Nice tidy haul from CO.  I smoke a lot of pot, so I fucked up buying the flower...and the guy behind the counter let me do it, but whatever - won't need to buy any weed for a long ass time.  The Little Smokey's are fucking perfect - just the right size for a quick buzz.

We live in Colorado, I have an autistic son with a medical license who has used the Ripple for quite some time, can’t even begin to explain how much of a difference it has made over the heavy psych meds and Benzos, he is way more of a functional person in day to day life.

As sold, it contains less than the legal limit of delta 9 THC. But it has plenty of THCA which, when burned, decarboxylates to delta 9.

Oh I'm aware of the "legal alternatives" available in Austin, and occasionally buy some edibles, but the flower I've tried just doesnt seem "right." Regardless, axing that loophole seems to be a big priority all of the sudden for Lt Dan, so I fully expect it to be closed this year now that its not an election year.

Fair enough. Like I said, I can’t vouch for the stuff (I haven’t smoked in over a decade). Just relaying what pleasantly surprised stoner friends have reported.

Keep in mind fed laws and state laws - including Texas - regarding cannabis use while in possession of a firearm get pretty complex. Having a medical mj license from your state may prevent you from passing the fed background check when attempting to purchase a gun.

That’s why I’m glad for the very few things this state I’m in gets right. 
 

First, just because you are under the influence, doesn’t mean you lose your other rights. So just being intoxicated and in possession of a firearm doesn’t mean shit.

Now, go on and do something stupid, you’re fucked. But as long as you ain’t botherin nobody, no crime. You know, since there are already laws on the book that cover those things.

Next, medical card holders are held as private information, between you and the state. It is absolutely not released to anyone. Including the feds. If that were to happen, the lawsuits would bankrupt the state for violating the state constitution.

Let me rephrase that to clarify.

The state is not allowed to share any information regarding the status of a medical card holder, outside of the medical program. A dispensary can verify your card, and see if you have allotment available (however much per month, rolling calendar.) That's it. That information is not shared with anywhere else. Not the feds, nobody.

Question it all you want, however that is how it is. It will not show up in any background investigation. It's treated as it should be.

Florida here but I have guns, CCL and med card. Where it gets dicey is you better not be caught with a gun and weed. That's straight to jail period. However, cops don't know you have a med card, as previously stated that is a HIPPA violation. Are there ways to find out, sure but then that's a argument to be made in court afterwards.

When I buy ammo, they have a sign that says they can't sell ammos to med card holders. But legally they can't check, so guess what...I'll take my ammo please. Prior Ag commissioner for State of Florida filed a lawsuit for this excat reason, still pending.

I bet there are plenty of people in NY who said the same about NY being a "Safe state" for abortion. This asshole is shameless in suing other states to try to fuck over fellow Texans.

There are problems with how that relates to the discussion.

First, I'm not in Texas. Second, where is there an issue with state to state?

I've simply said that information as to who has a medial card in my state, is not information made available outside of that system. It cannot be let out of that system, according to the state constitution. It will not show up when you get pulled over, it will not show up. Background check from your employer? Won't show up. Federal background check? Nope, won't show up.

Which is all I've said. Where suing to get that information came from, or has to do with the price of condoms in China, you got me. Who would sue for it? Why would they? There's nothing to gain there. There are no grounds.

There is no grand conspiracy. There is no smoking gun or "wink wink." Nothing. Nada. Zip. Zilch.

I'm not sure what your problem is today, but really, tap out man. This just isn't your day. I'm saying that out of respect to you personally, as you normally seem like a decent person.

The answer is he doesn't. Why you've taken this conversation into whatever weird territory this is perplexes me. He has absolutely nothing to do with another state's medical program. The courts here certainly would tell him to fuck right off for not having grounds, let alone jurisdiction. This isn't a state to state issue, and has not a single thing to do with anything I've posted. People from other states are not flocking to our state to get a medical card, buy products from the dispensaries here, and take it back home to Texas. Shit doesn't work like that. Of course they could easily purchase on the recreational side, but that's not illegal. Anyone 21+ can walk into a dispensary here and purchase cannabis in various forms.

And yes, this state will absolutely tell another AG to fuck off. They have. They did it with concealed carry permits, which have similar disclosure protections. There is not one valid reason for anyone outside this state to need information as to whether or not someone has a state issued medical card. If they take it out of state back to where they live, and it's illegal there, guess what? It's illegal there. Has absolutely zero bearing and provides zero ground for anyone to try and get a list of everyone with a medical card in this state. None. Zero. Zip. Zilch.

OTOH, I do. I am also very connected into regulations of not only our medical program, but recreational as well. So please, maybe that's how it is where you are, but it does not work like that around here. Maybe that's hard for you to believe or accept, but it is absolutely how it works here.

And what suing someone has to do with whether or not your card shows up on a background search (what started this discussion) has nothing to do with that line of discussion. For me, in my state, it absolutely will not show up on a background check, for the reasons I've mentioned previously.

While I will agree that there are some issues with what we have, patient privacy is absolutely not one of them.

The issue is not so much your State, it currently boils down to buying a gun and failing to disclose drug use when you fill out that fed form. If you tell the truth, you're not getting a gun; if you don't, you've perjured. Ask Hunter Biden, that's one of the get out of jail free cards his daddy just handed him. 

We all need to be aware that government agencies do, in fact, have access to pertinent information. If they can't get it in "legal" ways, it can't be used in court. But be sure they have it. For example, your internet (including phone) use is widely surveilled and available. If something suspicious is encountered, a simple "confidential informant" message is enough pc for a warrant, court order, etc. to see your hipaa info.

Is it routine? No, but it's there. Back to the intial part: you go buy a gun, fill out the fed form and leave off your use of whatever drugs they're asking about these days, you just committed a crime, and if they wantcha, they gotcha.
