Right, same as it always has been. If you use illegal drugs, you are obligated to report it on a federal form.

No different for someone buying under Rec. But then again, just because someone makes a purchase at a dispensary, medical or rec, also doesn’t mean they purchased  cannabis.

Many dispensaries also carry other related products like terpene enhanced products, cbd/n/g, etc.

And even in places with rec, many people still get cards for the lower taxes, and even prices in some places.

But yes, again, technically that is the issue.

However it isn’t as cut and dry to prove it these days as it used to be even 10 years ago.

And lets be honest here, the feds don’t care about weed any longer. If they did, they would have put the brakes on it when it started. They didn’t, and the cat’s out of the bag now and they know it.

On the TSA website it expressly states, in one of their faq’s about legal states, that they aren’t looking for cannabis. They don’t care. That’s not the ATF, but it shows how little the government cares about it.

Sure, if you’re doing a bunch of other shady shit and the feds need a reason to get you held in the system long enough to finish building their case for whatever else, then they might try it. 
 

For the average person that has their nose clean? While possible, I wouldn’t say probable. If it’s really a concern, don’t fill out the form and buy private and problem solved.

But at least if someone here, who had a card, wanted to take that risk, it would not show up in a background check. So they’ll clear that, provided everything else checks out.

We all need to be aware that government agencies do, in fact, have access to pertinent information. If they can't get it in "legal" ways, it can't be used in court. But be sure they have it. For example, your internet (including phone) use is widely surveilled and available. If something suspicious is encountered, a simple "confidential informant" message is enough pc for a warrant, court order, etc. to see your hipaa info.

Is it routine? No, but it's there. Back to the intial part: you go buy a gun, fill out the fed form and leave off your use of whatever drugs they're asking about these days, you just committed a crime, and if they wantcha, they gotcha. 

 

Just for googgles, I checked on "under what circumstances can law enforcement obtain hipaa records", and here's the top, AI, reply.

Went out for a little exercise on the Violet Crown trail yesterday morning, with less than desirable results:

This is the worst of it, visually, but not even close to all of the damage. My eye slammed, so I’ve got a big ass scab under it and it’s swollen up pretty good - enough to affect field of vision. Likely a cracked rib or two, so literally every movement hurts. Nothing a couple days of rest won’t heal, but I’m hurting’ for certain right now.

Ugh. Fuck this.

I used Hometown Hero gummies to quit drinking 2 years ago. It fucking worked.

But sure, keep that shit legal. It only kills innocent people daily on the roads.

Last year, I decided I didn't like driving through bumfuck west Texas with even perfectly legal gummies, so I have a big jar of D8 hidden in my in-laws' house in DFW.

Texas is so fucking stupid. I’ve been saying for years that the current legal regime was fucked up. Without regulation, it was relatively easy for kids to get their hands on shady, untested THC products.

The solution was obvious: legalize weed (or at least maintain legality of hemp-based products) and regulate the industry. You know, like sensible states do.

But Texans don’t do regulation because we value freedom and hate big government and all that jazz. So instead, we just straight-up ban the shit, blind to the glaring irony and deaf to the laughter of rational observers.

Most companies state that the person ordering them is required to be aware of local laws.  Because it's legal federally, they'll ship USPS, aka the largest distributor of contraband in the US.

Any chance the House doesn't pass it? They seem like the more reasonable chamber (at least compared to the Senate, which is obviously not saying much).

I believe the house bill is more toward regulation than a ban.  ICBW.  So if the house passes its bill, there may be some reconciliation.  But I fear this will be like a compromise with my wife, i.e., she wants vanilla ice cream, I want chocolate ice cream, so we compromised and got vanilla ice cream.

In Texas, I was paying about $1.50 each for a 50mg D8 gummy.

In Colorado, the real gummies I buy are $0.80 each.  Pre-rolled joints are $6 each at the place I go most.

In 50-75 years, very few people will be drinking.

I'm getting some great Oklahoma shit right now. One of my best friends is staying in an RV spot, that I pay for. His wife works at a dispensary. I'm getting shit that I would have to pay a lot of money for, and they are getting 2-4 times the value of what they pay for it. Win-win.
