Would he had to have failed a field sobriety test for them to take him in for DWI with a pen on him vs just charging with possession? Or is the speeding and having it on his possession enough for DWI? If he failed a field sobriety test, charge seems legitimate regardless of substance of cause. 

I’m guessing there were driving facts other than speeding. In fact, I haven’t seen the “speeding” allegation other than on this board, but you definitely need more than speeding and THC for DWI. You’d want a blood draw, driving facts that suggest impairment and failed SFSTs. I don’t know how much of that was present. There will be dash camera footage for driving facts and body camera of the standardized field sobriety tests (SFSTs).
 

Either way, I expect him to get a good lawyer and end up pleading it down to an obstruction of the roadway or some sort of pre-trial intervention.

Speeding was in the news article. Down W 6th at 2am.

I'm assuming the pen was (for now, legal) Delta 9 THC, and not marijuana, as possession of marijuana oil in concentrate in any amount is a felony. He still could get a ticket for underage possession of a controlled substance, or something similar, as you have to be 21 to buy that shit. I'm not a lawyer. Either way, the DUI smells like bullshit.

Ehhh, just suspend him for OSU game (which he wasn’t going to play in anyway) and make him run some extra laps after practice for a couple weeks.

Nah. If he blew a 0.0, and was just speeding with a legal vape pen, it sounds like he got railroaded by a shitty cop. Not ideal judgment, but to me this is a big fucking nothingburger. And as always:

Exactly. If it were a true thc vape pen, best believe he'd be hit with the felony. And I don't see how one would speed on 6th on the weekend, either. Copper probably saw him (black), saw him hitting the pen, then ran him through the gamut.

Really? That's one of those 'vape' thingies? Sweater gawd I thought it was a gold felt tip pen when it caught ny eye on the sidewalk. I love writing utensils, that's a fact. Did I tell you about that Mont Blanc pen I found at the bank when I went to cash my NIL check? Need to find some cartridges for that thing, ink cartridges, you know.

One the one hand, 17 over at 2:00 AM on 6th street is straight up asking to get got. 

On the other hand, it was the 900 block of W. 6th. Coming up to a pretty good straightaway leading to Mopac. I've been pretty heavy footed myself at that intersection. Still dumb to do it high, but let he without sin yada yada yada.

My mom was a police dispatcher for APD for 15 years, so I'm typically very lenient with my accountability of the police department. that being said, In Austin right now if you call for a cop for anything non-life threatening, it can take hours to get one to show up. This dude had better shit to do at 3am, and the speed limit for this intersection is obscenely low compared to the flow of traffic. It was bullshit. I don't support that he got high and drove, but I'm also someone who smokes marijuana in my free time and don't see it as a problem. He was just dumb for driving and not taking an uber.

It's been a while since I went bar hopping around the Don's Depot, but isn't most of the action west of Lamar down on 5th street? And even then, it's mostly busy before midnight? I've never seen that many pedestrians on that part of 6th. 

But again - it's been a while. Shit changes fast in Austin.

Looks like he was stopped east of Lamar on W 6th -- where all the bars are.

Yeah, that is the exact time a bunch of drunk people get dumped into the street at the same time.  West sixth has quite a few bars right in that area. 

 

On the other side, 17 over sounds bad, but most are doing 45+ on that street all day every day.  Probably an officer looking for a reason to pull people over and see if they just left a bar after drinking all night.  In college I got pulled over in a similar area for not using my blinker at 2:30 AM.  Luckily I was getting off of work, hadn't been drinking and was let go fairly quickly.  It's pretty standard in that area to try to catch drunks leaving bars.  Whether we like it or not is a different discussion.

There's several random bars there.  Star Bar, Little Woodrow's, Buford's and others.  While not packed with bars, also not completely empty.

I think my bearings must be off - I thought he got pulled over closer to Whole Foods. If he was down by Star Bar then it's significantly dumber.

Suspend him a couple games for speeding at 2am while high but also for being a dumbass and telling the cop he's high and going to 21+ clubs.

This certainly isn't a bad offense for a college kid but good learning opportunity. Can't let blatant stupidity go unpunished even if it's something 90% of people have done in college.

I don't blame the cop for pulling him over or even arresting him for the suspicion of driving while impaired.  But to put the statements in the paperwork that have nothing to do with arrest but are derogatory to young men who have nothing to do with the arrest and fine entertainment establishments is just bush league.

I'm not saying the police report is inaccurate, but there's a reason body worn cams and dashboard cams became a thing. Anyone know if either were in use during this incident?
