Hillary would have won but for Comey’s eleven day surprise. She got 3 million more votes than Trump. That kind of thing matters in every democracy but ours.

I know this seems like an obvious thing to have, but in reality the reason convicted felons aren't banned from office is to take away the incentive for an incumbent president to politically attack his challengers with false imprisonment to remove them from challenging him. It is the right call and the constitutional authors understood that.

I seriously doubt there is a law prohibiting that. There isn’t one in Texas.

There MIGHT be a standard condition of probation that would include that restriction though. In Texas, the language refers to “persons of bad reputation of character.”
I’ve never seen that enforced ever though, except MAYBE in a scenario where two felons are wanting to be roommates.

CSB- An old business partner of my fathers was a hit man in the mafia for 2 of the NY families.  He went to prison and when he was out on probation he was sitting in Central Park and a known mafia person jogged by him and said hello.  The feds got a picture of that and put him back in prison for associating with a known criminal.  Maybe that is federal level versus state level rules?

NPR had a former prosecutor on a few days ago. He said a fairly compelling argument could be made that the law cited to turn the misdemeanors into felonies was a tenuous connection at best. NPR is not wont to give airtime to shills, so I assume the guy was legit.
 

I was only partly paying attention. I don’t know if he was saying that was the tack trump’s lawyers should have taken with their case to the jury, or if it is a potential avenue for appeal

Yes, this is the most controversial part of the case and the fact that federal prosecutors chose not to prosecute the election fraud charges the state of New York leveraged. But the tactic his lawyers should have taken was that he paid off Daniels because of the harm that it would cause his family and marriage. But Trump only knows one way.

The most fertile ground for appeal, I think, is that jurors were given a choice of "predicate" offenses and were not instructed to agree on which one it was.  See Jury Instructions, starting at page 28.  https://www.nycourts.gov/LegacyPDFS/press/PDFs/People v. DJT Jury Instructions and Charges FINAL 5-23-24.pdf  Specifically:

Although you must conclude unanimously that the defendant conspired to promote or prevent the election of any person to a public office by unlawful means, you need not be unanimous as to what those unlawful means were. In determining whether the defendant conspired to promote or prevent the election of any person to a public office by unlawful means, you may consider the following unlawful means: (1) violations of the Federal Election Campaign Act otherwise known as FECA; (2) the falsification of other business records; or (3) violation of tax laws.

The choice stems from the fact that the actual "another crime" is NEW YORK ELECTION LAW § 17-152, which is as follows:

Any two or more persons who conspire to promote or prevent the election of any person to a public office by unlawful means and which conspiracy is acted upon by one or more of the parties thereto, shall be guilty of a misdemeanor.

The predicates 1, 2, and 3 are unlawful means.  So we have a triple nesting of statutes here.

That could potentially be a legal error that results in remand for a new trial.  It is about the only aspect of the case and jury instructions that wasn't well-settled in NY law, at least as far as I know or can tell from reportage etc.

People are doing a lot of spewing about evidentiary rulings, letting Stormy Daniels and Access Hollywood stuff in, keeping Trump's legal expert out.  I don't think those are going anywhere.

But yeah, this fucking guy.  He's never gonna see the inside of a cell.  But good news is, you can tell from the last couple of weeks...his body is eating itself from the inside.  And it's wonderful.

Its time for the Dems to play by Pub rules.  Schumer needs to bring a string of laws up for vote regarding felons.  One proposal every week till November. Make pubs vote against proposals regarding  crime and felons in government.
1.  Proposal to make it illegal for felons to obtain security clearance at any level.
2.  Proposal to ban felons from serving  at any level in an administration or congress.
3.  Proposal to ban felons from being on Air Force 1, Marine 1, or any government vehicles unless handcuffed.
4.  Drug test and full body cavity search each time a felon attempts to enter White House.
