Lawyer help

I am looking to see if anyone here is or knows Dan Kelley. He is an attorney with Hoffman and Kelley and owns land near mine. I need to speak to him about some stuff that is happening on his property. I have tried calling the firm and never received a response. Hoping one of you lawdogs know him and can help get me in touch.

 I spoke with him and I hate people even more than before this convo. 

So today I was cutting wood in the middle of camp when I heard a gunshot. I had one earbud in my ear and thought I heard a buzz over my head. I took my earbuds out and put my kids inside. I was standing listening and all of a sudden maybe 10 shots rang out. Ricochet bullets started flying all around. One hit feet from me as I ducked behind cover.  The shooting stopped for 30 seconds or so, I jumped in the mule and drove the long way around sorta behind where they were shooting honking my horn the whole time. I went to their fence line which is 100 yards from where they were shooting, yelling at them to stop. A guy came over and apologized. Claimed the owners son was somewhere "over there." I later found out I spoke with the owners son (who is a firefighter in Grand Praire that would never discharge firearms in an unsafe manner!) from ole Dan. They immediately packed up and left when I went back to camp to make sure none of my people were dead. 

Reached out to the gamewarden and sheriff but they couldn't do much other than make a note since they fled the scene.

Dan claimed we or someone were shooting at them oddly, he wasn't there and we never shot this weekend other than 22 subs my kids shot into a giant berm the opposite direction over a mile from their property.  Then he claimed they shot the opposite direction from our property despite me hearing gunshots from their property (the only one that direction for 100 acres) and immediate hail of bullets landing right fucking into our camp. Again, Dan was not there that I saw. Just 5-20 somethings. No 63 year old lawyers. The fact is, nobody TRIED to hurt anyone. This was simply an accident that I never want to happen again. Dan went full lawyer and denied everything. 

DAN KELLEY decided to try and take it to 11 with me. He is a garbage human and if you make money with him just know his firefighter son and their friends were very close to allegedly, committing manslaughter today.

Well he sounded like a drunk on the phone. Immediately started throwing out all sorts of shit before I told him anything about what happened. Honestly, it was the nicest I have ever been to anyone considering I almost got shot. I have been meaner to neighbors who parked in front of my house (heh) than I was with him. 

Sheriff has his sons info so we will see if the fire fighter has any honor. Doubt it based on his raising. Either way, the Sheriff is aware and if they show up again he told me to call him and he would go put the fear of God in them. He was pissed to hear my kids could have got shot.

David Connor Kelley is a Firefighter-Paramedic for the city of Grand Prairie Fire Department.

The City of Grand Prairie is a Civil Service Fire Department.

Under Texas Local Government Code Ch. 143, Subchapter D, Sec. 143.051, a firefighter can be removed or indefinitely suspended (fired) on several grounds, some of those being (1) conviction of a felony or other crime involving moral turpitude; (6) acts showing lack of good moral character; (8) conduct prejudicial to good order.


All of the above sound like they would apply to the below Texas Penal Code, which David Connor Kelley most definitely violated


Sec. 22.05. DEADLY CONDUCT. (a) A person commits an offense if he recklessly engages in conduct that places another in imminent danger of serious bodily injury.
(b) A person commits an offense if he knowingly discharges a firearm at or in the direction of:
(1) one or more individuals; or
(2) a habitation, building, or vehicle and is reckless as to whether the habitation, building, or vehicle is occupied.
© Recklessness and danger are presumed if the actor knowingly pointed a firearm at or in the direction of another whether or not the actor believed the firearm to be loaded.
(d) For purposes of this section, "building," "habitation," and "vehicle" have the meanings assigned those terms by Section 30.01.
(e) An offense under Subsection (a) is a Class A misdemeanor. An offense under Subsection (b) is a felony of the third degree.

It is also a crime to discharge a firearm across a property line per Parks and Wildlife Code.

if it happens again, record it on your phone, and a phone in your front shirt pocket sure makes a good body cam

 

 

Sec. 62.0121. DISCHARGE OF FIREARM ACROSS PROPERTY LINE. (a) In this section, "firearm" has the meaning assigned by Section 62.014(a).

(b) A person commits an offense if:

(1) the person, while hunting or engaging in recreational shooting, knowingly discharges a firearm; and

(2) the projectile from the firearm travels across a property line.

(c) It is a defense to prosecution under this section that the person:

(1) owns the property on both sides of each property line crossed by the projectile; or

(2) has a written agreement with any person who owns property on either side of each property line crossed by the projectile that allows the person to discharge a firearm on, over, or across the property or property line.

(d) The written agreement required under Subsection (c)(2) must:

(1) contain the name of the person allowed to hunt or engage in recreational shooting in a manner described by Subsection (b);

(2) identify the property on either side of the property line crossed by the projectile; and

(3) be signed by any person who owns the property on either side of the line crossed by the projectile.

(e) An offense under this section is a Class C Parks and Wildlife Code misdemeanor.

(f) If conduct constituting an offense under this section constitutes an offense under a section of the Penal Code, the person may be prosecuted under either section or both sections.

Yeah, it just happened so fast and my number 1 fear was my kids being hit so I was not operating in that capacity. It was in full survival mode. I am 100% mentally ready for this if it happens again. I will immediately call the sheriff, start recording and document everything I can with video/pictures.

Funny part of this is that the owner was super concerned how I got his personal cell number. My response was:

My wife was a landman and her good friend is a PI. I should have just started there. I am slipping. Didn't even think about all that when I posted. We know shit about these folks that would terrify them. My only goal is to make sure my kids are safe in the country.

Especially some bat-shit crazed lawyer who is already shooting at you.

His kid or friends did the shooting. Danny wasn't there. I was very clear I am not a threat, I just want the shooting to be done safely.

I have a plan moving forward. I have the sheriff's cell number. Everything I do will be above board. I am not crazy. I have 2 sons and a wife I want to live a long life along side.

Not worried about that guy.

One of my wife's sisters used to live in an unincorporated area close to Bastrop.  5-10 acre lots, flat as a board (the lots, not my wife's sister, no pics).  Some jackass was taking target practice with a rifle and manged to shoot and kill a kid jumping on a trampoline hundreds of yards away, if not more.  One in a million sucks when you're the one.

Something very similar happened in Hays County a few years ago as well.  Guy shooting a .22 rifle and killed a kid.  People think .22 are great and safe for target shooting not realizing a .22 can carry over a mile.  @HOOKEM4 is 100% right by contacting the landowner and the authorities.

I am hoping that I solved the problem. Despite the dad's reaction, I bet he still chewed his kid out about it. Firefighter could have ruined his life. Dad could have lost his spot. If one of my kids died, I would have never posted this. I would be dealing with TDC. 

Crazy thing is this weekend was about shooting a bolt rifle and gun safety. Teaching the boys how to operate with firearms. Safety safety safety. Might have actually been a great lesson. Could have been really really bad. I want two boys that respect guns, know they are not a toy, and know how to use them.

That was it, I had the wrong hamlet.  They lived outside of Niederwald, not Bastrop.

Definitely a good lesson for them. I bet things settle down and they were just dumbasses. But record and inform law if things get weird since they will be on your side for sure

I’ve noticed some firefighters can be extremely reckless/ irresponsible. Used to rent jet skis a long time ago and they were always the worst customers. We would have to cut them off. The owner loved them though since he would gouge them on the damages they did.

You’re not wrong. I have long contended that if fire and ems were to ever be put under the same microscope as law enforcement, public opinion of us would be about the same as the cops these days.
