One thing I've learned from this thread, is that the way the "impeding breath or circulation thing is worded, next time I dutch oven my wife and forcibly hold the covers over her face, I could feasibly get charged with a 3rd degree felony and possibly assault with a deadly weapon.

What law enforcement folks and criminal defense lawyers have told me about these types of situations:

You’d be amazed at how often these situations occur.

You’d be amazed at how often the accused is guilty as hell.

You’d be amazed at how often the accuser just makes shit up. 

The police just have to do the best they can at the scene and someone is going to get arrested. 

The legal process just sorts it out from there. Often it takes time to sort out what really happened, and sometimes you never do. 

In summary - surly doesn’t know squat, yet.

Not anymore.  Used to be routine charges would be dropped by girlfriends/ spouses/ even Ex's.  I worked as an intern at a large county DA's office one summer in the  early 1990s in the intake section where the victims of domestic abuse would come to drop charge after it had been submitted by the Police to the DA's office.  Unless it was an attempted murder situation,   they often got dropped.    How some of the abuse cases were not listed as attempted murder still puzzles me to this day.   And the number of repeat requests by the same victims was sad too.
