Need help from Surly Community

There is one good thing that may emerge from all of this.  My friend said regardless of the outcome he is going to do everything in his power to make sure what is happening to him doesn’t happen to anybody else.  He has obviously been very naive about a lot of things especially since he has family and friends in law enforcement.

He said the conditions of the county jail were the worst he has ever experienced.  He said the conditions of the county jail were worse than the cells that they detain suspected terrorists in the Middle East.  He said they took his mug shot after they strip searched him.  When he was the most humiliated and angry because the corrections officer kept kicking my friend’s bare ankles with his boots during the strip search, that is when they took his mugshot that is now public record. 

if anything, my buddy has now personally experienced what I’ve been telling him about our criminal justice system.  At the risk of getting too cloak roomy, our criminal justice system is designed to produce criminals not rehabilitate them.  He said there were a few people in his jail cell that couldn’t wait to go back to prison and wanted to skip the pre-trial arraignment.   When everyone found out what he was charged with and this was his first offense he was the one that everyone distanced themselves from.  He was ready to defend himself if he had to, but luckily no one attempted to harm him.

If it was this easy, 4Chan would have tens of thousands or even hundreds of thousands of people across the country sitting in jail, and this kind of stuff would be all over the media.  Valid email address lists are easy to find for free, and places like 4Chan have easy access to all kinds of illegal porn, the servers to store it on, and they have the technical knowledge, free time, and the drive to actually try and pull this kind of shit off.  And the feds would be heavily involved in going after them for a lot of reasons.

I've also had email addresses that go back to the 90s and have never seen anything like this, and I have a whole shitload of technically incompetent relatives who have been on the internet for 20 or more years, who have gotten their identities and financial details stolen many times, and they have plenty of details about their lives out in public (whether it be property purchases or leaving their social media wide open).  Oh, AND they are the kinds of people who get caught up in your typical internet scams, including targeted scams where somebody pretends to be a friend of theirs (perhaps found on Facebook) with some choice personal details, and tells them they desperately need X amount of money but they are too proud to ask publicly, etc., and proceed to scam them out of the money (I've seen this with a few relatives and parents of friends).

None of them are sitting in jail.....well, at least not for clicking on a fucking link in an email.

And going back to the bit about financial scams - anybody who has the knowledge to go through the trouble of setting all of this up to theoretically get a random person on the internet thrown into jail solely for the lulz, is more than likely going to put their effort into financially ripping that person off.  Everybody loves a good laugh, but if something in that chain goes wrong and you get linked somehow, you could be in deep shit, so why put all of that effort into something that won't financially benefit you, and puts your ass in line for federal prison?

@Neonmoon, I work for a software company and work on the business development side.  We have IT security policies and are required to take security awareness training each year since we handle extremely confidential data and have a SaaS platform.  I am somewhat IT savvy but in no way an expert.  I’m knowledgeable enough to at least ask the right questions or suspect what may have happened if my friend’s story is true.

This is the sort of excuse I would use with my parents when I got caught watching porn as a kid - "it was just a virus pop up!" It sounds like your buddy frequents some pretty shady and fringe sites - knowingly so. It's already been said, but stop fucking digging dude and just bring over a casserole and a case of beer if you want to support your friend and believe in his innocence

Agree @Captainant.  there is nothing else that I can do.  I just want to make sure he gets the best defense he can afford.  It is out of my hands and in his attorney’s hands now.  I would think that anybody in my position would do the same thing.  Maybe not post anonymously to a message board full of strangers but I thought it was the best way to quickly get expert opinions and confirm the best course of action for my friend and my wife and I.

Touché @goatsaag.  However, at my company we take data security very seriously.  You can’t pass the training unless you’re paying attention.  If there is a violation of our data security policy, it is a fireable offense.  We handle financial data for some of the biggest companies in the world.  If there is a data breach, because of the immense liability, it would potentially bankrupt the company.  The company I work for is a relatively small company too.

The safeguards of the evidence don't really surprise me.  But, just a few years back, the feds took over and ran a forum or server for several months or years to try to snag all of the "subscribers" or whatever they were.  They got a lot of shit for that, rightfully so.  The big theory behind child pr0n excessive criminality is that each viewing of an image constitutes a further injury to the victim and that the distribution of it creates and furthers the "market" for it.  I'm not sure I 100% buy those rationales, but the feds certainly did their part on that one.  Fuckers.

I see quite a bit of CP cases come through the courthouse but they're all simple possession, as opposed to distribution. Local law enforcement gets notified by ISP that a certain account has downloaded flagged images. Law enforcement gets a warrant, heads to the house and busts the guy.

Based on only seeing the possession cases, I'm assuming Feds (maybe state AG?) handle the distribution and other folks more directly involved.

Pretty damn funny.  But I think you’ve been watching too many lifetime movies.  I can barely devote enough time and attention to my wife.  No way I could have a relationship with two women at the same time and keep it under wraps.  

if there is any advice I can pass along is that everyone should try to live in a rural community for a period of time.  Like I said earlier, it exposes you to some interesting things and interesting people and changes your worldview on things.  Being from a big city and traveling around the world, living in a rural area for a period of time has had the biggest impact on my views.  Believe it or not it has made me more liberal being amongst more conservative people and dealing with the shit that they have to deal with on a daily basis and had to deal with for most of their lives.

Seriously, if this is real and you want to support the guy, the details aren’t your problem. Bring meals over, offer support, watch a game, but don’t talk about the facts of his case.

More importantly, this is how you end up  having to lie to the cops if they come question you, or you end up testifying  against your friend

Seems odd and irrational.  I could see states still handling non-internet and no-proof-of-mailing cases where there isn't the jurisdictional hook.

I’m prepared for that.  I am not lying for my friend under any circumstances.  I’ve already told my friend that if he is lying to me or I am put in a position to have to lie for him and put myself and my family at risk our friendship is over.  It could be a FAFO moment for him.  Time will tell.

OP if you have any optional surgery on the radar that requires general anesthesia, I'd recommend scheduling it asap so you have an easier claim to not having an independent recollection about what you may have seen or heard in the last couple months. And then never speak of it again.

There's still time to take up rugby or wrestling. Driving your car into a tree is risky but you could always just fake it. Use a really shitty car so you don't have to file a fraudulent insurance claim though.

I have an off-road truck and could do something like this and claim I took a wrong turn like in a Chevy chase movie.

The percentage of people charged with possession of child pornography but not found guilty has to be really low.  When you add on the intent to distribute it has to be close to zero.  
 

Maybe I’m being as naive as the OP but it seems like the LEO would not arrest and file charges without the case being a slam dunk.  If OP’s friends story was true and he just clicked on a random link in an unsolicited email then immediately closed the site with no other occurrences it would be near impossible to get a jury to convict.  The prosecutors would not waste the time and money on those type cases.

Based on what I’ve learned, conviction rates are very high especially if the Feds are involved.

I’m sure many of these cases end in plea deals vs. risking a trial.  I suspect most people charged with a crime this will do anything they can to avoid prison to avoid being public enemy #1 in prison.  He may be able to avoid prison time but he will most certainly be put on the sex offender registry for at least 10 years.  No matter what his life will be changed forever.

And like I said, if somebody was going to go through the trouble of picking out randos on the internet, and had the ability to mail them links to a server that would implicate them and contact local law enforcement and get them arrested, then they are far more likely to take that ability and use it to scam my elderly in-laws out of some money.

I'm still not buying the motive at all.  Go through all of that trouble just to get some rando arrested (in a situation where you would be in deep shit if it was traced back to you and then be labeled a sex offender), and then do what?  Tell your friends you did it, and risk somebody ratting you out for reward money?  Or go through all of that trouble to instead make some money, and if you're caught, well you won't be labeled a sex offender and won't be sent to pound-me-in-the-ass penitentiary.

It was either this or joining a “Friends of people that have been charged with downloading kiddie porn support group”.    I may need to start one if they don’t exist.
