Trump is not a  consumer. Period. He did not seek or acquire any goods or services by purchase or lease. If this is specifically a DTPA case it doesn't get past a Motion to Dismiss.

Duly noted elsewhere.

Many things wrong with this lawsuit and that is probably the decider.  However, that post was in response to specific questions about jurisdiction and venue.

So breaking that Marist poll for PA:

The early vote/already voted from that poll is 63-35 Harris.  The "yet to vote" is 54-44 Trump.  You can tell the GOP has cannibalized some of their E-Day voters, while a significant number of Dems have shifted to E-Day voting, since 2020 E-Day was 65-35 Trump and the EV was 76-28 Biden.

Democrats also have a few more days to push their EV margins up, since Thursday-Monday are all mail ballot returns, no "in-person voting" until Tuesday.  GOP encouraged their voters to show up early, request a mail ballot and then immediately cast it, which is effectively what PA's early in-person voting is.

Also Smithley points out Marist nailed the 2022 Senate topline in their final poll, when others were trying to push it to a tie/Oz lead.

Trump has said 10,000 things worse than the Liz Cheney shit that is going viral today.

And I just want to say it's very frustrating how much Cheney has been in the Democratic spotlight for the last month. I understand the strategy but I don't like it.

And, while the Cheney quote is ridiculous, as Meidas is wont to do, it is out of context.

Meidas has some good reporting on some things, but can also be counted on to be quite hysterical and to propagate kind of shitty tweets.

But does yet to vote actually translate to will vote? I just don't see the enthusiasm on his side.

Nope, you also have to hope they turn out.

Also speaking of "nailed it" - EPIC/MRA wo did the Harris +3 poll for Detroit Free Press also was bascially the only pollster who called the 2022 blowout for Whitmer - the final few polls were Whitmer +6, 5, 11, 2, 4.  The +11 poll was EPIC/MRA and Whitmer won 54-44

So the Friday before E-Day, 2 of the pollsters that nailed PA-SEN and MI-GOV put out good polls for Harris.  I will take it.

But the true test is Sunday - Queen Selzer will speak.

That wasn't even all he said!

He called Biden a stupid bastard and called Harris a sleaze bag.

But Biden says a comedian is garbage and the media ran wild.

It actually has 120,00 of the newly registered as rural (27% of newly registered) and 111,000 of the registered but not vote group as rural (32% of the previously registered). Do we really think there are tens of thousands 2020 rural registered voters that didn't come out for Trump in 2020 and yet are going to come out for him now? That doesn't make much sense to me.

Right?  Oh no... the panhandle turnout is shooting up like crazy.  We now have to contend with at least 50-100 more Trump voters.  Like is there anyone left there that doesn't vote Trump?

Yeah, I'm wondering about this too. I assume he means Liz is quick to send troops to war but imagine if part of sending troops to war meant you grabbing a rifle and facing enemies too. I don't know.

But it's top of the fold at CNN.com and Drudge. At least somebody's running with it. If it sways anybody to vote for freedom, then I'm all for it.

I don't think any amount of context is going to make it anything but a terrible, despicable thing for a former president and current presidential candidate to say.

I know @BamaATL mentioned it, but in case it got lost, Georgia is confirming fast results on Tuesday.

All early voting will release about an hour after polls close and Georgia officials anticipate being done counting by midnight.

Hard for me to see this drag through the week - GA says they will finish Tuesday night, FL is fast, NC is pretty quick, Michigan/Wisconsin are quicker than 2020 and PA had a Senate call just after 1am eastern time, so there's 5 of your 7 swing states who could finish or be close to finished Tuesday night.  We will, of course, wait all week for NV/AZ due to how slowly they count the mail and how long it can be received for.

Right? Out of context doesn't mean anything when he is clearly using an example that makes his rabid base salivate.  Tie the quote to the other ones he's said about her and the likes of her and you can see what he's implying.

But you'll miss the fun of waiting 5-6 hours for Harris County to send the day-of voting results to the centralized reporting location by carrier pigeon.

Just imagine, Cruz leads Allred by 30,000 votes and we are just waiting on day-of Harris County votes.....

Yes please. I want to laugh at the loons in Arizona as they spend weeks counting and recounting just in an attempt to decrease Kamala's margin of victory.

Our goal today is to badger my wife’s best friend into voting today.  She’ll vote for Kamala/Allred, but we just got to get her there.  Her friend is a lawyer who was out of state all last week and has been “too busy” to go early vote this week.  She’s busy but she ain’t that busy.  And the reason she is busy is because she procrastinates and is inefficient with her time, but that’s a whole other story.

If she doesn’t do it today, there is very little chance she’ll do it on Election Day.  She’ll come up with some excuse that “I can’t wait in line for 2 hours. I’m too busy.”  So my wife is texting her constantly.  There’s an underserved voting center 10 minutes from her house that isn’t busy.

And there are millions of people in Texas just like our friend who would vote D but they just haven’t prioritized voting.

Drive to her house and fucking pick her up.  I did this with my friend in 2016 and she hasn't missed an election since.

Twice - You’re actually trying to apply the law. Unfortunately, Kaz-Know-Nothing doesn’t actually care about the law. He thinks God wants him to grant a victory to Trump and he will rule for Trump.

As you rightly point out, that will ultimately go through the 5th Circuit which is the most wretched hive of scum and villainy since Mos Eisley. In a 2-1 decision, they will uphold the Amarillo Moron’s decision.

Now, we’re at the Supreme Court. Thomas and Alito will threaten to show up at Court every day open carrying ARs if the Court takes the case. Ultimately the Court takes the case and Trump loses a 5-4 decision with Roberts and ACB joining the 3 liberal justices. Thomas pens a dissent written in crayon and blood that Trump should be able to file this lawsuit in Texas because he sent some nice Russians to his house and they fixed his RV which had broken down in Nebraska.

This timeline sucks.

This.  Lawyers on here.  Discussing the law.  Yet, not fully grasping the truth that when it comes to the Amarillo division, the 5th Cir., and SCOTUS....the "law" doesn't matter.  At all. As in, it matters 0.0%.  They will rule how they want, for who they want, to get the result they want.  And that's it.  That's the entire game.

In much of this country, "the rule of law" does not exist anymore.  As someone whose entire career is based on the premise of, you know, laws and shit like that, this has been the most troubling development of this timeline.  I now have to advise clients "it doesn't matter what the law says, think about how Fox News would want this case to go, and that's how it will go."

Not to mention "9" is a pretty specific reference.  Obviously not all firing squads have 9 members, but most are close.  Here's one:

Pretty much. D9 gummies are effectively the same thing you get in any legal state and THCA flower becomes regular flower when you smoke it. The only thing really not up to level would be your store purchased vaping products, which is probably smart to stay away from anyway. You could always make your own from TCHA flower though.

Young Americans with good prospects are very much considering their options around both the political climate and the climate climate, and it's influencing the way the approach dating. Being a single person with multiple passports/citizenships is as good in eligibility terms as being rich or a high income/status professional right now. Not joking.

Well no, in-person early voting in PA is basically being handed a mail-in ballot, filling it out and handing it back.  It's kind of dumb, but it is essentially "in-person early mail voting."  These in-person requests categorize as a requested mail ballot, which is why the GOP's request and return rates increased last week.

The only true "in person voting" by machine is Tuesday.
