“People will be particularly concerned about accessing controversial speech when the state government can log and track that access,” Ezra wrote. “By verifying information through government identification, the law will allow the government to peer into the most intimate and personal aspects of people’s lives.”

Judge was on the ball on this one

Ezra said Texas has a legitimate goal of protecting children from online sexual material, but noted other measures, including blocking and filtering software, exist.

“These methods are more effective and less restrictive in terms of protecting minors from adult content,” Ezra wrote.

The judge also found the law unconstitutionally compels speech by requiring adult sites to post health warnings they dispute — that pornography is addictive, impairs mental development and increases the demand for prostitution, child exploitation and child sexual abuse images.

“The disclosures state scientific findings as a matter of fact, when in reality, they range from heavily contested to unsupported by the evidence,” Ezra wrote.

Chugging through other courts:

The Texas law carried fines of up to $10,000 per violation that could be raised to up to $250,000 per violation by a minor.

The Utah law was upheld by a federal judge who last month rejected a lawsuit challenging it.

Arkansas' law, which would have required parental consent for children to create new social media accounts, was struck down by a federal judge Thursday and a lawsuit challenging the Louisiana law is pending.

No, the department of Texas Health and Human Services did not actually study pornography or develop any findings that porn causes mental illness or increases prostitution, etc.

Anyway, with the court rejecting it, we figured there would be some time for it to go through the usual appeals process.

But we did not count on good ol’ 5th Circuit Judge Andy Oldham.  Because a three judge panel that includes Oldham reinstated the law, putting an “administrative stay” on the preliminary injunction that blocked the law in the first place. Once again, the ruling gives no details at all. It’s two sentences this time (up from one the last time), and just effectively removes the preliminary injunction, meaning that the law is immediately in effect. The only difference from last year’s similar nonsense is that the court says the appeal is “expedited” to the next available oral argument panel.

Sorry, I don't think you read the whole article. The top part talks about last year tomfoolery, the bottom half talks about the new stay on the injunction that was issued days ago.

 

Earlier this year, Texas passed a law requiring both age verification and a mandatory “health warning” message on all adult content websites. The Free Speech Coalition sued to stop the law going into effect (as it was scheduled to do on September 1st) and, as we reported, the court reasonably granted the injunction blocking the law, noting that it was pretty clearly a violation of the 1st Amendment for both the age verification bits and for the mandatory health warning, which forces adult websites to say that “Texas Health and Human Services” has claimed that pornography leads to eating disorders, impaired brain development and an increase in demand for child exploitation even though, as the judge blocking the law noted, Texas Health and Human Service’s department never found any such thing.
 

As the court clearly notes “this is compelled speech.”

It's illegal to sell/distribute dildos in Texas period.  To a party of men, women, aliens, dogs or cats, or to just one.  But the best part is, if you possess more than six dildos there is a presumption of intent to distribute.

That's right.  That's why my practice is, when we are going to upgrade one of our current dildos, we pick one to toss out, so we do not exceed the 5 dildo cap.

I mean....that's what my friend does.  That's what he told me once.  And no, I don't have a good reason to explain why we were talking about dildos.  We just, uh, were....it was a real wandering conversation.  Yeah, that's what happened......Goddammit, where's the edit button?

More than six.  Six is the cap, which actually makes sense.  You want to leave one nostril unimpeded so as not to interfere with breathing (unless that's your thing).

There will be more to come - the state is not happy everybody decided to ignore this law. 

So renew your VPN subscriptions in the future if he wins the case.

are they considering the ones on alcohol sites that ask you birthdate "reasonable age verification measures to protect minors" as well?? I'd think they would need to comply in same manner since serving same purpose.

Texas has done this in the most counterproductive (and most Texas) way possible. Delta 8 THC and Delta 9 THC are widely available and completely unregulated here. There is a proportional weight limit, but I don’t think there’s an absolute amount limit per serving. And you can buy that shit anywhere, including shady independent businesses whose employees are more likely to sell to minors compared to the regulated dispensaries that operate in legal states. 

So weed is nominally illegal here. But it’s functionally far more available, especially to children. Which is completely fucked up.

My husband's cousin is a secret service agent and when Trump was in office, he got us passes to see Air Force One land when Trump was coming to Austin for something.
