off.

Sounds like you have anger issues.  Tried to strangle your significant other lately or been accused of it?  Maybe you should be fired!!!!

I'm not saying we have to "get to the bottom of this".  You're not going to wait for the trial.  You just need to give him a chance to explain himself.  There is a slight chance he's got an exculpatory story, and that may lead to some hard decisions on UT's part.  I think we just need to get him into the office after he posts bail and have this simple exchange:

Dennis Taylor UT:  Answer! Did you threaten this customer fiancee or use profanity in any way?

Brad Beard:  Yes

Dennis Taylor UT:  You're fired.

Coincidentally (or maybe not), big hairy pussy was a prominent factor in both instances…

Crazy GF in college, one drunk night neighbors called cops and when they got there she tried to fight the female officer and went to jail.

fast forward a few months and add mushrooms, she trashed my place and cops came again.  This time it’s 2 guys, she started bawling and saying “I don’t want to go to jail” so they picked me.

It does happen, but he was charged with a FELONY.  I was never charged and went home the next morning, so I would say there’s a 100% chance he did something bad.

i saw the craziest shit that night…

well i can't speak to how charges work or under what circumstances they get filed but people have been sentenced to death based on fabricated evidence so i wouldn't bet the farm on his guilt yet. doesn't look good but the fact that felony charges were filed isn't conclusive in my book.

From a risk management perspective (and frankly from a business and basketball perspective), suspending him and doing an investigation is the right thing to do. However, it is also true that from a legal perspective the University could fire him right now and there isn't a whole hell of a lot he could do about it.
