We're assuming Trumps lawyers, at this point, passed a bar exam?  I assumed they were appearing pro hac v.d., or something.

To that end, a NY case elaborating on the standards for a change of venue, in the infamous Amadou Diallo cop murder case. https://casetext.com/case/people-v-boss-4

A pretrial change of venue for the purpose of protecting the right of a fair trial is an extraordinary remedy reserved for the rarest of cases. The case of the four police officers accused of murdering Amadou Diallo is that rare case People v. Boss, 261 A.D.2d 1, 2-3 (N.Y. App. Div. 1999)

We conclude that this case has been deluged by a tidal wave of prejudicial publicity to such an extent that even an attempt to select an unbiased jury would be fruitless. The prospective jurors of Bronx County, and the rest of New York City, have been subjected to an endless repetition of the notion that the two undisputed facts, namely that 41 shots were fired and that Mr. Diallo was unarmed, conclusively establish defendants' guilt and are dispositive of all possible factual and legal issues. This idea has been repeatedly stated in the form of quotations from prominent persons, or as editorial comment by publications and their columnists. This opinion as to defendants' guilt is routinely accompanied by assertions that defendants were motivated by racial prejudice. The few voices reminding the pool of prospective jurors of the sacrosanct right of an accused to the presumption of innocence have been drowned out by this incessant drumbeat of prejudicial publicity. People v. Boss, 261 A.D.2d 1, 4 (N.Y. App. Div. 1999).

We are also convinced that this is the rare case where a motion for a change of venue should be granted prior to trial, rather than deferred pending an attempt to select an impartial jury. In our view such an attempt would be a "futile process" People v. Boss, 261 A.D.2d 1, 6 (N.Y. App. Div. 1999).

Given that there are just as many talking heads pro-Trump as anti-, including NY Post, I don't think he's going to be able to meet that burden.  One interesting thing is that the motion is made in the court of appeals not the trial court.

I'm making assumptions based purely on being in Texas too long.  But pretrial motions in criminal cases don't often amount to much and often don't delay the case for long.  The exception to that rule (in Texas) is a pretrial writ of habeas corpus to challenge the constitutionality of a statute.  And that only serves to delay things due to the fact that they can be appealed pre-trial and are likely to sit around on an appellate court's docket for six to eight months (conservative estimate) before an opinion is issued.  And can be appealed upward from there.  I don't know if NY has a similar mechanism pre-trial.

I mean, we're all generalizing based on what we're somewhat familiar with, but I think the general idea is that a criminal case just isn't subject to the interminable delays of a civil case, usually.  Ken Paxton notwithstanding.

There is a provision of NY law specifying what can be appealed permissively and of right, by both the state and the defendant, and the list is short and almost exclusively post-conviction.  One exception is that the state has the right to appeal the dismissal or reduction of charges in an indictment.

The other thing is that because this occurred prior to the election and he's being charged and prosecuted after his term in office, there's almost no opportunity to assert executive privilege or any of the peculiarities of having been POTUS.  Because those things tend to have an immunity from suit as well as a testimonial/evidentiary privilege, they provide for immediate appeal in most cases.

Is that a younger, taller Don Rickles over Trump's right shoulder?

Did nobody stop and look at that mock-up before posting it?  Look at the faces of the people behind him and how creepy they are?  Somebody is fucking with him...they all look like they have bells-palsy.  Never mind that multiple flags on our right/his left are not accurate.

They keep bragging last night/this morning about how he's raised $7mm+ and counting off this arraignment.  I know that's an impressive number to about 2/3rds of his base.  But to the rest of us, it's just a sad indicator of how fucking stupid our country really is.  Fun fact, he also has the least efficient re-election fundraising game in U.S. history.  Not only are you paying money to a "billionaire" to get him back into office, that he'll only use for personal gain and not what you think he'll use it for.  But he also spends more than anyone else on raising money to raise money.  Their efficiency clip is about 40 cents on the dollar.  Most of which, I'm sure still goes back to him and not his fundraising team.  It's a non-stop cycle of grift and with this many loops, you're too far removed to have any hope of ever seeing the original light.

I used to feel rage against this stupidity.  Now I just feel sorry for most of these people.  They've long since circled the drain with him.  Now they're on the underside of the disposal, thinking the shit smell is a bouquet of flowers and thanking Christ for the privilege.  I guess we were always gonna end up here, just a question of how.  Happy Easter everybody, .

Although I think this case is better than I initially thought it was, and may well result in some felony convictions, I do kind of wish the criminality here was more apparent to the layperson and less susceptible to (mis)interpretation.  All of the other known potential cases, 1/6, Georgia, MAL document obstruction, seem to fit that criteria better than this one.

That said, the single most gratifying thing about this, other than watching Trump have to go through it, is that the nation hasn't burned.  And that consideration would seem to be off the table for authorities considering further charges.

It's wild that we are still honoring and protecting norms with the charlatan who accomplished most of his policy wins through destroying norms. It's the sort of power imbalance that enables authoritarianism.

And yet, none of the more clearly criminal behaviors have gotten as far as this white collar prosecution. It's almost like we don't really punish fascist criminal acts in any sort of expedient manner, or something.

Yeah dude he's only been arraigned. No trial, no hearings, very little to be significantly aggrieved of. Yet. I'd argue the true peril is on the business end of the trial process, because that's when the fucking around ends, and the finding out starts.

Okay, what I took away from the news last night is that now we wait until December for the next appearance, and if we're lucky, we'll get a trial next spring, but these charges don't have much teeth, unless Dotard says things that violate State of NY laws around interfering with governmental process, which he probably might, or unless one of his followers goes after the judge he named in his statement, which they very well might, and in either of those cases his charges could go up significantly.

Does that about cover it?

Man, you know I like and appreciate you…your legal opinions are valued, I appreciate your efforts at realistic neutrality and you absolutely helped me at a time when I was really struggling…hell I’ve said I want you with me at parties so I can pull a Billy from Moneyball where I point at you and snap my fingers like he did to Pete so I can get an instant rational take.

However this part here I feel like you’re wasting your brain cells.  There’s 40% of this country that will deny, attack and spew self-righteous outrage at any attempt to portray this ‘man’ as anything but sent from god himself to reign as a holy warrior.

Regardless of priority I feel it’s necessary to prosecute his crimes as the case is ready.  Tiptoeing around for fear of upsetting his base is how we got Jan 6.  Even if both his impeachments were failures, we need them on the historical record.

The "ride" on this, and the other rides he's about to take, should be glorious in and of themselves.

Catching up on the thread. Great fun. Thanks go to the analysts such as TwiceHorn. I don't get why people sharing a learned opinion attract antagonism. Maybe their right, maybe their not; the opinions never seem personal.

Reading the above and agreeing with it, my mind drifted to aspects outside of the courtroom: his radical followers.

If indictments pile up, what happens in a world where leading elected GOPs are claiming, in their usual projectionist way, that the ebil Dems are weaponizing the federal government? What happens with the constant braying from Trump himself calling for violence by predicting violence?

Where do the stochastists strike? Whom have they been told is the enemy? The more organized Christian white nationalists will not try another public takeover.

In a good old banana republic, every revolutionary knows that you takeover the radio stations and kill the prominent opposition leaders. If you lay on two more indictments from federal and state prosecutors, the narrative of weaponized government and dangerous radical socialist Democrats seems to be fulfillment of the Scriptures.

God, country, Donald, the children! need me!
