We have a neighbor who wouldn't let their kids buy Nerf guns until they were like 10+, but they own multiple semi-automatic rifles and I know they don't secure them properly all the time.

Investigators say he 'unfortunately lacked the necessary speed and distance.'

A 21-year-old man has died while attempting to perform a “high-risk skiing stunt” trying to jump the width of a U.S. highway in Colorado, authorities say.

The incident occurred on Tuesday at approximately 3 p.m. when the Grand County Communications Center in Colorado received a 911 call regarding a skiing accident on Highway 40, just west of Berthoud Pass Summit about reports of a 21-year-old male skier who was found “unconscious and not breathing,” according to a statement from the Grand County Sheriff’s Office released on Wednesday.

“The preliminary investigation revealed that the victim was attempting to perform a high-risk skiing stunt by trying to clear the width of Highway 40 and unfortunately lacked the necessary speed and distance and subsequently landed on the highway pavement,” authorities said. “The victim had been wearing a helmet and other protective gear.”

Los Angeles police believe Danielle Cherakiyah Johnson, 34, posted on X as an astrology influencer and recording artist with the moniker "Ayoka," in the days leading up to the violence, which began hours before the eclipse peaked in Southern California, Lieutenant Guy Golan said.

While detectives have reviewed Johnson's posts, police are not considering the eclipse to be a precipitating or contributing factor to the slayings "because we just don't know why she did what she did," Golan told The Associated Press.

The Los Angeles Times first reported on Johnson's social media activities in connection with the killings.

"Get your protection on and your heart in the right place," she posted April 4 to more than 105,000 followers on X.

"The world is very obviously changing right now and if you ever needed to pick a side, the time to do right in your life is now. Stay strong you got this."

On April 5, she posted in all caps, "Wake up wake up the apocalypse is here. Everyone who has ears listen. Your time to choose what you believe is now."

Her social media also included a mix of antisemitic screeds, conspiracy theories about vaccines and warnings about the end of the world alongside astrological predictions and positive affirmations.

Also on April 5, she posted the word "LOVE" dozens of times.

Her personal website offers a variety of services including "zodiac healing work," "alcohol balancing system" and an "aura cleanse".

According to the Gonzales County sheriff's office, the child's confession came after officials in the Nixon-Smiley Consolidated Independent School District said the boy had referenced the killing and made new threats. That's when school officials involved law enforcement officers, who interviewed the boy at a child advocacy center.

“During the interview the ten year old child described in detail that two years ago he shot and killed a man in a trailer in Nixon, Texas,” a sheriff’s office release said. 

Brandon O'Quinn Rasberry, 32, died in his RV home in Nixon after being fatally shot on Jan. 18, 2022. Until last week, the case had gone cold. But now the 10-year-old child has provided law enforcement with more details about the crime he claims to have committed.

The boy told law officers he didn’t know Rasberry and was not angry at him at the time of the shooting. He was visiting his grandfather at the mobile home park, according to the sheriff’s office, and grabbed a gun from his grandfather’s truck.

“The Child stated he observed Brandon sleeping in his bed and approached Brandon and discharged the firearm into Brandon striking him one time in the head,” the release said. “The child stated as he was leaving the RV he discharged the firearm another time into the couch inside the RV.” 

Law enforcement later retrieved the gun from a pawn shop as evidence and collected shell casings from the mobile home park. The boy has undergone mental health evaluation and treatment, according to the sheriff's office.

 

“At the time of the murder the juvenile suspect was seven years old, one week shy of his 8th birthday,” the release said. “Therefore charges for murder will not be filed.”

However, authorities have charged the child in connection with a recent incident in which he is accused of threatening another student. The sheriff's office said that threat soon spiraled into the confession to killing Rasberry.

According to the confession, the boy had no known reason to kill Rasberry.

"The child was also asked if he was mad at Brandon for some reason or if Brandon had ever done anything to him to make him mad, the child stated no," the release said.

An Aurora man faces more than 400 years in prison after embarking on a late-night crime spree that began when he pulled a gun in a Burger King drive-thru after an employee refused payment in the form of drugs — possibly methamphetamine.

Eugene Robertson, 40, would go on to fire multiple shots and narrowly avoid being shot himself during the series of bizarre confrontations that he instigated on the night of Oct. 17, 2022, according to an arrest affidavit prepared by Aurora police.

Robertson was found guilty April 12 of eight counts of attempted first-degree murder with extreme indifference, four counts of menacing using a firearm and two counts of reckless endangerment as well as single counts of illegally discharging a firearm, possession of methamphetamine and harassment.

The employee of the Burger King near Alameda Avenue and Buckley Road told police he believed he was going to be shot and killed after turning down Robertson’s offer of a baggie of drugs. Instead, Robertson drove away and pulled up to the 7-Eleven at the northwest corner of the intersection.

DA’s office spokesman Eric Ross wrote in an email that a baggie dropped by Robertson at the 7-Eleven and recovered by police, which contained about 5 grams of methamphetamine, resembled the baggie described by the drive-thru worker.

A witness later told police that, when Robertson entered the 7-Eleven, there seemed to be “something off” about him, and that Robertson was “talking about God” and carrying a Bible with a purple cover.

Robertson and the witness got into an argument, and Robertson again drew his handgun and pointed it at the head of a store employee. Robertson then shot a television screen that was displaying surveillance camera footage of the inside of the store.

The witness ran out through a side door and retrieved his own handgun from his car. When Robertson walked outside, he started shooting at the witness, who returned fire.

Following the brief gun battle, during which neither man was hit, Robertson fled the scene.

About 15 minutes after responding to the 7-Eleven shooting and less than an hour after they were called out to the Burger King, Aurora police officers were dispatched to yet another 911 call involving Robertson, this time from a woman who reported that her friend, “Eugene,” had just shot at her apartment.

The woman said Robertson knocked on her front door, and when she refused to open it, fired at the door twice. He also shot once through a sliding glass door into the woman’s apartment, where multiple people were present.

Robertson lived in the same apartment complex, which is located less than a mile from Alameda and Buckley. Officers found the Audi that witnesses had said was involved in the two previous incidents parked nearby.

While investigating the shooting at the complex, police spotted Robertson, who tried to escape on foot by running through a bush. When he emerged from the bush, an officer shot at him and missed. Robertson was then arrested.

“During his arrest, Eugene said he was not physically hurt, but his ‘feelings were hurt,’” the affidavit said.

Officers also learned that Robertson had an outstanding warrant in connection with a March 2021 case where Robertson was allegedly involved in a vehicle crash and shooting, fled the scene, removed or lost his pants and flagged down an Aurora police officer, who arrested him on suspicion of illegally possessing a firearm.

Police wrote in the arrest affidavit associated with that case that Robertson said he had consumed marijuana and alcohol prior to encountering officers, which would have been a violation of a prior Arapahoe County court order.

“Robertson also spontaneously uttered that he was wearing white Nike tennis shoes and blue jeans prior to our arrival,” the 2021 affidavit says.

The same affidavit mentions that Robertson had previously served an 84-month sentence for felony distribution of crack cocaine, making it illegal for him to possess a firearm.

Robertson’s 2021 case remains open, while his sentencing for the recent convictions is scheduled to take place Aug. 9.

“It’s a miracle no one was seriously hurt or killed,” prosecutor Taylor McCreary said in the Thursday news release from the DA’s office.

“This defendant endangered countless lives that night by recklessly firing a gun.”

I have a buddy that is a big time hunter. Been all over the world killing critters and was even on ESPNoutdoors back when that was a thing on Saturday mornings. He has a large social media following so he does Q&A’s on Instagram periodically. Someone asked what sidearm he would recommend for hunting in bear country, and his reply was hilarious and true: whichever gun you want to commit suicide with because you can empty the mag and all you’re gonna do is piss that bear off.

That’s why you use a revolver lol.

A violent autistic teen who was caught on camera brutally beating a teaching aide last year is seeking legal recourse against a Florida school district for “failing to meet his needs.” Brendan Depa was arrested for aggravated battery and is facing up to 30 years in prison for assaulting an employee at Matanzas High School.

According to the Daily Mail, the 18-year-old teen, who is over 6 feet tall and weighs almost 270 pounds, is suing the Flagler County school district for “failing to meet his needs” after 59-year-old teaching aide Joan Naydich took away his Nintendo Switch.

In response to Naydich’s threat, Depa reportedly spat on her and chased her as she fled the classroom to report the incident to school administrators. Disturbing surveillance footage shows the teen, who was 17 at the time, pushing the teaching aide “to the ground before kneeling and punching her in the head and back” over a dozen times.

In the suit, Depa’s lawyers claim that Matanzas High School employees knew of his “disabilities, triggers, and problem behaviors,” along with his history of wrongdoings, including spitting, shoving an aide, intimidating school staff, and shouting at his teachers. It also highlights that because Depa is “a large black male student, he is subjected to misperceptions and racism.”

The lawsuit noted that “the school and staff working with him and the district knew that the electronics, specifically the Nintendo and its use on a school campus, was a trigger for escalating behaviors,” reads the filing, which describes the teen as a “ticking time bomb whose needs, despite concerns and warnings, were completed disregarded by the district.”

Continuing, Depa’s lawyers argued that the brutal attack on Naydich, who suffered from multiple broken ribs and a concussion, was due to the school district’s “failure to address his needs or have staff around him” with the proper training.

“This incident started with a paraprofessional and the student exchanging words and the student being reprimanded in front of his peers. He was punished by being denied his electronic device, even though other students were allowed theirs. The paraprofessional and the teacher began discussing his ability to bring electronics to school, in front of him and in front of his classmates.”

The suit also describes Depa’s behavior as a “self-defense” mechanism after hearing educators “talk about him in front of his other classmates.” His lawyers blame the entire incident on Naydich, arguing she should not have interacted with him in the manner she did.

“The paraprofessional should not have interacted with the student in this manner. Her and the teacher’s actions caused a predictable outcome. The IEP and behavior set out the evidence [of] interventions that should be utilized when a student misbehaves. The paraprofessional did not follow the plan and did not utilize an evidence-based strategy, putting herself in a dangerous situation.”

Despite Naydich expressing how the attack has negatively impacted her life, turning her into a “totally different person.” Depa’s lawyers are seeking “compensatory education and placement in a behavioral therapeutic school” at the school district’s expense as well as covering the cost of any “out-of-pocket costs including tutoring fees and mental health services.”

I mean....the other takeaway from that story is that our system has left a 90 year old veteran to starve.  I love seeing people step up and help, but story after story of people needing a Gofundme to pay for basic living costs, medical expenses, and the like....shit.  That's depressing.

A man is in custody on attempted second-degree murder charges after allegedly attacking another person with a hammer, police said Monday. 

Edward Kang, 20, allegedly flew from Newark, New Jersey to Jacksonville, Florida to confront the unnamed victim after a dispute through the online fantasy video game called ArcheAge, Nassau County Sheriff Bill Leeper said in a news conference.  

"This is a weird one," Leeper said. "Some things make you say 'Hmm.' Some things, you just can't make up. There are some things that make you say 'What in the world was he thinking?' And there are some things that make you say 'You're not going to believe this.' This case makes you say all four of those." 

Leeper said that Kang flew from Newark Liberty International Airport to Jacksonville International Airport and stayed at the Ocean Coast Hotel in Fernandina Beach since Friday. Once in Florida, Kang went to an Ace Hardware and purchased a hammer and flashlight, Leeper said. Receipts for the items were found in his hotel room. 

Kang was able to enter the victim's home in Fernandina Beach because the front door was unlocked, according to Leeper. Kang, wearing all-black clothing, gloves and a mask, attacked the victim, and the two ended up struggling on the ground, the sheriff said. 

Deputies were called to the home by the victim's stepfather, who reported being awakened by his stepson's screams for help. He told police he found his stepson on the ground struggling with Kang. 

Police found a "significant amount of blood" in the entryway of the home and in the victim's bedroom, Leeper said. 

Both Kang and the victim were taken to an area hospital. The victim sustained "severe head wounds," but they were not life-threatening, Leeper said. He has since been released from the hospital. Kang was released into the custody of the Nassau County Sheriff's Office. 

Kang allegedly told a deputy that the victim is "a bad person online," Leeper said, and asked how much time in jail he might serve for breaking, entering and assault. 

"I would say, 'Mr. Kang, it's going to be a long time before you play video games again,'" Leeper said. 

Kang is not cooperating with the investigation and remains in the Nassau County Jail, Leeper said. Jail records show that Kang has also been charged with armed burglary, in addition to the charge of attempted second-degree murder. Both are felony charges. 

Leeper said that the incident serves as a reminder that online altercations can spill over into the real world and stressed that people should exercise caution online, report suspicious behavior, and keep homes securely locked.

A man has been sentenced to more than six years in prison after hacking into a state database to fake his death, and get out of paying child support.

Jesse Kipf from Kentucky, in the US, was sentenced to 81 months for computer fraud and aggravated identity theft.

The 39-year-old admitted to accessing the Hawaii Death Registry System in January last year and creating a “case” for his own death.

Kipf then completed a State of Hawaii Death Certificate Worksheet, assigned himself as the medical certifier for the case and certified his death, using the digital signature of the doctor.

It meant he was successfully registered as a deceased person in many government databases.

Kipf admitted that he did it to avoid his outstanding child support obligations of more than $100,000.

The hacker also accessed other death registry systems and companies in unrelated attacks that he carried out using the stolen log in details of real physicians and workers.

He was found to be offering to sell access to the systems and selling stolen databases containing private information like Social Security Numbers to other cyber criminals on the darknet.

The darknet is a portion of the internet only accessible through specialist software that hides a browser’s identity. There are many darknet marketplaces where cyber criminals sell stolen data or access to compromised IT systems.

Kipf sold to international buyers, including individuals from Algeria, Russia and Ukraine, the court was reportedly told.

Depends on the evidence.  If this was a one-off, probably not.  If there's evidence of a known problem of scorpion infestation or prior occurrences, then maybe.

A 10-year-old has allegedly confessed to fatally shooting a former city councilman and his daughter, according to officials in Louisiana.

Officers in Minden, about 30 miles east of Shreveport, received a call at 6:30 a.m. Sunday about two bodies inside of a house, Minden Police Chief Jared McIver told ABC News.

Responders found Joe Cornelius Sr., 82, and his daughter, Keisha Miles, 31, dead from multiple gunshot wounds, he said.

The 10-year-old suspect -- who is related to the victims -- "confessed to the crime of murdering both," McIver said.

The 10-year-old, whose gender was not released, was at the house that morning and allegedly shot the victims between 6 and 6:30 a.m., the chief said.

A motive is not known, the chief said.

Two guns that belonged in the house were found hidden on the property, the chief said, and the shell casings at the scene were of the same caliber of the two guns.

Police are efforting an expert who specializes with children to interview the suspect and help determine next steps, McIver said.

"We still got to put some puzzle pieces together," the chief said. "The city can rest easy knowing that the suspect is off the street of a double homicide, but there’s also the shock factor that comes into play: How does a 10-year-old do this? There’s a sigh of relief, there’s a shock, there’s mourning, there’s just different emotions our city is running through right now. Only thing we can do right now is do this case the best we can."

1) I literally just got back from a weekend at the Venetian (Palazzo, actually), and I can happily share that I did not get stung on the junk by a scorpion, and 

2) as a result, my sex life (both there and afterwards) is just fine.

3) I HAVE, however, been stung by a scorpion in my own bed (it fell on my neck, from the ceiling), and while it certainly would have affected my mood at the moment, had my wife said "yeah, but are you in too much pain to get down and get freaky," I would have said "nope, I'm all good," because I am a living, breathing, male human being.

 

As for the legal claim, insect bite claims (there have been others) are really, really hard to win on.  Insects are "wild animals," and a property owner or employer is generally not going to be responsible for wild animals unless there are standout facts like there was a known infestation in the room and you rented it out anyway, or the property owner created conditions that invited dangerous wildlife in (leaving exposed trash so as to draw in raccoons, who then bite someone going into the building, might create liability).  Scorpions?  Yeah, it's the desert.  They exist there.  So long as there was no known significant infestation and failure to exercise reasonable pest control measures, there's not going to be liability.  Shit, we have regular pest control, we've taken measures to seal window and door thresholds, and when they are active, we still get scorpions in our house in W. Austin.  Nature exists.

Not at The Venetian, but I had a scorpion crawl up my pants leg at home. I was sitting with my legs crossed reading a magazine (you remember those) and felt an itch on my inner thigh next to El Guapo & Friends. I scratched it and all hell broke loose. I jumped out of the recliner trying to grab the motherfucker with my left while undoing my belt and blue jeans with the right (which I did in record time) while inventing break dancing. I stood there with my pants around my ankles and my right leg on fire. I counted 13 stings over 6 inches. Scorpion? He ded, but I smashed TF out of it anyway.

A Colorado teenager told deputies that he was shot in the face outside a house by the boyfriend of the homeowner after trying to ask for permission to take photos at the property, according to the Jefferson County Sheriff's Office.

The 17-year-old was taken to the hospital where he remains Wednesday evening, but according to a news release from the sheriff's office, he told deputies he and a friend went to a property in the 23000 block of Pleasant Park Road around 4:15 p.m. on Tuesday.

They jumped over the fence and tried to locate the homeowner to ask if they could take high school homecoming photos at their property. When no one answered, they walked around the property trying to find the homeowner or a resident. When they couldn't, they assumed no one was home and returned to their car, the sheriff's office said.

The homeowner called the police, saying the teens were trespassing. She then called her boyfriend, 38-year-old Brent Metz.

The woman was not home at the time and saw the boys on her home surveillance camera, according to the sheriff's office.

As the teens were back in their car, they began writing a note to the homeowner with their request to take photos at the property. That's when Metz arrived, got out of his truck and fired one round from a handgun into the teen's car through the windshield, striking one in the face, according to the sheriff's office. Investigators recovered the note, appearing to confirm the teens' story.

When deputies arrived, they said the uninjured boy was putting pressure on his friend's face with a t-shirt.

According to an arrest affidavit, Metz declined to speak to responding deputies, instead asking for an attorney. A deputy asked if there was a gun present for safety and Metz said it was in his truck.

Skydiving instructor at troubled California center gets prison time

A California skydiving instructor who fraudulently trained new instructors at the Lodi Parachute Center in San Joaquin County, including one who died while tandem jumping with an 18-year-old high school graduate in 2016, has been sentenced to two years in prison. 

Robert Pooley, 49, of Acampo, was sentenced on Monday after being found guilty in May of running unauthorized tandem skydiving courses at the beleaguered site in San Joaquin County that has seen 28 deaths since 1985. 

After Pooley’s certification as an instructor was suspended in 2015, he continued to train more than 100 new instructors using the digital image of the signature of another certified instructor to sign off on training courses. Pooley charged around $1,100 for each training course.

“Pooley falsely told students that he was a tandem examiner,” the U.S. Attorney’s Office said in a statement Monday. “After those deaths, numerous victims of Pooley’s scheme asked for their money back, but he did not repay them.”

One of Pooley’s trainees was Yong Kwon, a 25-year-old who had recently moved to California from South Korea. On Aug. 16, 2016, Kwon was paired with first-time skydiver Tyler Turner for a tandem jump. Both men died on impact in a nearby vineyard after Kwon was unable to successfully open either the main or reserve chutes. Turner’s mother, Francine Turner, described the tragic day to SFGATE last year, and characterized the scene at the Lodi Parachute Center as “hurried and rushed.”

Pooley has not been charged in relation to Kwon or Turner’s deaths. 

Following the Turner and Kwon crash, a wrongful death civil suit was brought against longtime owner of the drop zone William Dause. Turner’s family was awarded a $40 million judgment in that case, but told SFGATE in 2023 that they had not seen a penny. 

While investigating the 28 deaths at the Lodi Parachute Center, SFGATE revealed the murky level of regulation surrounding the sport that has a contentious history of oversight and accountability. The most recent skydiving deaths in California occurred in August when instructor Devrey LaRiccia Chase, 28, and student Kayla Black, 28, both died in a tandem jump at Skydive Perris in Riverside County.

Guida's three children, ages 2, 11, and 13, were inside their father's vehicle as the confrontation escalated, with Giddens allegedly shooting a rifle, striking Guida and the vehicle.

"The children could have been injured or killed as well," Maj. Aaron Turk, of the Catawba County Sheriff's Office told WSOC. "Thankfully, that did not happen."

"The amount of violence that occurred," Turk continued, "seemingly from two people who didn't know each other, it shocked me personally."

Giddens was taken into custody and is charged with one count of murder and three counts of attempted murder.
