From what I understand, that's incorrect.  A pardon can't be used to run an end-around on the 5th Amendment (note: I'm basing this on a discussion I heard on NPR from a gal who wrote a book on the pardon power and its history).  I found that surprising.

I would think you just use the Clear and Present Danger “Senator, I can’t recall.” Defense and call it a day.

Not a shocking outcome here. Part of it is this is his only living son. I would posit most of us would do the same thing if we had that kind of power to protect our child from prosecution. 
 

Does it make it right? No. I personally think Biden just finally said to himself “F it. You guys wanted me to step down as the nominee because I couldn’t win yet we still lost.” He is at least going to protect his son at this point. He has nothing left to lose. Caring about how he is remembered is not real important once you are dead and gone. That legacy stuff just matters to those still alive or the historians writing about it.

This is exactly right. You can’t vote to reelect a guy who is the single most corrupt person to ever hold office and then complain that some other guy abused his power. You’ve already shown that you don’t care.  It’s Biden’s age scandal all over again

It doesn't change the fact that Biden is a liar and this move (even if you think its warranted for many different reasons) tarnishes his legacy, feeds conspiracy theories, and removes some of the moral high ground Dems might have had previously.  They still have way more than Rs and Trump, but a little less than yesterday.

 

 

 

Point of order, to be a "liar" or commit fraud for that matter, you have to have the present intention at the time of the lie not to do what the lie says.

I imagine Joe meant it when he said it, but now that we're approaching Thunderdome, why the fuck not go back on your word.

He has made the case all year long that to prevent Thunderdome vote for Kamala (or him in earlier iterations).  I completely agree with him on that.

This is a good post.  Let’s think about how long the GOP has been outsourcing responsibility to the Dems.  The encroachment of the crazies is deep but there are still probably at least 50 percent of the party who aren’t, and they’ve just let the Dems take over so they can posture.

I'm still surprised almost 4 years later that Trump didn't offer blanket pardons to himself and his family member for unnamed crimes dating back as far as possible. Even if those pardons were later successfully challenged in court, it's not like the pardons would have harmed them.

I fully understand that the constitutional scholars are fairly in agreement that a President cannot pardon himself. But it wouldn't be illegal for Trump to attempt it and SCOTUS ruling on such a claim would always buy Trump time.

So do the following words: "If the president does it while he's in office, it's an official act."

That was the entire, valid point of concern about the dissent.  The POTUS could make a finding that Incredulity is a clear and present danger, have a drone strike hit your house, and there are zero repercussions.  Not a one.
