And that order was unconstitutional almost without doubt and anyone imprisoned under it could commence lengthy litigation to so establish, likely being freed along the way.

So today’s traitors can regain their freedom 20 years from now.  What’s the downside in this specific case?

Im not advocating suspending HC, but speed the fuck up people.

Is there nothing like "failure to render aid", when the POTUS sends a mob to the capitol, and then refuses to offer assistance (because he is in league with the mob) while it and all of our elected leaders are under attack? How on earth is that not criminal?

Yea but Lincoln also had an actual honest-to-goodness shooting war going on at that point AND all he had out there information wise was word of mouth and newspapers that most people didn't get.

What Trump and his army, acting at his behest and functionally under his command did is only partly criminal. The individuals who actually trespassed assaulted cops, etc, committed some crimes.

But what was done as a whole was not a criminal endeavor…it was a rebellion.

And Lincoln DEFINITELY showed us how to deal with a rebellion: you kill the fuck out of the rebels. You shoot them and keep shooting them until their bodies fill the field. He didn’t try to arrest them. He didn’t bring them up on charges. He sent the forces of the United States to kill rebels. It was the right thing to do then, we should have done it again on January 6, and we should do it if they ever try it again. Mow them down. Shoot them as they panic and run. Just like we did at Gettysburg.

You don’t arrest traitors actively committing rebellion.. You kill them. Don’t treat it like a criminal justice problem, because that’s not what it is.

It's just fucking insane that apparently our options are either "suspend habeas corpus" or "let trump repeatedly abuse the justice system with unchecked lies". What the fucking fuck? It's like y'all have this weird blind spot that makes you think trump is always acting in good faith when he NEVER fucking has

Link to someone asserting that Trump is always acting in good faith?

My problem with this, specifically with January 6th, is WE ALL SAW HIM COMMIT THE OFFENSE IN REAL TIME.  Oh, maybe he didn't mean for them to storm the Capitol?  YES HE DID.  WE ALL WATCHED IT.

And what you saw isn't a crime until a court says it is. That's what y'all seem to not understand. In your mind, he's guilty, and you're playing judge, jury, and executioner. But we don't do these things that way here and for very good reasons. And if you even give the appearance of doing so, you hand-deliver to Trump everything he wants.

You're trying to make this simpler than it really is and very conveniently forgetting some very important things. And by doing so, you are being the very authoritarians you are accusing Trump of being.

We don't get to stop playing by the rules just because they stop. Otherwise, we're hypocrites, full of shit, and deserve to lose.

Well in some cases, the crimes are obvious.  But at least to a lawdog, what was televised on J6 wasn't necessarily a crime.  We know that "incitement to riot or violence" isn't really a thing unless it's pretty explicit.

Even if it's obvious, due process is a real thing. We have it for a reason. And in this case, we have to be very very careful to show that we're going through all the right steps in the right way, because even one tiny misstep will give the bastards all the political ammo in the world.

Counterpoint: we sure as fuck did stop “playing by the rules” the last rebellion these fuckers tried. There weren’t any cops telling suspects to stand down at Gettysburg. We weren’t there to make arrests. We didn’t put them on trial. We shot them dead. Thousands of them. We didn’t stop shooting until they either surrendered or fled the battlefield.

Because see, while these fuckers opted out of ONE set of rules (law, evidence-based litigation, etc), they opted INTO another set of rules: you engage in violent rebellion against the country, then you fucking die. There are only two sets of rules: rule of law or rule of the gun. They chose the second. We should have engaged in their chosen game. Until our rifle barrels melted down.

Yeah, I use him as a punchline more than I should because Gallagher is dead and Carrot Top is so obscure now.  But the few comics I know that know him reiterate the same thing your friend said.  He's actually super nice in real life, does a lot of charitable work, and isn't exactly 'smart', but is much more intelligent than his 'character.'  They all like him.  It's his audience, which he panders down to for money (which I get), I guess that I am ostensibly referring to when I use his name as a dig.  I should stop that. I guess it's just a lazy placeholder on my part.

equal csb/ A comic friend of mine, Gary Gulman who helped me acknowledge some shit I needed to work on personally when he was coming out a rough patch himself.  Gary is one of the smartest comics I've ever met, probably the smartest.    Probably one of the most intelligent of all time.  I mean, he could have done anything.  I know a lot of smart people, a lot.  In all walks of life.  And Gary blows me away, but he went into comedy instead of something more high paying because it was a way for him to work his shit out (as many comics do).  But he operates on a such a level that his material isn't as popular as it could be because of how obscure and high level it is.  It's not quite Carlin-esque, but it's close.  Anyway, he tells me that Larry is, as you say, smarter than he seems.  He's disappointed that Larry dumbs it down for his audience but he gives him full credit because a lot of the money that he has earned off the Stupids, Larry turns around and does a great deal of good with it.  He's a conduit for the greater good in that sense.

To tie it back to this thread, Gary used to do some political humor.  Not much, but some.  I asked him, just once (I don't like to get into their stylings), about why he wasn't taking advantage of all this Trump insanity to incorporate into his act.  And he had a legitimate point.  He said there's basically nothint there.  The absurdity speaks for itself.  There's really no room for commentary.  And he told me about a guy he met, an improv player, who had a really good Trump parody that just got hired my SNL.  And he said, "He's basically just gonna go Trump straight unlike Baldwin's goofy cartoon."  A year later, James Austin Johnson launched his impression and we went in Uncanny Valley.  Gary telegraphed it correctly.

??? The only thing my comment was directed to was the speed with which SCOTUS took up the Colorado 14th amendment case.

if he wins because of clearly illegal manipulation of the system, that is one thing.

If he wins because the majority of the voting populous is so stupid they will vote for him no matter what the truth - or the clear lies and hate pouring out of his mouth - then the reason would be “democracy”.

if the latter, then people opposing that election would be the insurrectionists.

it is certainly a more than worrisome dilemma.  However, the easier response above is often worse for everybody.  Following the rule of law despite the public says we should ignore it just this one time is a sound way to go.

Having said that, If the election result is not attributed to democracy, but to Trump’s clear illegality, corruption and manipulation of the system, then there is a good faith argument for a different response.

Trump selling his Vegas hotel to pay legal bills?

https://www.reviewjournal.com/business/tourism/officials-mum-about-potential-sale-of-las-vegas-trump-hotel-3029352/

I especially like the quote from Tweedle-Dumb (Eric) in this story.

Quote

Could the nongaming Trump International Hotel just off the Strip be sold to generate revenue for Republican presidential candidate Donald Trump’s enormous civil fraud penalties?

The people closest to the property’s ownership — Trump and business partner Phil Ruffin — aren’t saying, and lodging industry experts say they haven’t heard anything about a potential sale of the 64-story, 1,282-suite property, which opened in 2008.

Ruffin also is the owner of the Treasure Island and Circus Circus hotel-casinos.

The Associated Press in February reported that New York Attorney General Letitia James said she would attempt to seize Trump properties to pay the $454 million civil fraud penalty that, with interest, is escalating by an estimated $87,502 a day.

Trump was assessed the fine following a Feb. 16 ruling by Manhattan Supreme Court Judge Arthur Engoron. In January, a jury also ordered Trump to pay an $83.3 million judgment for defaming writer E. Jean Carroll. Trump has denied wrongdoing and vows to appeal.

Whether James, a Democrat, would attempt to seize Trump International in Las Vegas is unclear.

Clark County records show the parcel is owned by Trump Ruffin Tower I LLC.

Contacted Friday, a representative for Ruffin said he would have no comment on the matter, and Trump hotel officials did not return calls seeking comment.

Trump and Ruffin struck up a friendship when they partnered to build the tower, initially targeted as a condominium high-rise. When condo sales flagged in the run-up to the Great Recession, the Trump Organization changed strategies and brought in Hilton Grand Vacations to take some of the suites as timeshare units. Some suites also were made available as hotel rooms.

Because of the plan to develop residences, the Trump Organization opted not to put a casino in the property.

At the time, Eric Trump, a son of Donald Trump and one of the top local executives, explained the unusual strategy of having a Strip property without a casino.

“We have no problem getting a gaming license, but we wanted to do something different here,” Eric Trump said “We wanted a true luxury resort experience. It’s hard to have a high-quality product when you walk into ‘ding, ding, ding’ and there are people walking around in Hawaiian shirts with big plastic drink mugs.”

Trump and Ruffin planned building a second nearly-identical tower at the site, but those plans fell through as the recession hit.

The local Trump hotel has two restaurants and a pool deck. In addition to opting against adding a casino, developers decided to have small meeting rooms instead of a convention center.

Holy shit, I can't wait to see this negotiation.

"We don't have people walking around in Hawaiian shirts with big plastic drink mugs, so we're doing to insist upon a premium. We'll even throw in Eric and some dessert and t-shirts for the kids."

-Ah well, nevertheless.

I honestly don't know what's going to be studied more for the next century---his utter and complete business idiocy or his political rise to ascension.  You could literally craft a 60-credit hour program around the two.  Never mind getting into the shit his kids have been up to.  We will not live to see it unpacked, but it will be...

The latter is the rub. There needs to be some sort of ruling to appeal. Currently, there isn't one.

A motion in limine is usually filed on the eve of trial but there is nothing that says it has to be. They are also usually evidentiary in nature, while this one would be more to resolve something as a matter of law (PRA does not apply here).

But I think her denial of one would give Smith the ruling he needs.

I may, or may not be under the influence of herbal medication, but is there a way you could present some sort of bastardize motion to suppress/ with the thing you want to suppress the use of the improper presidential records, act defense?

Then you file a motion in limine on essentially the same subject.   It seems like she would quickly bite on denying the motion to suppress.   In Louisiana practice, a court will look at whatever counsel calls it and disregard that if need be - and look at the substance of the request and redesignate the motion to the proper procedural vehicle.   if we don’t know what the hell to call it, then file it and call it something else and let the appeals court decide what to do with it.

Ruffin (the owner of Circus Circus) is, among other things, Trump's friend of sorts.  Trump served as his best man at his wedding in 2008 (he was 72 at the time, and married a former Miss Ukraine who was 26 at the time).  He also bailed out Trump from his failed Trump University suit.  Trump owed $25 million, and Ruffin paid the tab.   The two have an intertwined past.

Ruffin is a piece of shit.  But he's far more successful in business than Trump ever dreamed of, and isn't leveraged to the hilt.

Trump served as best man to his financial benefactor who married a Ukraine national beauty queen who Trump wants to let Russia stomp all over her country after he admitted to walking on in on beauty pageant dressing rooms and the owns a Circus themed casino and Trump is a literal Circus Clown.  What in the fucking fuck is happening anymore?

Eric and Lara are basically glorified carnival barkers and Don, jr. can do enough blow in one sitting to kill a circus bear.  Guess I'm going to church tomorrow to convince myself none of this is real...

With that said, it’s beautiful that he asked those people to show up, they do, they start shit, they get prison sentences, felony records, lose businesses, jobs, family members, and Trump rakes in hundreds of millions in donations but won’t donate any of it to pay their legal bills, and he won’t even do a massive fundraiser.

He just let’s them sit in prison or rack up debts from legal bills and lost jobs while he rides off with all of the money.

As much as I hate Trump, I love that he completely fucked over his MAGA followers in the wake of January 6th.

Yeah, it is kind of his master-stroke to use them to make money with the promise that he'll use that money to help them and then not use that money for them but to help himself defend himself for the very criminal allegations he's under, which put them behind bars in the first place.  You gotta kinda tip your (red) cap to the 'inception' level layer-ness of it all.  Many, if not most, of them will have tainted records and be unable to get gainful employment or loans for decades while he's literally on a golf course sand trap earning 20%.

I mean, he's totally fucked financially in the long run and we will dead soon.  But these people are truly proper fucked.  Their grandkids will feel the strain of this, it's that bad in many instances.  They should have asked for bullets to the head that day because their suffering will echo for generations.

He does a very entertaining interview (don't know the radio show, but you can find it easily I'm sure) about the background of the bit.  He told me how he sat on the whole bit, almost verbatim as it was delivered on latenight for several years.  It was so quirky that he didn't think it would work...even in a nightclub of drunks.  And this is when all these niche documentaries start coming out on streaming.  And one was literally about the history of some Font so he thought he could feign the documentary angle of the process of the abbreviations.  And then he's coming out of his mental health issues (or least, making big improvements).  And to work it out, he basically felt "If ever I needed to do this weird bit, now is the time."   Not my place to say, but I think it was a sort of internal challenge to himself to let his weirdness out as he was healing from issues and on meds 'n shit.

But the true beauty of it, which explains Gary's improvement to a more content place in life.  Is it starts out as an absolutely absurd premise as it did when he wrote it, something as twisted that only he could come up with in a dark place.  Then it gets silly and playful as Gary is oftentimes with the Dottie bits.  But when the pretend abbreviators get the contractor and he goes on the smart string of jokes about the different words...that's when you can see he's back to his sharp, confident self.  It's really cool to watch when you know his backstory.  Watch "The Great Depresh" whenever you can. It's half documentary and half standup.  And we laughed about how mental health and football concussion protocol were basically one in the same when we grew up.  But again, it's so layered and clever that it's not belly-aching funny...but it's so fucking funny to me while being so sad and a reminder of what we go through as people.  But you can literally feel in your bones how cathartic the release is for him and we kinda feel the same way watching/listening.

So to tie it back to the thread...i picture Donald Trump watching the bit and thinking, "Well, in my first 100 days back in office ...I'll fire that Postal committee, bang Dotty, get an omelette with extra ketchup, and change UT back to Uta to fuck with Mitt Romney."
